I. INTRODUCTION
1. The Ben Luc-Long Thanh Expressway Project (BLLT) is one of the 16 expressways under
Eastern North-South Expressway as per “Development planning of Vietnam expressway
network toward 2020 and the vision after 2020” and “Detailed planning of Eastern North-
South Expressway”, approved by the Prime Minister through Decision No. 1734/QD-TTg, dated
01 December 2008 and Decision No. 140/QD-TTg, dated 21 January 2010.

2. The Ben Luc - Long Thanh Expressway Project has an overall length of 57.7km. It
traverses through 16 Communes in 7 Districts of 3 Provinces. This expressway starts from My
Yen Commune and part of an access-road in Tan Buu Commune in Ben Luc District, Phuoc Ly
commune and Long Thuong commune in Can Giuoc District of Long An Province; and traverses
through Binh Chanh Commune, Tan Quy Tay Commune, Hung Long Commune, Da Phuoc
Commune in Binh Chanh District; Nhon Duc Commune, Long Thoi Commune in Nha Be District,
and Binh Khanh Commune in Can Gio District of Ho Chi Minh City; then goes through Phuoc
Khanh commune, Vinh Thanh Commune, Phuoc An Commune in Nhon Trach District, Long
Phuoc Commune, and ends at Phuoc Thai Commune in Long Thanh District of Dong Nai
Province. The right of way (PROW) and land acquisition area along the route varies from 56m -
73m wide.

3. The project expressway is divided into three sections;


(i) western section is Tranche 1 (21.74 km), this part is financed by ADB (Asian
Development Bank),
(ii) middle section II, it’s length of 10.71 km, is financed by Japan International
Cooperation Agency (JICA), and
(iii) Eastern section III (25.25 km) is Tranche 2. It’s entire of tranche 2 is in Dong Nai
Province for the expressway construction, this eastern sections is also financed
by ADB
4. The project was estimated to cost $1.608 billion at appraisal, inclusive of local taxes,
contingencies, and financing charges during development. Separately. JICA section in the
amount of $286 million will cover construction of the eastern section of the project, mainly
focusing Binh Khanh Bridge crosses Roai Sap river to connect between part of project in Nha
Be district of Ho Chi Minh city with project part in Nhon Trach District of Dong Nai Province (
belong Tranche 2)

II. PROJECT DESCRIPTION WITH CONSTRUCTION PACKAGES


5. Ben Luc – Long Thanh Expressway has an overall length of 57.7 km and divided into 11
construction packages. Construction is being carried out at all of the 11 packages and the
entire budget for construction is being funded by ADB and JICA. The JICA funding covers
middle section, which includes packages: J1; J2; J3. The ADB funding covers ADB section I of
the project (Tranche 1 of packages: A1; A2-1; A2-2; A3; A4) and ADB section III (Tranche 2) of
Packages: A5, A6, A7). (see Table 1 &2)

III. QUARTER REPORT OF MONITORING ON RP IMPLEMENTATION


6. This report is concerned with the monitoring and reporting of Resettlement Plan (RP)
implementation. The main objective of monitoring of resettlement work is to provide an
insight and guidelines to the management for assessing the progress of resettlement. Its

objective is to identify probable difficulties and problem area, like a RADAR system providing
an early warning system, in the implementation of resettlement Plan (RP) -2014 approved by
ADB and Viet Nam Government.
7. In order to ensure effective implementation of the Resettlement Plan (RP) and
achievement of the set targets, internal monitoring of Resettlement & Rehabilitation (R&R)
components of the project has been carried out by the Executive Agency (EA) with the help of
Resettlement Specialist of Project Supervision Consultant (PSC), to enable timely adjustment
of implementation set up and procedures effectually.

8. South Expressway Project Management Unit (SEPMU) of Ben Luc - Long Thanh (BLLT)
Expressway Project is the representative of the executing agency for VEC and is responsible for
internal monitoring.

9. As per agreed updated RPs, the SEPMU has to submit quarterly monitoring report to
ADB and VEC. This quarterly monitoring report No.4 (QRNo-4) of 2017 presents the status of
land acquisition and handing over of land for the project & income restoration program (IRP)
implementation up from October of 2017 to December 2017.

IV. OBJECTIVES OF INTERNAL MONITORING REPORT (IMR)


10. The objectives of the monitoring program are:

a- monitoring of gender disaggregated resettlement progress of the affected HHs


under RP implementation, in particular land acquisition and handing over land
to project and implementation of IRP
b- Assess of monitoring the standard of living of affected Households (AHHs) are
restored or improved as how?
c- monitoring whether the overall project and resettlement objectives are being
met;
d- assess, if rehabilitation measures and compensation are sufficient;
e- Identify problems and risks; and identify measures to mitigate problems.
f- Identify and explain issues in Memorandum of Understanding ( MOU) of each
ADB mission to meet Safeguards Policy Statement (SPS), 2009-ADB

11. The range of activities and issues that need to be recorded and verified, include:

a- Compensation, allowance payments and delivery of assistance measures to


affected households (AHHs);
b- Re-establishment of AHHs settlements and business enterprises;
c- Reaction of AHHs, in particular, to resettlement and compensation packages;
d- Monitoring of IRP Implementation activities and the role of the responsible
agencies, carrying out IRP;
e- ;
f- Review and support (if necessary) to resolve disputes and grievances of AHHs
g- Assistance provided to AHHs in relocation to new resettlement sites.

implementation as how
12. When preparing 4rd Quarter Report of 2017, no external monitor had been mobilized to
monitor and evaluate the RP updating and implementation. According to EPMU, the selection
on external monitor is being reviewed by VEC through some bidding; however, no decision has
been taken up till now so far.
13. For this project, a Consulting service contracts has been made on 12th November 2014
between Vietnam Expressway Corporation (hereinafter refer to as VEC) and Joint Venture of
Dasan Consultant Co., Ltd, with Kunhwa Engineering & Consultant Co., Ltd. and
Intercontinental Consultants and Technocrats Pvt., Ltd, as project supervision consultant (PSC).
The team Leader /Highway Engineer of the project supervision consultant act as the Engineer
of the Project, while Resettlement Specialist of PSC will assist in the updating, implementation
and monitoring of RP activities and prepare QRs to assess these RP activities

V. LAND ACQUISITION AND RESETTLEMENT IMPACTS


14. One updated resettlement plan (uRP) was prepared per district. Due to changes in the
number of Households (AHs) relative to the uRPs, RP addendum will be prepared for each
district with an accounting of the additional AHs including mitigation measures corresponding
to the impacts. In the coming quarter VEC will prepare RP Addendum of Ben Luc; Can Giuoc
and Can Gio Districts.

