Confirmation of Preliminary Injunction of

Presidential Proclamation 10052

This confirmation is submitted on behalf of an applicant requesting an interview for the J-1 visa
in order to participate in the U.S. State Department’s au pair cultural and educational exchange
program. This applicant has successfully passed the comprehensive screening requirements of
the U.S. State Department’s federal regulations for program participation.
This notice confirms that the United States District Court for the Northern District of California in
the matter of Nat. Ass’n of Man., et al. v. U.S. Department of Homeland Security et al., 20-cv-
04887 (N.D. Ca.) issued a preliminary injunction on October 1, 2020, enjoining enforcement of
Presidential Proclamation 10052 that had suspended through December 31, 2020, the issuance
of certain categories of visas, including the issuance of J-1 visas for participants in the federal au
pair program subject to enumerated exceptions. On November 18, 2020 the Court issued an
order granting a motion to clarify the preliminary injunction and confirmed that visas must be
processed for individuals covered by the injunction “including under proclamation 10052’s
national interest exceptions.”
As a member of the U.S. Chamber of Commerce which participated as a named party in that
action, Presidential Proclamation 10052 cannot be enforced to deny an otherwise valid
application for a J-1 visa by an exchange visitor sponsored by Cultural Care Au Pair including those
pursuing a National Interest Exception waiver. This preliminary order enjoining the application
of Presidential Proclamation 10052 and requiring the processing and issuance of applications for
J-1 visas is effective as of October 1, 2020 and remains in effect until further proceedings or
further orders of that Court.
