I have scrutinized the photocopies of the documents which handed
over to me and I have given below my opinion.

SCHEDULE OF PROPERTY

All that piece and parcel of House, Ground and Premises bearing
Old Door No.31, New Door No.128A (128/A situated at Kamaraj Salai),
Kodungaiyur, comprised in Old Survey No.119/1, 119/2 as per TSLR
Patta Old Survey No.119/1B, Door No.31/128A, T.S.No.93, Block No.30,
Ward No.001 of Kodungaiyur Village, Perambur Taluk, Chennai District,
measuring an extent of 1190 Sq.ft.

TRACING OF TITLE:

1. From the recital and perusal of the photocopies of the above


documents it is learnt that originally Item No.1& 2 Schedule
mentioned Property measuring an extent of 2863 Sq.ft. originally
belongs to one Mr.G.Balan who had purchased the same by way
of registered Sale Deed dated 10.04.1960 vide., Document
No.1061/1960 registered on the file of SRO Sembium.

2. Thereafter, Item No.1& 2 entire schedule described property was


sold by Mr.G.Balan to and infavour of Mr.P.Sadhasiam, Son of
Perumal which is evidenced on perusal of the registered Sale
Deed dated 16.06.1965 vide., Document No.2236/1965
registered on the file of SRO Sembium.

3. It is learnt that the said Mr.P.Sadhasivam was in absolute


possession and enjoyment of the property by putting up
construction over the same and enjoying the above schedule
described property by muting all the revenue records in his
name. subsequently Mr.P.Sadhasivam had died intestate on
29.12.2006 leaving behind his wife Mrs.Parvathiyammal, and
his 4 sons Mr.S.Raghavan, Mr.S.Narayanan, Mr.S.Nagarajan,
Mr.S.Krishnamurthy as his surviving legal heirs which is
evidenced on perusal of the photocopies of the Death Certificate
and Legal Heirship Certificate of Mr.P.Sadhasivam.

4. It is stated that subsequently Mrs.Parvathiyammal, wife of


Mr.P.Sadhasivam died on 14.09.2015 leaving behind her 4 sons

as the surviving legal heirs of the above schedule mentioned


properties who were equally entitled for the same. Thereafter,
the Four sons of Mr.P.Sadhasivam, viz., Mr.S.Raghavan,
Mr.S.Narayanan, Mr.S.Nagarajan, Mr.S.Krishnamurthy who
were his surviving legal heirs had decided to sell the schedule
mentioned properties to M/s.Hemalakshmi Civil Contractor,
represented by its Proprietrix Mrs.Hemalakshmi by way of
registered Sale Deed dated 01.02.2021 vide., Document
No.679/2021, registered on the file of SRO Madhavaram.

5. With regard to the above Sale Deed dated 01.02.2021 registered


as Document No.679/2021, there was an error occurred during
the digitalization of Patta with regard to the Survey Number
which was found through the TSLR Patta and the same was also
rectified by vendors viz., the legal heirs of the way of Registered
Rectification Deed dated 28.12.2021 vide., Document
No.8749/2021 registered on the file of SRO Madhavaram.

6. It is found that M/s.Hemalakshmi Civil Contractor, represented


by its Proprietrix Mrs.Hemalakshmi had proposed for
construction of an Apartment under the name and style of “SRI
CHAKRA APARTMENT”, for which she had also obtained
necessary building construction plan approval, demolition and
reconstruction for Ground plus Two Floors each containing
three houses, which is evidenced by way of the Building
Planning Permission for construction in the Western Side
portion of the Schedule mentioned properties and also paid
necessary charges for such demolition and reconstruction which
is evidenced by vide., Chennai Corporation Planning Permission

No: PPA/WDCN04/01114/2021 and Building Permission


No.BA/WDCN04/02479/2021 and the receipt issued by CMDA
dated 26.04.2021 issued by the Corporation of Chennai.

7. Thereafter the owner of the property M/s.Hemalakshmi Civil


Contractor, represented by its Proprietrix Mrs.Hemalakshmi
becomes the absolute owner and also made construction of the
Apartment comprising Ground+2 Floors each consisting of Three
Flats and also entered into construction and Sale Agreement
with the buyers.

8. Further right from the date of the above cited documents in


respect of the above Item No.1 & 2 schedule described property
the said M/s.Hemalakshmi Civil Contractor, represented by its
Proprietrix Mrs.Hemalakshmi being the owner of the Schedule
mentioned property with absolute possession and enjoyment of
the said property.

ENCUMBRANCE CERTIFICATE
And Encumbrance certificates verified for the period from
01.01.1987 to 28.01.2021 disclose Nil Encumbrance. (The said has to
be scrutinized till date)

OPINION:
      Above said property in respect of Item No.1& 2 schedule mentioned
property spread out in Old Door No.31, New Door No.128A (128/A
situated at Kamaraj Salai), Kodungaiyur, comprised in Old Survey
No.119/1, 119/2 as per TSLR Patta Old Survey No.119/1B, Door
No.31/128A, T.S.No.93, Block No.30, Ward No.001 measuring an extent
of 2863 Sq.ft. situated in Kodungaiyur Village, Perambur Taluk,

Madhavaram Sub-Registration District and situated within the


Registration District of Chennai-North.

I hereby tender my opinion that M/s.HEMALAKSHMI CIVIL


CONTRACTOR, represented by its Proprietrix Mrs.Hemalakshmi is the
absolute owner of the schedule mentioned property having a clear and
marketable title of the said property.

Note:
1. As per the documents which handed over to me, I give the above
opinion.       
2. Since Completion Certificate is not handed over to me for my
perusal, the property can be purchased if CMWSSB and TNEB
Connection is obtained in respect of each Flat Portion separately in
the name of the owners of the respective flat.