15. Besides, Resettlement Plan (RP) addendum for electricity Pole removal and T14 internal
road will also be prepared for Ben Luc and Can Giuoc districts respectively.

16. However, up till December 2017 only Resettlement Plan (RP) addendum for electricity
Pole removal of Ben Luc district has been prepared and submitted to EPMU for its final
submission to ADB as Ben Luc District is the only district that has approved plan of
compensation and completed land acquisition. Remaining RP addendums of other districts are
pending due to lack of approval of compensation plan and incomplete land acquisition
process.
17. The area of recovered land, reflected in the DMS (Detailed Measurement Survey) at
design stage was a generic assessment; however, actual recovered land area at the time of
implementation is different due to construction demand or any other reasons. Therefore, in
this report the assessment on status of land acquisition for each construction package is
updated at micro level of each household. These information and data is verified and supplied
by cadres of EPMU, Contractors and Local Authority of each District and Commune from the
actual recovered land area, which is specifically summarized in end of the month and every
quarter in a year at each construction site in the commune and at every construction packages
5.1. Number of Household affected by land acquisition
18. There is no change in the final list of affected households from March 2017 up till
December 2017, the reporting period. This list is updated and verified every quarter by Center
of Land Fund Department (CoLFD) of the Project districts on the basis of decisions of land
acquisition and compensation plan, and finally approved by Chairman, Peoples Committee of
the Province and District. Given that there is a change in the number of AHs relative to the
uRPs, RP addendum will be prepared for each district with an accounting of the additional AHs
including mitigation measures corresponding to the impacts. The details are presented in
Table-3 below:

5.2. Area of Impacted Land as per Updated Decision


19. Land Acquisition is the major issues that determine the progress of construction work.
Since, the project alignment has been designed in a new land, hence, major part of land
consists of agriculture land (nearly 85%) and small area part of protection forest in Long Thanh
District of Dong Nai Province (3, 65 ha), SEPMU is working with Long Thanh District PC to
identify location and land area to reforestation for compensation for this loss forest area part,
while the remaining are residential land and swampy river area. The table below gives clear
picture of updated status of land acquisition:

20. The above table shows that there is not a change in recovered land area from previous
reporting period.

21. To date, the process for land acquisition for Tranche 1 is nearly completed, while in
JICA section it is already completed. On the other hand, the process of land acquisition in
Tranche 2 is under progress.
5.3. Budgeted amount for RP implementation
22. The table below shows the resettlement budget as per updated decision up till 18
February 2018 and its comparison with the URP and the previous quarter (please see remarks
column in the table):

23. The above table elaborates that there is no change in the total budget for land
acquisition in comparison to previous reporting period. This Land acquisition cost has been
updated at micro level at the time of actual payment of compensation and support to each
household (updated to December 2017)

VI. PHYSICAL AND FINANCIAL PROGRESS OF LAND ACQUISITION

24. Monitoring of resettlement progress of the affected HHs under RP implementation, in


particular land acquisition and handing over of land has been carried out in this quarter like
previous quarter. During this reporting period it was tried to appraise gender disaggregated
monitoring of the resettlement progress of the affected HHs, where reasoned appropriate.

6.1. Number of Affected Households (HHs) Fully Paid


25. As against the acquired land and property, the compensation has been paid in full to
89.90 % affected households up till 18 January 2018 in comparison with 87.94 % in No 3 QR, in
September 2017, a substantial progress from last reporting period. The payment detail up till
date has been drawn in the Table-6. The payment was made in accordance with priority of
construction activities.

26. 100% compensation has been made to JICA section, while it is 97.81 % in Section-1
(Western section- A1, A2-1, A2-2, A3 & A4), almost 1.31 % more from last reporting period.

27. A significant improvement has been witnessed in compensation payment for section-III
(Eastern Section- A5, A6 & A7), where an average to 72.33% HHs have been paid up till this
reporting period, a significant rise of 3.78 % from last reporting period.

28. 95.24% Households and 88.62 % Households have been paid in package A5 and A6
separately; a huge advancement from previous reporting period, while in last reporting period
the payment was only 91.43 % and 86.11 % in reporting in September of 2017 of A5 and A6
separately.

29. Remaining HHs, who are unpaid, are being paid as per priority, or put in District
treasury with other reasons.

6.2. Total Land area under Acquisition paid


30. In 92.63 % of total acquired land for the project has been paid up till this reporting
period, while it was 89.58 % in last reporting period (Sep 2017) for entire of the project. The
payment has been made maximum 100 % in JICA section completion, while it is more than
98.19 % in Packages A1, A2-1 & A3, comprising Can Giouc completed, and Can Gio districts

respectively (100%). Currently, payment of compensation is only concerning to 44 HHs in Binh
Chanh District and 1 HH in Ben Luc District in Tranche 1
31. Payment in Long Thanh District and Nhon Trach District are being carried out
continuously, in this reporting period is 83.43 % HHs in these 2 districts has been paid. The
package wise detail on status of land area paid is delineated in Table 7.

