FINAL ORDER

This matter comes before the Department of Highway Safety and Motor Vehicles upon the
Administrative Complaint, issued January 7, 2022, against VROOM AUTOMOTIVE, LLC.
Accordingly, it is FOUND AND ORDERED as follows:
1. Petitioner is the state agency charged with regulating the business of buying,
selling, or dealing in motor vehicles or offering or displaying motor vehicles for sale, pursuant to
§ 20.24 and Chapter 320, Fla. Stat., and Fla. Admin Code R. 28- 106.2015.

2. Respondent is, and has been at all times material hereto, a licensed motor vehicle
dealer in the State of Florida, having been issued license number VI- 1133073, based upon the
application identifying PAUL HENNESSY as President. The physical address of record is
1551 East Silver Star Road, Ocoee, Florida 34761.
3. On January 12, 2022, the Department properly served the Administrative
Complaint on Respondent. § 120.60(5), Fla. Stat. Respondent failed to timely file a response to
the Administrative Complaint within 21 days of being served with the Administrative Complaint
as required by law and rule. § 120.569(2), Fla. Stat.; Fla. Admin Code R. 28- 106.111(2).
4. Based on the foregoing, Respondent has waived the right to a hearing pursuant to
§§ 120.569(1), 120.57(1), and 120.57(2), Fla. Stat., and Fla. Admin Code R. 28- 106.111(4).

5. Therefore, the facts in this cause are deemed admitted. Trisha's One Stop v. Office
of Fin. Regulation, 130 So. 3d 285, 287 (Fla. 1st DCA 2014).
FINDINGS OF FACT AND CONCLUSIONS OF LAW
6. The facts in this cause are not in dispute and are deemed admitted.
7. Therefore, the allegations of fact set forth in the Administrative Complaint are
approved, adopted, and incorporated herein as the findings of fact of the Department.

8. The conclusions of law alleged in the Administrative Complaint are approved,


adopted, and incorporated herein as the conclusions of law of the Department pursuant to
§ 320.011, Fla. Stat.

9. Based on the Findings of Fact and Conclusions of Law, the violations in the
Administrative Complaint warrant discipline.

WHEREFORE, it is ORDERED AND ADJUDGED:


10. Respondent shall pay a civil fine in the amount of forty -seven thousand dollars
($47,000.00) within 15 days from the date of filing of this final order.

11. Failure to pay the $47,000.00 will result in the Department's suspending
Respondent' s license until such time that Respondent complies with the terms of this final order.
THIS FINAL ORDER SHALL BECOME EFFECTIVE UPON FILING WITH THE AGENCY
CLERK OF THE DEPARTMENT OF HIGHWAY SAFETY AND MOTOR VEHICLES.

NOTICE OF RIGHT TO APPEAL


A party adversely affected by this final order may seek judicial review as provided in
§ 120.68, Fla. Stat., and Fla. R. App. P. 9.190. Judicial review is initiated by filing a notice of
appeal with the Agency Clerk, and a copy of the notice of appeal, accompanied by the filing fee,
with the appropriate district court of appeal. The notice of appeal must conform to the requirements
of Fla. R. App. P. 9.110(d) and must be filed (i.e., received by the Agency Clerk) within thirty (30)
days of rendition of this final order.

Filing with the Department's Agency Clerk may be accomplished by U.S. mail, express
overnight delivery, hand delivery, facsimile transmission, or electronic mail. The address for
