PEOPLE V.

MAPA Y MAPULONG
G.R. No. L-22301, August 30, 1967

I. FACTS

 Mario Mapa Mapulong is a secret agent of Hon. Feliciano Leviste, then Governor of Batangas
 He had in his possession a home-made revolver (Paltik), Cal 22, without serial number, with
6 rounds of ammunition
 Lower court rendered a decision convicting Mapa of the crime of illegal possession of
firearms
o 1 year, 1 day – 2 years
o Confiscated firearm are forfeited in favor of the Government
 Mapa petitioned to SC
 MAPA’S CASE:
o People v Macarandang: The title of secret agent sufficiently put Macarandang
within the category of “peace officer”

II. ISSUES

 Whether or not the appointment to and the holding of the position of a secret agent to the
provincial governor would constitute a sufficient defense for the crime of illegal possession of
firearm and ammunition

III. RULING

 The petition is DENIED.

IV. RATIO

 No provision in the law is made for a secret agent. The previous decision in People v.
Macarandang no longer speaks with authority