6.3. Amount Disbursed to Affected Households


32. Payment of compensation is being carried out by District Compensation Committee
(DCC) in each Project District. The compensation to affected households is being paid through
a/c payee cheque to maintain the transparency in the payment process and safety. Progress
for payment of compensation and allowances, paid to eligible HHs, Detail items of
compensation and support was also monitored close and disclosed public at commune office
before payment and detail page of compensation and support sent to each household
33. As it was the figure shown in paid column, was the actual amount, it is disbursed to pay
to each household. Currently, Payment of compensation is focusing for Tranche 2 (Long Thanh
and Nhon Trach Districts in Dong Nai Province) as in Nhon Trach District ups to 18 January
2018, paid compensation have reached 221.49 B vnđ (accounting 41.01%) and Long Thanh
District is 47.32 B vnđ (accounting 30.5%). In Tranche 1 ( Binh Chanh District) is only remaining
44 AHHs in obstruction in handing over land to project, However, in this district, payment of
compensation have reached 1553.27 B vnđ/ Total 1659.35 B vnđ ( accounting 96% total HHs
paid; 1117 HHs/ total 1161 HHs paid and handed over land)

6.4. Assistance and Support Paid to AHs


35. The affected households, who are losing agricultural land and other productive assets,
are entitled for following assistance and allowances:
• Support to households, individuals directly engaged in agricultural production: Article
23 of Regulation issued in the following Decision No. 35/2010/QĐ-UBND, ‘when the
State evicts the agricultural land, where the households & individuals directly produces
agricultural products in land, are not only entitled to receive the compensation by cash,
but will also receive support for change in jobs and creation of new work. The support
will be as follows:
▪ A support of 4 times of agricultural land price, regulated and announced
annually by the People’s Committee of City, for the agricultural land of annual
plants located in front of road;

▪ A support of 5 times of agricultural land price, regulated and announced
annually by the People’s Committee of City, for the agricultural land of annual
plants not located in front of road;
▪ A support of 3.43 times of agricultural land price regulated and announced
annually by the People’s Committee of City, for the agricultural land of
perennial plants located in front of road;
▪ A support of 4.31 times of agricultural land price, regulated and announced
annually by the People’s Committee of City, for the agricultural land of
perennial plants not located in front of road;
This support is applicable only on actual affected area but not over 10,000m 2/HH. The
above support rate is approved by the People’s Committee.
• Other assistance and policy compliance :
▪ Support Budget of Changing Careers/ Occupation: An assistance to support
changing careers/ occupations is also given to eligible APs (losing agricultural land).
At current price it is estimated that an amount equal to 180,000 VND/eligible APs is
applicable for this assistance. .
▪ Allowances to Vulnerable Households as per Government regulation (social policy
households, heroic mothers, wounded, dead soldiers): Assistance with minimum
amount of 1kg rice/person/day with minimum period of 12 months.
▪ Life stabilization allowance: The eligible DPs will receive equivalent to 30 kg of rice
per member of household or equivalent amount. The allowance period will depend
on the estimated transition period,
▪ Entitlement to take part in income restoration program: the households, who will
experience severe loss of productive land, relocating households and business
owners, and vulnerable households
• Bonus: A Bonus equal to VND 2,500,000 is given to all AHs who will hand over the land
to the project in time.
• Additional support assistance for relocating households: The DPs, who are moving
within the city, will receive 6.000.000 VND/HH and the class 4 housse and temporary
house; will receive 4.000.000 VND/HH, while AHs, moving out of the city, will receive
an assistance of 10.000.000 VND/HH. For demolishment and relocation of full house
but land is not fully acquired and it is viable for reconstruction of the house on the
reamaing land, will be assisted with demolishment and relocation cost, which is equal
to 50% of assistance for those who move to other places.
• Materials Transport Allowance: Will be equivalent to the actual cost of moving (vehicle
and labor), and
• House Rental Allowance: if DP has no other accommodation while waiting for new
accommodation (i.e., while DP is rebuilding house or waiting for house being built by a
contractor at the resettlement site).
36. All the Project Districts (Districts: Binh Chanh, Nha Be, Can Gio ) of the Ho Chi Minh City
applied Decision No 35/2010/QD-UBND dated 28 May 2010 of the Ho Chi Minh City PC
and the two Districts: Can Giuoc and Ben Luc of the Long An province have applied
Decision No 56/2014/QD-UBND of Long An province PC, dated 13 November 2014 to
calculate support level to HHs, specified in the policy framework
37. Life stabilization allowances equivalent to 30 kg of rice per member of household during
transitional period and payment of additional support of 6.000.000 VND/HH and 4.000.000
VND/HH for the class 4 house and temporary house to relocating families moving within
the city are being made and included in the compensation plan. The HHs, moving out of
the city, are receiving an assistance of 10.000.000 VND/HH.
38. Moreover, to provide the rental assistance to eligible DPs during transitional period, a
letter by Binh Chanh District PC has been sent to HCMC PC vide Statement No 781 dated
13 April 2017 , however, they are waiting for approval by PC, HCMC province. Once
approval comes to concerned district, the house rental will be paid to eligible DPs
39. The transitional support for the household‘s relocation were also specified and detailed in
approved plan of compensation, support, and resettlement (Refer Q-4, 2016, Table-15,
and Annexures- 8 and 9)
VII. GENERAL PROGRESS ON GROUND CLEARANCE AND HANDING OVER LAND

7.1. Status for land clearance and handing over of Acquired land
40. To up 18 January 2018. Land Acquisition and Ground Clearance are nearly on
completion in all districts of the project, in Long An province and Ho Chi Minh City (Tranche 1
reached up 98 % for all construction packages). Handing over of land area to Project in
Packages A1, A2-1 are being reached near to 99%, Separately, A3 & A4 have completed 100
%, howevr, in package A2-2, Land Acquisition and Ground Clearance has reached 95 %.
41. The disbursement in two Districts; Nhon Trach and Long Thanh are being carried out as
per priority, linked to construction activity. However, during this reporting period, there was a
good progress in compensation payment as well as handing over of land, where averages 83 %
of the affected Households have handed over the land ( A5 is 98%; A6 is 83% and A7 is 75%)
42. The details of progress in land clearance and status of handing over of land to Civil
works up to December 2017 has been weighed up in Table No 9: (See more detail in Annex 1)

