‘SUBJECT: Bunting License Requirement for Residents
Bunting Deer Over Salt Lick
There appears to be some confusion about hunting license requirements for
residents or members of their inmediate family hunting on land they ow but
éo not reside.
This is due to conflicting statutes in the code, Section 9-11-51 requires
residency on the land by the landomer and inmediate family vhile paragraph
four (4) of 9-11-44 does not require residency on the land. Since Section
9-11-44 is the most recent law passed by the legislature, it takes prece-
dence over Section 9-11-51 and residency upon the property by the landowner
is not required for the license exenption to epply. This only applies to
residents of Alabama whether they are the landowner or members of the
immediate family.
Questions continue to arise about hunting deer over salt licks. In 1975,
the legislature amended vhat is now Section 9-11-245 to allow hunting deer
over salt licks. The word "salt" vas inadvertently left in Section
9-11-244 without an exclusion alloving the hunting of deer over a salt
lick. The legislative intent of allowing the hunting of deer over salt
licks has been honored by the Division. A copy of the amended law is
enclosed for your review.
I appreciate the effort each of you is putting forth during a busy hunting
season. The limitation of the forty-hour work week requires that each work
ey is planned carefully to provide maximm service to the public and
protection for our wildlife resources.
