Crèche – Definition & Legislative Coverage
❑ A crèche is a facility which enables parents to leave their children while they are at work and where children are provided stimulating environment
for their holistic development. Crèches are designed to provide care to children, usually up to 6 years of age, who need guidance and supervision
away from their home during the day – Ministry of Women and Child Development, Government of India
❑ The Maternity Benefit Act 1961 was amended by way of the Maternity Benefit (Amendment) Act, 2017 to introduce various new requirements
including the need to provide a crèche facility as follows:
• Every establishment having 50 or more employees shall have the facility of crèche within such distance as may be
prescribed, either separately or along with common facilities
• The employer shall allow four visits a day to the crèche by the woman, which shall also include the interval for rest allowed
to her
• Every establishment shall intimate in writing and electronically to every woman at the time of her initial appointment
regarding every benefit available under the Act (Section 11A)

Crèche should be built with a minimum space of 10 to 12 sq. ft. per child with proper light and ventilation, provision of safe and potable drinking

The crèche unit should have up to 30 children. The Guidelines provides for appointment of one crèche-in-charge along with one helper for every
10 children under the age group of 3 years and for every 20 children in the age group of 3 to 6 years. However, in case the number of children

is less than 5, a crèche-in-charge may not be appointed. A specified selection criterion, training schedule and role of each worker has also been
prescribed

Every establishment to adopt child protection policy and provides for a prototypical policy as a guide. The policy is aimed at prohibiting

received under the policy and the redressal of the same

The Guidelines provide for a suggestive list of equipment and material required by establishment to be maintained at the crèche facility.

from which such material has originated, platform of display of such material etc. (Section 19 read with Rule 11 (1) & (3))
Periodic trainings for Periodic training shall be organized for sensitizing the staff/employees (regular or contractual) on child safety and