7.2. Status on Ground Clearance and Handing over of land by Affected Households
43. The assessment of handing over land by affected households (AHHs) has also been
done. The finding reveals 89.8 % HHs have handed over the land for construction up till 18
January 2018, which is about 1.6 % more than last reporting period. Paying attention, in March
2017 was only 64.96 % of the AHHs. The percentage of affected households, who handed over
land in Binh Chanh District, is now 96.2% (Previous reporting period of 93.63%), while
remaining districts in western section have achieved the target of either 100.% or over 99.69 %
(Ben Luc District is 99.7 %; Can Giuoc is 100 %, Nha Be is 100 % and Can Gio is 100 %
respectively).

44. Up to December 2017. In Binh Chanh District, remaining 44 households are still
pending handing over land and ground clearance to project;

45. In 2 Districts of eastern section; Nhon Trach and Long Thanh Districts have also
achieved good progress of 90.2 % & 17.9 % respectively in handing over land. Entire average
for Dong Nai Province has reached 74.0% AHHs, who already handed over land to Project. See
Table 10

VIII. OBSTRUCTION ON HANDING OVER OF LAND AND GROUND CLEARANCE

8.1. Issues affecting Timely Land Handover:


46. Currently. Most of the Households, who haven’t handed over the land to the project,
are in Binh Chanh District; i.e., 44 HHs and addition of 1 Household in Ben Luc District. These
45 HHs have not yet handed over the land to Project (most of in packages: A1; A2-1 and A2-2)
due to the following reasons:
a- One Household: [This information has been removed as it falls within exceptions to
disclosure specified in paragraph 97, (exception (x) Information that, if disclosed, would
or would be likely to endanger the life, health, safety, or security of any individual, or
safety or security of ADB assets, or to prejudice the defense or national security of a
member) of ADB’s Public Communications Policy (2011).] in Ben Luc District have
temporary handed over an part of land acquisition area for project to drill and
construct piers ( EP3 and EP4), but afterward, this temporary handed over land part is
blocked by the household in order to wait court Decision on dispute of compensation
in family. The contractor issued several letters (as Letter No. BLLT/A1/E/17-014, dated
June 2017) to remind priority of resolution of the problem of handing over land at
HCMC-TL Interchange for constructing, but up now still pending of handing over land.
In 14 December 2017 Long An Province PC hold a meeting to resolve this case and Ben
Luc District PC is requested consultant of solving this case for Province PC in order to
send an letter to Supreme Court at Ho Chi Minh City to resolve quickly and proposed
measures for supporting construction activity soonest if possible
b- In Binh Chanh District, still pending on handing over land to project of 44 affected
households; wherein focusing
- 12 HHs are disputing, waiting court's resolving of their grievance ( 5 HHs at
City Court, 07 HHs at District Court). It is noted that some disputes are from other civil
cases not related to land acquisition of the project ( like debt of Court fee or Debt loan
of bank)
- 09 HHs are refusing to receive compensation with reasons: compensation
rate is low

- 16 HHs in dispute, waiting adjustment or addition of compensation or
inheritance, supply origin of CoLUR…All of their compensation are being put into
district treasury;
- 07 HHs have committed handing over land after Tet festival (mid of February
2018) and they are waiting to be handed over plot in Vinh Loc B resettlement site
(most these HHs are from self-relocation, change into Resettlement site)
c) In these 44 AHHs are focusing in A2-2: is 33 AHHs (including 5 HHs in Hung Long
commune; 28 HHs in Da Phuoc Commune).
d) Paying attention to Binh Chanh District, herein with reasons: witnessed a tremendous
urban development in recent past. Because, the affected households are asking for
additional compensation and delay of handing over land as well as problem in permit
for constructing new house to resettlement, complaining low compensation rate
e) In 2 Communes of Binh Chanh district; Hung long and Da Phươc, payment of
compensation conducted slower in comparison with other communes in the District.

47. There various reasons, stated above, for delay in handing over of the land have been
drawn, here, in the table 11 below:

48. The information on critical locations and other details of obstruction, which need
urgent action on Ground Clearance in Binh Chanh District, is highlighted in Annex. -2.
8.2. Initiative to resolve the Issues, affecting Timely Land Handover:
49. As described in the last reporting period that People’s committee (PC), Ben Luc District
and Binh Chanh District and CoLFD and Committee of Compensation of District have organized
more discussion to directly talk with HH to resolve the pending issues of handing over land for
the Project. The Positive outcome of this discussion is visible on ground, when the HHs has
started handing over the land for civil construction.
50. About 9 HHs in Binh Chanh District, who are not handing over the land due to
complaining low of compensation rate.the authority, may issue an enforcement decision. . It is
pertinent to mention here that In Binh Chanh District, the compensation plan is based on the
compensation policy of HCMC province. The compensation plan is based on replacement cost and is
well explained in the compensation policy, i.e., Document No 7250/UBND-ĐT, dated 23 November
2017 of Ho Chi Minh City PC. This replacement cost is especially designed for BLLT project in
compliance with safeguards policy of ADB
51. However, current, local authority levels still try to mobilize and lobby to these HHs to
hand over land to project. In Parallel this activity, the local authority also prepares steps to
enforce handing over land according to regulations of land law, policy of the local authority is
minimized or avoid land acquisition by coercion
52. It is pertinent to mention here that Article 39 of Law of Land on ‘Land recovery for
use for objectives of national defense and security, national interest or public interest’ says
that ‘after a decision on land recovery and a plan for compensation, site clearance and
resettlement have been approved by the competent State body, publicly announced and
become effective, the person, having land to be recovered, must comply with the decision on
land recovery. Where a person, having land to be recovered, fails to comply with the decision
on land recovery, the people's committee at district level, which is authorized to make the
decision on land recovery, shall have the right to issue an enforcement decision.’
53. Land recovery, compensation and ground clearance procedures were first touched
upon in Decree No. 197 and then detailed in Decree No. 84 with 12 steps. However, some of
these procedures proved impractical and their implementation time limits were not clearly set,
causing rampant project construction delay and affecting investor interests. In face of such
situation, Decree No. 69 was issued, re-arranging the land recovery, compensation and ground
clearance procedures defined in Decree No. 84 in only four steps, which is well illustrated in
the following Table:

