‘THE PROSPECTIVE ADOPTIVE PARENTS - FATHER
He is the son of the late Josphat Njoroge Njathi and Joyce Wanjiku Njoroge.
His family hails from Thogoto in Kiambu County, He has 5 grown up
siblings who live in different places with their families.
EDUCATIONAL BACKGROUND
He went to Mirithu Primary School and later to Kijabe High School. From
there he moved on to the University of Dar where he obtaned a bachelor
degree in mechanical engineering.
PROFESSIONAL BACKGROUND
He has always been a public officer attached to the Ministry of Water
before he retired from service.
THE PROSPECTIVE ADOPTIVE MOTHER
She is the daughter of the late Gabriel Thigiti and Faith Wathemu. Her
family comes from Kagio in Kirinyaga County. She has 5 grown up siblings.EDUCATIONAL BACKGROUND
‘She attended Kagio Primary School and later joined Kambare Girls High
‘School. From there she moved to Eldoret Bible College where she obtained
a bachelor degree in theology and masters degree in leadership from the
same university. She has also obtained a PHD in psychological counseling
from North Western Christian University.
PROFESSIONAL BACKGROUND
After her education and training, she was employed by the Ministry of
Agriculture where she was attached to KARI.
MARRIAGE
‘They contracted a Christian marriage in 1981 and out of which 3 issues
ensued but 1 is deceased. They describe their marriage as happy and are
able to resolve their issues through dialogue.
VIEWS ON DIVORCE
‘They hold the view that married couple should strive to maintain their union
no matter the challenges and that divorce should be the last resort
ABOUT THE CHILD IN THIS MATTER
‘The child is believed to have been born on 07/07/2006 and is therefore 15
years old. She was abandoned by her mother at Lilian Atieno’s house in
Soweto Slums. The 2 police letters from Soweto Police Station indicate as
such and that no relative has ever been found.
‘The child was then’placed at Imani Children Home and her formal
‘committal was done by Nairobi Children Court vide protection and care
case number 196 of 2015.
The child was then placed under the foster care of Hadijah Muthoni Thigiti
on 09/12/2015,pending adoption. However, the said Hadijah died on
29/07/2017 having appointed the applicants legal guardians. The
applicants then stepped into the shoes of the late and made this present
application to adopt the chilé,ice1013
‘She has lived withthe applicants since the deceased died and attends
schgol at Mama Ngina in Kinoo where she is in class 8
OPINION AS TO WHETHER CHILD IS FREE FOR ADOPTION
‘She was declared free for adoption on 02/07/2021 by Buckner Adoption
Society as indicated in the certificate of freeing serial number 105. given
the fact that the child was abandoned and no relative has ever been found,
| reasonably believe that she is available for adoption and was properly
freed for the same.
REASONS ADVANCED FOR THIS PROPOSED ADOPTION
‘The child has initially been placed with the female applicant's sister who
died. Both applicants had been proposed as legal guardians and when the
appicant died they stepped into her shoes and continued the process.
FINANCIAL ABILITY
‘They live in their own house in Kinoo near Uthiru and have 4 leased units.
‘They make enough money to take good care of the child and themselves.
HOME ENVIRONMENT
The home of the applicants was visited. They lve in Kinoo near Uthiru in
their 4 bed-roomed house with the child. The house stands in a big
compound and is well furnished
RIGHT OF INHERITANCE
The applicants do understand the right of the child to inheritance all their
property in accordance with the provisions of the Law of Succession Act
without any discrimination
OBSERVATIONS
The child has bonded well with the applicants as if they are related by
blood. They have generally provided a conducive environment for the
grown and development ofthe childRECOMMENDATION
The joint applicants have met virtually all the legal requirements for
adoption as provided in the Children Act and other enabling provisions of
the law. They do not have any known criminal record and the police
clearance produced by them clearly attests to thai, They are financially
secure and that will enable them take good care of the child, They have
bonded well with the child. They have further provided a conducive
environment forthe child to grow and develop.
‘They have appointed their daughter Dorine Wanjiku Njathi as the legal
guardian in case of death or incapacity
The child is free for adoption, having been declared as such by Buckner
Kenya Adoption Society and the process leading to that freeing was well
done. The child was abandoned and the police have not found any
relatives to claim her. Adoption therefore remains the most effect method to
safeguard and protect her best interest.
Seeing that the applicants have met the requirements for adoption and the
child is available for the same, Director Children Services recommends
them to adopt the child
