Crèche – Definition & Legislative Coverage

❑ A crèche is a facility which enables parents to leave their children while they are at work and where children are provided stimulating environment
for their holistic development. Crèches are designed to provide care to children, usually up to 6 years of age, who need guidance and supervision
away from their home during the day – Ministry of Women and Child Development, Government of India

❑ The Maternity Benefit Act 1961 was amended by way of the Maternity Benefit (Amendment) Act, 2017 to introduce various new requirements
including the need to provide a crèche facility as follows:

• Every establishment having 50 or more employees shall have the facility of crèche within such distance as may be
prescribed, either separately or along with common facilities

• The employer shall allow four visits a day to the crèche by the woman, which shall also include the interval for rest allowed
to her

• Every establishment shall intimate in writing and electronically to every woman at the time of her initial appointment
regarding every benefit available under the Act (Section 11A)

Crèche Facilities Under the Code on Social Security, 2020:
❑ Chapter-VI of Code relates to maintenance of crèche facility.
❑ Section-67 of the Code retains the 50-employee threshold, and the draft Rules provide that the facility shall be located either:-
✓ Within the establishment; or
✓ At an appropriate distance from the establishment such that it is easily accessible for women employees including a woman employee working
from home
❑ The crèche is to be maintained for the use of children under the age of 6 years and must contain adequate accommodation with lighting and
ventilation.
❑ Section-67 provides employers with the option of maintaining common crèche facilities. Thus, an establishment is now allowed to avail common
crèche facility of:-
✓ Central Government
✓ State Government
✓ Municipality
✓ Private entity
✓ Non-Governmental Organization
✓ Any other organization or group of establishments who may pool their resources for setting up a common crèche
❑ The employer is also required to provide intimation in writing electronically to every woman at the time of her initial employment. This
intimation shall provide details on every benefit available to such a woman employee under the Maternity Benefit chapter of the Code.
❑ The employer is also required to provide women employees with 4 visits a day to the creche that are inclusive of her intervals of rest.
National Minimum Guidelines for setting up and running Crèches under
the Maternity Benefit (Amendment) Act, 2017
❑ The Ministry of Women and Child Development, Government o India has formulated these guidelines to standardize the quality of crèches and to ensure
effective implementation of the Act

❑ The guidelines provide a list of minimum standards and norms based on child development principles in alignment with the National ECCE Policy 2013

The crèche unit should have up to 30 children. The Guidelines provides for appointment of one crèche-in-charge along with one helper for every

is less than 5, a crèche-in-charge may not be appointed. A specified selection criterion, training schedule and role of each worker has also been
prescribed

Every establishment to adopt child protection policy and provides for a prototypical policy as a guide. The policy is aimed at prohibiting

received under the policy and the redressal of the same