administrative measure to be taken by the State in necessary
cases. In order to prevent such coercion from abuse and protect
people’s interests, coercive land recovery must be only carried
out in certain cases

54. The decision on Coercive land recovery by local authority can be imposed in following
cases:
- If, the land recovery has been strictly carried out according to the above-mentioned
three steps; or,
- Past 30 days after the deadline for land handover, the land users concerned fail to hand
over to-be-recovered land; or,
- The land users decline to hand over to-be-recovered land though they have been
persuaded by local administrations and compensation bodies; or,
- A coercion decision has been issued according to law by a competent state body; or,
- The coercion decision has been received by the land users concerned or publicly
displayed at the office of the commune- level People’s Committee of the place with the
land to be recovered.
55. Coercion decisions will be enforced by coercion forces under the direction of district-
level People’s Committees 15 days after the decisions are received by the land users
concerned or publicly displayed at the offices of the commune-level People’s Committees and
the land areas are not handed over. Any person, subject to a land recovery enforcement
decision, must comply with it, however; he has the right to make a complaint.
56. The District People's Committee has directed the Compensation Clearance Board of
Binh Chanh District to speed up the completion of the legal documents so that the site
clearance can be completed.
57. The obstruction caused by TL Shoe Company, a major obstruction for A2-1 package in
Tan Buu Commune, has been resolved by the Can Giuoc District and construction work is going
on this location, See status of construction on above said land in Fig.-1 below:
58. Can Gio District have completed handing over of land to Project of 100%
59. The resolved cases of handing over and present obstruction, updated up till December,
2017, is shown in the figures below (Fig.-1)

IX. RE-ESTABLISHMENT OF AHHs SETTLEMENTS AND BUSINESS ENTERPRISES;


60. Basic principles in guidelines under SPS-2009 of ADB is to avoid involuntary
resettlement wherever possible and or to minimize involuntary resettlement by exploring
project and design alternatives; to enhance, or at least restore, the livelihoods of all displaced
persons in real terms relative to pre-project levels; and to improve the standards of living of
the displaced poor and other vulnerable groups. The involuntary resettlement safeguards
covers physical displacement (relocation, loss of residential land, or loss of shelter) and
economic displacement (loss of land, assets, access to assets, income sources, or means of
livelihoods) as a result of involuntary acquisition of land and properties.
61. Harmonized with the basic principles of ADB Policy on compensation, assistance and
resettlement, Vietnam Government, in agreement with ADB, has adopted a specific
Resettlement Framework for the BLLT Expressway project, which could minimize involuntary
resettlement, enhance, or at least restore, the livelihoods of all displaced persons in real terms
relative to pre-project levels.
62. The several RPs, prepared for this project, establishes the provisions for payment of
resettlement assistance to AHs, and income restoration assistance to the poor and vulnerable
households and provides the budget and cost estimate for implementation.
63. The agencies, involved in RP implementation, maintained continuous efforts to achieve
the desired result on timely execution of resettlement and IRP activities. In the process, the
agency/ authority have initiated following activities to make sure effective implementation of
resettlement and restoration of livelihood:
• Consulting project affected people viable solutions for resettlement and livelihood
restoration;
• Providing affected people options of resettlement and livelihood restoration;
• Compensating entire replacement cost for damages and loss;
• Selecting sites for resettlement, which could provide better benefits and services or
similar to their existing place ;
• Providing finance for assistance, training and income support to help them go well
during the transitional period;
• Recognizing vulnerable groups and providing special support for these groups; and

• Establishing a structure on institution and organization to assist this process to finally
succeed and smooth in implementation organization
64. In order to conduct objective implementation of the RP and minimize the adverse
social impacts a periodic evaluation will be carried out. This evaluation will involve identifying
the gaps between the implementation of the RP and the mitigation measures proposed in the
RP. Any gaps thus identified will be discussed in consultation with the EPMU officials and the
local administration as necessary and corrective actions executed. These corrective actions will
be examined and then implemented in a timely manner. Other than that the evaluation
criteria will examine resettlement status and the quality of life with respect to the income
levels of the persons or families losing livelihood and business structures, if any. There will be a
direct comparison of the income level pre-project period and post project implementation
stage. If there have been any families that are impoverished due to the project development,
measures will be suggested to address the same to them without delay.
65. To evaluate the status on re-establishment of AHHs settlements and business
enterprises, an evaluation of resettlement/relocation and implementation of IRP activities will
be required, which has not initiated as up till now.
66. Currently. Resettlement of some households have changed model of resettlement from
self – relocation previously to resettlement into resettlement sites of Districts as after:
• There are 502 eligible HHs in Tranche-1 (ADB section I), who needs relocation. Out of
which 499 HHs opted for self-relocation, while only 3 HHs opted for relocating at
resettlement site in first in 2014 -2015
• For Binh Chanh District in the Ben Luc- Long Thanh expressway project, Before, only
having 1 Households (HH: [This information has been removed as it falls within
exceptions to disclosure specified in paragraph 97, (exception (x) Information that, if
disclosed, would or would be likely to endanger the life, health, safety, or security of
any individual, or safety or security of ADB assets, or to prejudice the defense or
national security of a member) of ADB’s Public Communications Policy (2011).] ) opted
resettlement into Vinh Loc B Resettlement site, but today (January 2018) changed, 44
Households have opted on self -relocation before, now they have petitioned to be
resettled into new resettlement sites in the District (Da Phuoc Commune of 20 HHs;
Hung Long Commune of 14 HHs and Binh Chanh Commune of 8 HHs). These
households were being reviewed for approval by Ho Chi Minh City PC and Binh Chanh
District PC.
• The resettlement sites were identified by the local government of Binh Chanh District
and AHHs, the resettlement sites now completed infrastructure and ready for
relocation for this 47 HHs ( including first 3 HHs relocated into RS from 3 year ago) in
Vinh Loc B Resettlement site and An Ha resettlement site.

