JUDICIAL AFFIDAVIT OF ZEPHIRIN DAVID

This Judicial Affidavit of Zephirin David, the witness for the prosecution, is
executed to serve as his direct testimony in the instant case.

This Judicial Affidavit is being offered to prove that 1) All the allegations in
the Information including all annexes appended thereto and 2) All other
related matters, facts and circumstances relevant and material to this case.

This Judicial Affidavit was taken at the office of Atty. Renda Rae L.
Mendoza at Mendoza and Mendoza Law Offices, Angeles City, Pampanga.

Questions were propounded by Atty. Renda Rae L. Mendoza, numbered

consecutively with each question followed by the answer of the witness.

QUESTIONS AND ANSWERS

1. Do you swear to tell the truth and nothing but the truth?

YES

2. Are you aware that you may face criminal liability for false testimony or
perjury if you will not tell the truth?

YES

3. Please state your name, age address and occupation

 ZEPHIRIN C. DAVID. I AM 26 YEARS OLD. I LIVE IN UNIT 3, DAISE
AVENUE, DEL ROSARIO, SAN FERNANDO, PAMPANGA. I AM A
DENTIST

4. Do you know the Complainant in this case, Rev. Fr. Thordan Manabat?

YES.

5. Do you know the respondent in this case, Ardbert Mateo?

YES.

6. How do you know Ardbert Mateo?

HE IS OUR NEIGHBOR.

7. Are you a practicing Catholic?

NOT REALLY.

8. How devout are you, would you say, in your beliefs as a Catholic?

I AM NOT VERY RELIGIOUS BUT I PARTICIPATE IN RELIGIOUS

CEREMONIES IF THERE ARE.

9. Do you regularly attend mass at Holy Spirit Parish?

YES BUT I DON’T HAVE PERFECT ATTENDANCE BECAUSE

SOMETIMES I HAVE TO WORK ON CLIENTS..

10.Did you attend the June 19, 2022 Sunday mass at 8:00 in the morning?

YES, I DID.

11. Who were you with during the mass?

I WAS WITH MY GIRLFRIEND.

12.Where were you seated?

WE WERE SEATED BEHIND ARDBERT AND SETO.

13.Did you witness any unusual incident over the course of the celebration?

YES I DID.

14.What did you witness?

ARDBERT KISSED SETO DURING PEACE OFFERING.

15. How long did the incident go on for?

NOT LONG. IT WAS QUICK.

16.Did the attendees see or notice this incident as it happened?

YES, MOSTLY THE PEOPLE IN OUR ROW AND THOSE SEATED ON

THE ROW ON EITHER SIDE OF US SAW THE INCIDENT BECAUSE
THEY WERE LOOKING AT THE PAIR AFTER THE ACT.

17.What was the reaction, if any, of the church goers to this incident?

THEY WERE LOOKING AT ARDBERT AND SETO WITH WIDE EYES

AND THEY DEFINITELY LOOKED SHOCKED AND SCANDALIZED.

18. What was your personal reaction to this incident?

I WAS ALSO SHOCKED OF COURSE, AS WAS MY GIRLFRIEND.

19. Do you know the relationship between Mr. Ardbert Mateo and Mr. Seto
Natividad?

NO. I ASSUMED THEY WERE JUST CLOSE FRIENDS AND

HOUSEMATES.
20. Did any person of authority from the church do anything about the
incident?

DURING THE INCIDENT, NO. BUT FATHER THORDAN TOOK A

WHILE TO RESUME THE CELEBRATION. AFTER THE MASS, I
STAYED FOR A WHILE AS IS MY PRACTICE, TO WAIT FOR MY
BROTHER FINISH POST-MASS THINGS WITH HIS PEERS AND I
SAW FATHER THORDAN SUMMON ARDBERT INTO THE SACRISTY.

21.Did the celebration end after the incident occurred?

NO. THE MASS ENDED NORMALLY.

the corresponding answers that the witness gave and that neither I nor any
other person present or assisting me has coached the witness regarding the
latter’s statement.
