i. In California, changing venue refers to transferring the action from one California county to another.
1. Changing Venue When Original Venue Is Proper
a. The judge may transfer the action if the transfers serves (1) the interests of justice, and (2) convenience of the witnesses.
2. Changing Venue When Original Venue Is Improper
a. The judge may transfer the action to a proper county if the P’s complaint designates the wrong court.
3. Forum Non-Conveniens
a. A court may stay or dismiss a case if another forum in another state or country is (1) more suitable, and (2) the balancing of public and
private interest factors strongly favor staying or dismissing the case.
i. More Suitable [Other Forum Must Have . . .]
1. PJ; and
2. Its SOL does not bar the claim; and
3. It provides (a) due process, (b) impartial jury, and (c) some form of remedy.