• One HH in Nha Be District: HH: Doan Xanh, opted relocation into Resettlement site,
already received land plot in Resettlement site from 2015.
• Another 1 household of Vulnerable group in Can Giuoc District has petitioned to be
received a plot in Hai Son resettlement site , to replace self-relocation before and
subsequently, she already received plot in Hai Son SR from May of 2016
• In other two districts of Tranche-2; i.e., Nhan Trach District and Long Thanh District (in
ADB section III), 273 HHs have opted relocation into resettlement sites, and however,
relocation of these households have not been initiated up till date. Nhon Trach have
arranged 2 Resettlement Sites ( Long Tho Resettlement Site and HUB Resettlement
Site) for the AHHs, These 2 RSs have completed construction, the Long Thanh District,
Tan Hiep Commune Resettlement Site is being constructed and plan will be completed
and handed over plot in March – July 2018. See detail Table 14)
X. GRIEVANCES AND REDRESSAL
67. The nature of grievances and its redressed requirement are diverse, which need
corrective action at different levels and by different institutions. Most of the grievances,
specified below, are concerned with the claimed inadequacy of compensation and rate and
disputes among HHs. The nature of the grievances received and redressed up till December
2017 are summarized in the table-12.
68. In Tranche 1: Comparison with previous report, this QR No4 of 2017 reduced 30 cases,

69. In Tranche 2: The 39 HHs in Nhon Trach district are complained compensation for
location of recovered land and is being resolved by local government.
70. Compensation of the 16 HHs/ 44 HHs in Binh Chanh District have temporary put in
district treasury to wait decision of resolving or completed legal documents to pay
compensation. See table 12

XI. RELOCATION AND TRANSFER

11.1. Resettlement Preferences of Eligible Affected Households


71. There are changes in the number of eligible HHs, who opted for relocating at
resettlement site as part of resettlement preferences from previous reporting period. In ADB
section I and JICA section II, First time, only 3 HHs have opted for relocation at resettlement
sites, while remaining 499 HHs, selected for self-relocation. But to December of 2017, having
44 Households, firstly, opted self-relocation but afterwards, they have petitioned to be
resettled into new resettlement sites in the District as Vinh Loc B RS, An Ha RS ( Da Phuoc
Commune is 20 HHs; Hung Long Commune is 14 HHs and Binh Chanh Commune is 8 HHs)
72. All of these new 44 HHs will be arranged resettlement into 2 resettlement sites (Vinh
Loc B Resettlement site and An Ha Resettlement site in the Binh Chanh District) with
Households’ agreement and approved and being reviewed approval by local authority. In
These 44 HHs: 9 HHs/ 20 HHs in Da Phuoc commune completed lottery and identified plots in
Resettlement site from August – December 2017; 2 HHs/14 HHs in Hung Long Commune also
completed lottery and identified plots in Resettlement site. All of 8 HHs in Binh Chanh
Commune already received decision for RS and Plot in the Resettlement Site of them from
August – December 2017.

73. On the other hand, in two districts; i.e., Nhan Trach and Long Thanh (mostly ADB
section III), 273 HHs have opted relocation into resettlement sites.
74. According to Report of CoLFD of Nhon Trach District in November of 2017:
Preparation for resettlement site have been selected for resettlement as after:
• Long Tho Resettlement Site and HUB resettlement site, Construction for these 2 RSs
completed;
• Currently. Local Authority have allocated plots in the 2 RSs to each households:
- Phuoc Khanh Commune have completed handing over plot in RS to 21 HHs/21 HHs,
resulted to November 2017
- Vinh Thanh commune have completed review on status of 20 AHHs of relocation.
According to Plan: the 20 HHs to be handed over plot in RS in next time ( January- July
2018)
- Phuoc An Commune has completed review on status of 70 AHHs/70HHs to be handed
over plot in Resettlement Site in next time. It is planned to handover plot to 65 HHs in
March – July, 2018
75. Long Thanh District, 162 AHHs will be resettled into Tan Hiep Resettlement site, this
Resettlement site is being constructed with total plots of 167 Plots ( the 162 AHHs arranged to
relocate the HHs into this RS, Local authority will organize lottery of plot to each HH and
afterward will hand over plot to each HH according to plan in February – July 2018,

11.2. Status of Resettlement Site development
77. All resettlement sites for moving of relocated households in project identified. Most
these specified resettlement sites completed construction and identified resettlement to each
household in concreted communes. Separately Long Thanh District, Tan Hiep commune
resettlement site is being constructing and plan will be completed in April- July 2018 to hand
over plot to household

78. Ho Chi Minh City and Dong Nai Province are developing more new urban areas and
industrial zones and which may need more resettlement sites. To meet the challenges and
demand, the authority is setting up new resettlement sites for local people, workers and to
reduce the population density from its central area into suburban. In 2 suburb districts, Binh
Chanh and Nhà Be in Ho Chi Minh City and 2 Districts: Nhon Trach and Long Thanh of Dong Nai
province; more resettlement sites and new residential apartments are being developed to
meet the resettlement demands. The same resettlement sites will be available for the affected
persons of Ben Luc- Long Thanh expressway project.

