AND ORDER SETTING HEARING FOR PRELIMINARY INJUNCTION

After considering Plaintiff, State of Texas’ application for temporary restraining order, the pleadings,

affidavit and evidence, the Court finds:

1. The Texas Alcoholic Beverage Code (TABC), and the Civil Practice and Remedies Code

(CPRC) and the Texas Rules of Civil Procedure (TRCP) give the County Attorney

authority to seek injunctive relief for violations of said statutes.

2. Violations of the TABC and CPRC have occurred or are occurring, and these violations

pose an immediate threat of irreparable injury, loss or damage.

3. Plaintiff is entitled to appropriate injunctive relief to prevent the violations from occurring

or continuing to occur, and to prevent immediate threat of irreparable injury, loss or

damage.

4. No imminent harm, irreparable injury, or showing of the absence of an adequate remedy at

law is necessary to support the State’s entitlement to injunctive relief under the TABC or

CPRC.

5. A showing of imminent harm, irreparable injury has been shown in the State’s petition.

6. The State has met the requirements of Local Rule 1.05, and an ex parte order is necessary

and proper.

7. The State is not required to post a bond under Section 6.001 of the CPRC and TABC Sec.

101.01(b).

8. A Temporary Restraining Order is reasonable against the Real Property known as 5081

Fort Defiance, El Paso, Texas 79938, in rem (hereinafter, “Property”), and is a party.

9. A Temporary Restraining Order is reasonable against, Defendant Priscilla Chavez, owner

of the Property known as 5081 Fort Defiance, El Paso, Texas 79938.

10. A Temporary Restraining Order is reasonable against Defendant Gabriel A. Chavez, an

individual who lives at the Property, and owns and operates Defendant Mansion

Promotions LLC at the Property.

11. A Temporary Restraining Order is reasonable against Mansion Promotions LLC, located

at an operating from 5081 Fort Defiance, El Paso, Texas 79938.

12. A Temporary Restraining Order is reasonable against GMT Promotions ENT, a company

that proports to rent portions of 5081 Fort Defiance, El Paso, Texas 79938, and operates a

entertainment business from the Property.

13. A Temporary Restraining Order is reasonable against Jesse Hayward Bruce Jr, who owns

and operates GMT Promotions ENT.

IT IS THEREFORE ORDERED, ADJUDGED and DECREED that:

1. All named Defendants are restrained and enjoined from operating, hosting, advertising,

promoting, maintaining or using the Property at 5081 Fort Defiance, El Paso, Texas 79938

in any way for gatherings, parties, entertainments or social activity of any kind for the

duration of a Temporary Restraining Order or until further order of the court;

2. Defendants must immediately cease to operate a business from 5081 Fort Defiance, El

Paso, Texas 79938 in any capacity until the temporary restraining order expires;

3. Defendants must post on all social media platforms used to advertise, give notice of and

promote events at the Property: “NOTICE events held at the Mansion at 5081 Fort

Defiance Drive El Paso, Texas 79938 are temporarily cancelled by court order” and remain

posted and visible until further order of the court;

4. All records and documents from April 2019 to present, relating to the business of

Defendants operating out of the Property including but not limited to the ownership,

rental/lease, and records relating to taxes, employees, clients and the operation of 5081 Fort

Defiance, El Paso, Texas 79938 as a business must be preserved;
