JUDICIAL COUNTER AFFIDAVIT OF JOHN HOWARD O.

ROLDAN

I, JOHN HOWARD O. ROLDAN, 28 years old, married, carpenter,

and a resident of Namboongan, Sto. Tomas, La Union, state under oath as
follows:

1. That I executed this Judicial Counter Affidavit to serve as my direct

testimony in this case;

2. That this Judicial Affidavit is being offered:

a. To prove my innocence in this case and all the material

allegations stated herein;

b. To identify documents and to testify on other relevant matters in

relation to this case;

3. That the QUESTIONS were propounded by ATTY. MARIA THERESA

AMOR C MANUEL-SOBEJANA, in the English language translated
into Filipino, our official language, and the ANSWERS were given by
me also in Filipino which was translated in the English language as
written hereunder;

4. That the examination was held at the Public Attorney’s Office, Agoo,
La Union, by ATTY. MARIA THERESA AMOR C MANUEL-
SOBEJANA of the PUBLIC ATTORNEY’S OFFICE Agoo District Office,
Agoo, La Union;
 5. That I answered the questions asked of me intelligently and truthfully
with full consciousness under oath and all are based on my personal
knowledge and/or authentic records; and

6. I fully understand that I may face criminal liability for false testimony
and perjury.

The following were questions propounded to me by ATTY. MARIA

THERESA AMOR C MANUEL-SOBEJANA, with my corresponding answers
to wit:

1. Q. Do swear to tell the truth and nothing but the truth in this
examination?
A. I do.

2. Q: Are you aware that the questions that I am propounding and the
answers that you will be giving will form as your direct testimony in
this case?
A: Yes, Ma’am, I am aware.

3. Q: Are you also aware that you are under oath and that you are liable
to face prosecution for perjury and false testimony in case you
knowingly give false statements?
A: I am aware, Ma’am.

4. Q: Are you the same JOHN HOWARD O. ROLDAN, who is the accused
in Crim. Case No. Ar-5559 for Reckless Imprudence Resulting in
Serious Physical Injuries and Damage to Property pending before the
Municipal Trial Court of Aringay, La Union?
A: Yes, ma’am.

5. Q: Where were you on October 23, 2021 at around 9:00 o’clock in the
evening?
A: I was then driving my motorcycle (mitsukoshi euro sport) traversing
the northbound lane of the National Highway along Brgy. San Benito
Sur, Aringay, La Union taking the necessary precautions.

6. Q. While you were traversing the northbound lane of the National

Highway along San Benito Sur, Aringay, La Union on October 23, 2021,
what happened next?
A. A speeding motorcycle coming from the west direction driven by
one ALDRIN RABOT Y CAOILE suddenly emerged on the
northbound lane just in front of my driven motorcycle.

7. Q. After a motorcycle suddenly appeared on the northbound lane just

in front of your driven motorcycle, what happened next?
 A. I veered my driven motorcycle to the right, particularly to the
shoulder of the northbound lane to avoid hitting the speeding
motorcycle driven by one ALDRIN RABOT Y CAOILE but the latter
also quickly headed and treaded the shoulder of the northbound
lane and as a necessary consequence my driven motorcycle
bumped the motorcycle driven by one ALDRIN RABOT Y CAOILE.

8. Q. What happened after your driven motorcycle bumped the

motorcycle driven by one ALDRIN RABOT Y CAOILE?
A. I was thrown off my motorcycle. ALDRIN RABOT Y CAOILE and his
female back rider, ROXANNE ORDOÑO, fell on the roadway.

9. Q. What happened next?

A. Members of the Aringay, La Union Municipal Police Station arrived.
They subsequently brought me, ALDRIN RABOT Y CAOILE and
ROXANNE ORDOÑO to the Caba, La Union District Hospital,
Caba,ion.

10.Q. Do you have any other statements you wish to add?

A. Yes Ma’am. It’s the fault of ALDRIN RABOT y CAOILE why the
vehicular accident subject matter of this case happened. The reason
why I bumped the motorcycle driven by ALDRIN RABOT y CAOILE
was because the latter was then speeding when he entered the
National Highway coming from the west direction without ensuring
that there were no vehicles approaching coming from the opposite
directions.

11. Q. What do you want to happen to the case filed against you?
A. I hope that the account of events I narrated will be considered by
the Honorable Court and that the case filed against me will be
dismissed.

under oath that I conducted and supervised the examination of the witness
and I have faithfully recorded the questions asked together with the answers
given by the witness. I further swear to the fact that neither I nor any other
person present or assisting the witness coached him regarding his answers
and any false attestation shall subject me to disciplinary action including
disbarment.