79. The status of development of Resettlement Sites and relocation status of affected
households are described in the Table -14:

XII. INCOME RESTORATION PROGRAM (IRP) IMPLEMENTATION

12.1 Households participate IRP and selected Income activity


86. Income Restoration Program (IRP) is being conducted in each local region of project
District level
87. The final list of eligible HHs participates in IRP to up till December 2017 is 860 HHs,
decreasing 13 HHs in comparison with previously report (Quarter No 3 report of 2017). Reason
of change: additional households list for IRP in 2 communes: Long Thuong and My Yen of Can
Giuoc District at first is 59 HHs, but afterward some HHs are not participated IRP, the HH list
decreased to 43 HHs like in according to statement No1845 /TTr-SLDTBXH of Long An
province's DOLISA dated 11 September 2017 to Long An province PC and Province PC decision
No 4236 /UBND-KT dated 20 Sep 2017 of Long An province PC : approval for the additional 43
HHs list of IRP
88. In 23 November 2017. Binh Chanh District PC official approved household list, who will
participate IRP to 410 HHs, increasing 3 HHs. 2 Districts: Nha Be and Can Gio are not change
89. Reason of this change is from HHs numbers in 2 Districts:
(i) Can Giuoc District ( Long An Province): official approval Decision for additional
Households List is 44 HHs ( replacing for 59 Households in previous reporting

(ii) Binh Chanh District with official updated Households list of December 2017 is

and service promotion as organizing training courses and handing over input to each HH
91. Currently IRP implementation of 92 HHs in Can Gio district completed in 2016-2017 and
completion report of IRP implementation also submitted and approved in 2017
92. In Tranche-2 part of the project. Long Thanh District have completed eligible HHs list of
128 Households, who would participate IRP, an Meeting organized at Meeting hall of Phuoc
Thai Commune to inform IRP to participant and the participant will hear contents of IRP and
proposed Income restoration activities for IRP and they will choice Income activity suitably for
them. For Nhon Trach District. Eligible Households list of IRP is being identified.

12.2. Vulnerable Group and their participation in IRP


94. With reference to the MOU of ADB mission in March 2016 to identify the HHs of
vulnerable group, the Consultant and the EPMU have worked with CoLFD and DCC in each

District of the project from March to June 2016. The identification of vulnerable groups at
Commune level was obligatory, with the objective to invite them to participate in the IRP.
EPMU and the Consultant were supplied this vulnerable list by Districts ;

95. During working with ADB mission last time (20-23 November 2017). Co LFD of Binh
Chanh District have supplied to SEPMU and ADB mission, consultant: an official eligible
households list in the District will be participated IRP and including Households are vulnerable
group in this District of 410 HHs

96. All of the 46 vulnerable households in IRP list will be invited to participate in IRP and
who selected income restoration activity for them. Small Business is main opted income
restoration activity for the vulnerable group (27 HHs); next income activity of livestock raising
and farming (12 HHs), Vocation training (4 HHs); cultivation (3 HHs).

97. Additionally, in two Districts; Long Thanh and Nhon Trach of Dong Nai Province, list of
vulnerable group only identified in Long Thanh District with 2 HHs ( [This information has

12.3. Status on IRP Implementation


99. The updated information up to Decembr 2017, out of 860 households, registered
participating IRP, In Tranche 1 and JICA section: 299 HHs have received input of IRP as after:
- 96 HHs in Ben Luc district, 76 HHs in Can Giuoc district, and 92 HHs in Can Gio district.
- Separately Nha Be District have been handing over Input of IRP for 35 HHs (7 HHs
completed vocational training ( 1 HH failed and re-examination); 22HHs in handicraft (
received sewing machine ) ; 3 HHs in service (machine to press sugar cane juice for
beverage) ; 2 HHs in Cultivation (Cultivating Orchid). Time of handing over this input of
IRP is from 08 September 2017 to 10 December 2017; respectively.
100. Binh Chanh District PC official approved for 410 AHHs list, who will participate IRP
including vulnerable group as above said;

102. Separately. Can Giuoc District of Long An province. Some members of management

this reason need re-organize according to request from EPMU and Consultant. Can Giuoc

103. IRP implementation is being carried out in each district of Dong Nai Province, set up of
organization to implement IRP completed in each districts (Long Thanh District and Nhon Trach
District).
104. Implementation of IRP in Long Thanh district: eligible 128 HHs in Phuoc Thai
Commune of Long Thanh District is identified participating IRP, Long Phuoc Commune is only 2
AHHs, they are not eligible HHs to be participated IRP. In the 128 AHHs list of IRP in Long
Thanh District, who selected income restoration activity as after: (i) 26 HHs of vocation
training; (ii) 45 HHs in service and trade; (iii) 53 HHs in livestock and farming; (iv) 4 HHs of

106. For successful implementation of income restoration program (IRP), it is essential to


provide proper training to IRP participating households on how to initiate and take best return
from the income models; they selected as part of their income generation activities.
107. The key issues of such type of training are to have specific knowledge of the selected
income activities and skill development of the participating households, through which, they
can improve their abilities to manage and run the selected trade, occupation or service. Such
type of training gives ample exposure and experience to run the ideal model successfully to
generate income. This training helps the participating households to understand the positive
and negative perspective of various income activities in processing IRP implementation and
experiences from IRP implementation for income restoration activity in future

108. The working groups, involved in IRP Implementation activities, prepared a detailed plan
to organize training courses/ workshop for eligible HHs under IRP. They prepared a proper
plan, equipped with relevant materials and tools, for imparting the training to the participant
HHs including technical requirements, human resources and operating costs for each income
activity

