JUDICIAL AFFIDAVIT

I, Fatima Orosco, 40 years old, married, residing at 347, Bblock 3, Katarungan

Village, Muntinlupa City., after having been sworn to in accordance with the law do
hereby depose and state that:

Atty. _______ is the counsel who conducted and supervised my examination

as a witness at his office at ______________________, Philippines;

I am answering the questions herein fully conscious that I do so under oath

and that I may be criminally liable for false testimony or perjury.

PURPOSE: This affidavit/ testimony of witness , FATIMA OROSCO, is being offered to

prove that the defendant Jose Andes threatened the plaintiff Peter Marcelo with a
gun while the latter was demanding the defendant to stop destroying the his
property.

Q1: Do you swear to tell the truth and nothing but the truth?

Q2: Please state your name and other circumstances for the record.
A2: I am Fatima Orosco, 40 years old, a public school teacher, and a neighbor of
Peter Marcelo.

Q3: Do you know the plaintiff inof this case?

A3: Yes, he is our neighbor and has been living in this block since we moved last
2010.

Q4: Do you know the accused in this case?

A4: No Atty., the first time I saw him was only during that afternoon of January
2022.
Q5: What about that afternoon? What are you doing in the afternoon of January
20, 2022?
A5: I was sweeping in front of our house when I saw that there arewere many
people on the vacant lot, it seems like they are arguing.

Q6: What did you do after noticing the altercation?

A6: I went closer to know what’s going on.

Q7: What have you seen or heard when you moved closer to the cluster of
people?
A7: I saw and heard Peter shouting “Anong ginagawa niyo? Huwag niyong sirain
ang bakod! Lupa ko ‘yan!” while pulling some men off the fence. Then the
defendant answered “Huwag ka na maghabol dahil ako ang may-ari at
nakabili ng lupang ito”

Q8: And then what happened?

A8: Peter was so enraged and kept pushing off the men destroying the
fence.…then Then I saw the defendant get his gun from his car and pointed it
to Peter..

Q9: What did you do?

A9: I ran off because I was afraid that the situation would escalate to something
life-threatening.

Q10: What happened after that?

A10: Peter concededconceded, and the defendant went on with destroying Peter’s
fence.

Q11: Anything else?

A11: That would be all Atty.