109. The proposed IRP workshops or training program was organized at commune level and
was meant to help and advice to each participant to make their choices of income activity
based on their education and skills and how to carry out the specified income activity and
contact the relevant persons or institutions, in case they require any advice and technical
inputs to run their business. The training program were organized as per following program
(see table 20):

110. Separately in 2 Districts of Can Giuoc and Ben Luc in Long An Province. Organization to
train for income restoration activities component as agriculture, cultivation, small business…
are not trained separately. It is only general organized and quickly trained in each workshop of

111. In Long An province. Currently, Two Districts: Can Giuoc and Ben Luc are summarizing

District is carrying out training as above written; Can Gio District completed IRP

12.4 Status on Schedule of IRP Implementation:


114. The Income Restoration Program ( IRP) is part of the approved URP, which aims to
specify the directions, strategies and objectives set out to restoration of income of affected
households afterward recovered land, this Resettlement Plan including IRP approved by the
ADB and the Government of Vietnam

115. The implementation plan for the income restoration program activities are generally
designed in 2 years (24 months); from date of commencement of the implementation of the
project. Keeping in mind, the implementation plan schedule of IRP was made and updated from
time to time to match the project progress in each commune.

116. There are delays in implementation schedule of original plan of each project district for
IRP , attributed to various reasons:
(i) first, IRP is carried out at local and
(ii) Local authority conducts IRP, they met new strange problem on procedures of
organization, and mechanism to carry out ;
(iii) the limit capacity and experience of local authority and working group as well
as assigned staffs to carry out IRP, most of these assigned staffs in first time for
IRP implementation are limit
(iv) delay and difficulty in procedures and issued decision and mobilizing local staffs
to set up management committee of IRP implementation and working groups
to assist implementation of IRP;
(v) delay in availability of budget to carry out IRP implementation;
(vi) time of IRP implementation of 24 months, therefore difficulty in mobilizing
local staffs to participate IRP with reason is stagger their job and position after
IRP completed,
(vii) level to support to each HH is small ( 9 M đ) in comparison with total of income
restoration activity investment ;
(viii) some households considers income activity of IRP as sub -income activity is not
main income activity therefore they do not spending more time in
implementing;
(ix) some Households persists to be received cash of support level ;
(x) changes market and climate are reason to affect IRP implementation and result
of IRP

12.5. Evaluation of IRP Implementation in Can Gio District


117. Though the handing over of IRP input has been initiated or carried out in three districts;
Ben Luc, Can Giuoc and Can Gio, however, evaluation of completion IRP implementation could
be carried out in Can Gio district only.

118. The handing over of input in Ben Luc and Can Giuoc District in Long An province has
been done in 2016-2017. Monitoring and evaluating and monitoring conducted in 2017 and is
summarizing result of this survey

119. In 08 January 2018. Can Giuoc District PC issued Decision No 35/QĐ-UBND of


adjustment and strengthen: re-establishment of management committee for Income
Restoration Program ( IRP) for Ben Luc- Long Thanh Express Way Project, Section passes Can
Giuoc District, afterward some members of the Management Committee of IRP of Can Giuoc
District, retired and removed working to other unit ( see Annex 7)

120. In Can Giuoc District, according to IRP implementation committee in Can Giouc district
has communicated that 76 HHs, who have received the IRP input before in 2016- 2017, the
evaluation and monitoring of those HHs will be conducted in the month of August 2017 and will
completely summarize in February – March 2018 and additional Information that, 43 HHs are
additional approved in household list of IRP of Can Giouc District by Long An Province PC as
according to Letter No 4236/UBND- KT dated 20 September 2017 to carry out future, Currently.
Management committee of IRP of Can Giuoc District is waiting Budget to conduct for these 43
HHs

121. A summary completion Report on Evaluation of IRP implementation of Can Gio District
completed and submitted to EPMU. Other District, IRP is being carried out as above written

13. PREPARATION OF RESETTLEMENT PLAN (RP) ADDENDUM:


122. Resettlement Plan (RP) addendum for electricity Pole removal, as required by MOU of
ADB, May 2017, has been prepared for Ben Luc District and was submitted to EPMU, because
Ben Luc District approved plan of compensation and completed land acquisition. Remaining
the RP addendum of other districts is pending due to following reasons:

• Binh Chanh District: additional Compensation plan for land acquisition to relocate
electricity poles in The District was prepared and submitted to Department of finance
of Ho Chi Minh City for reviewing and approval before Binh Chanh district PC approval
on the additional compensation plan for land acquisition to removing electricity poles
in District but pending at this time, with reason: MOT’s approval on assessment of
compensation price is not clear. Currently this submission is pending at Department of
Finance of Ho Chi Minh City and EPMU is working and explaining with them on this
issue.
• Nha Be District: CoLFD of The District is awaiting approval for cadastral map of
recovered land area part for each pole from DoNRE of Ho Chi Minh City to have basis
issue of decisions for land acquisition and preparation of compensation plan. This
cadastral map is being pended at DoRNE. Therefore, Compensation plan is not yet
prepared up till now. EPMU and local authority are resolving
• Nhon Trach District: CoLFD is carrying out land acquisition for project and not yet
started process for preparing compensation Plan for relocating Power poles.
• Consultant and EPMU are following up compensation committee of districts to speed
up completion of compensation plan addendum as request

The working groups will assist in implementing IRP according to assign the IRP implementation Management
committee of the Ben Luc- Long Thanh Expressway Project, section passes Can Giuoc District
The IRP implementation Management Committee will use stamp and account of DoLISA of The Can Giuoc
District to liquidate budget as regulation
Article 3. Office manager of District People’s committee and People’s council, Head of DoLISA, Leaders of
related agencies, MS, Mr. having name as in article 1 and PC chairman of Phuoc Ly Commune and Long
Thuong Commune responsible in implementation of this decision
This decision effects since signed and replace decision No 10/QD9-UBND dated 06/January/2016 of Can
