RESERVIST ACT OF 1991 “a sa a a a S&S = 2 = 6 )SlUl= REPUBLIC OF THE PHILIPPINES DEPARTMENT OF NATIONAL DEFENSE ‘Camp General Emilio Aguinaldo, Quezon Cily RULES AND REGULATIONS IMPLEMENTING THE CITIZEN ARMED FORCE OR THE ARMED FORCES OF THE PHILIPPINES RESERVIST ACT OF 1991 RULEL GENERAL PROVISIONS ction 1, Legal _Basis_and Purpose. - These Implementing Rules and Regulations are hereby issued pursuant to pertinent provi ns of Republic Act Number 70 77, otherwise known as the Citizen Armed Force or the Armed Fi ces of the Philippines Reservist Act and hereinafter referred to as the Aci, to insure the smooth , orderly, speedy and effective implementation of the law. Section 2, Scope _and Application, - These Rules and Regulations shall cover the development, administration, organization, training, maintenance and utilization of the Citizen Armed Force of the Armed Forces of the Philippines (AFP), hereinafter referred to as the Reserve Force, and shall apply (o all personnel and units of the AFP tasked to undertake the aforementioned activities. Section3, Declaration of Policy. - It is hereby declared the policy of the State lo: a. Maintain a standing or regular military force in times of peace consonant with its actual needs for ils security but which can be rapidly expanded by the well-disciplined Citizen Armed Force or Reserve Force in the event of war, invasion or rebellion; ! | | b. Provide maximum opportunity for the Citizen Armed Force to participate in safeguarding the security of the State, assisting in socio-economic development, in rescue and relief during disasters and calamities, and in the operation of vital utilities and services in time of emergencies; and c _Ensure the readiness and preparedness of the Citizen Armed Force to the call of service and responsiveness to their role as protector of the people and the State. It is not envisioned by the State to have a nation under arms, unless extremely necessary. Hence, the manpower objective of the Citizen Armed Force shall conform with projected and actual needs. Section 4. Definition of Terms. - For the purpose of these Rules and Regulations, the following terms are hereby defined: a. Academic Class - the total number of students undertaking the same baccalaureate degree or course who completes the scholastic requirements for a specific academic term. b. Academic Term - either semestral or trimestral period of instructions observed or followed by an institution of higher learning Acceptance Board - a group of selected individuals, created by law and headed by the civil registrar or municipal treasurer of a city or municipality, given the responsibility to examine and classify registrants selected for compulsory military training as provided for in Sections 24 of R.A. 7077. d. Institution of Higher Learning - any public or private school, college of university duly accredited by the Department of Education, Culture and Sports to confer baccalaureate degrees. m. Law nforcement Service - refers to programs or activities for the maintenance of peace and order and those which encourage observance of and compliance with law. n. Military Service - refers to programs or activities necessary to enhance the military preparedness of the citizenry. © Mobilization Center - a specified area in the province designated by the Secretary of National Defense in consultation with local executives where the reservists will report upon mobilization. P- Mobilization - the process of assembling personnel and material and placing them in a slate of combat readiness. q Presidential Appointees - refers to government officials appointed by the President, with or without the confirmation of the Commission on Appointments of Congress. t. Promotion - the process of upgrading the rank of military personnel both in the active and inactive list in accordance with existing laws, rules and regulations. Ss. Seniority and Lineal List - refers to the master record of inactive reserve officers grouped according to rank and arranged according to seniority in the manner as provided for under existing rules and regulations for officers in the Regular Force. 4 —! “ Women's Auxiliary Training Corps (WATC) - refers toa two-year (basic) or another two-year (advance) voluntary military taining course offered lo female college students u. Women Reservists - refers to the female members of the Reserve Force whose membership have resulted from the same standard for admission, training and commissioning required for the male members thereof, except for those essential adjustinents in such standards required because of physiological differences, RULE I ‘THE RESERVE FORCE. Section 5. Mission of the Reserve Force. - The mission of the Reserve Force as prescribed in Section 7 of R.A. 7077 is, to: - Provide the base for the expansion of the AFP regular force in the event of war, invasion or rebellion; ~ Assist in the rescue and relief during disasters and calami - Assist in socio-economic development; and - Assist in the operation and maintenance of essential government or private utilities in the furtherance of the overall mission. Section 6. Reserve Fores unponents. - The Reserve Force shall be organized into five (5) components, namely: a. The Army Reserve Component; b. The Chief of Staff, AFP, shall render a report on the status, canvassing and inventory of all existing AFPARUs that were constituted with orders prior to the effectivity of these Rules and Regulations Section 9. Citizen Soldiers or Reservists. - The citizen soldiers, alternately referred to as reservists, who compose the Reserve Force, are those reservists of the AFP who are incorporated into the Reserve Force, as follows: a. Graduates of the ROTC/WATC basic and advance courses who were issued orders as enlisted reservists or reserve officers of the AEP; b. Graduates of authorized basic military training instructions such as draftees, trainees and others who, as a result thereof, were issued orders as reservists; ¢. Officers and enlisted personnel reservists of the defunct Philippine Constabulary (PC) who shall have transferred to the reserve component of either of the three (3) major services of the AFP. PC reservists who opted to remain with the Philippine National Police (PNP) may be considered, subject to the guidelines to be issued by the Secretaries of National Defense and Interior and Local Government; d Members of the PNP who were formerly members of the AEP and who opted to join the AFP Reserve Force and were issued orders as reservists; ©. Ex-servicemen and retired officers of the ALI and other armed forces that have diplomatic relations with the Philippines who, were honorably discharged or retired from the service, and who are Filipino citize tions; upon their applic: ized World War IL guerrillas who were honorably f Recopt discharged from the service; Commissioned offic rs and enlisted personnel under the Alliliated Kese es calegory and graduates of the National Defense College of the Philippines (NDCP) who have been issued orders as reservists; and h. Categorization_of Citizen Soldiers. - Citizen soldiers or follow: ‘eservists shall be categorized based o age, erve shall a. Second Category Reserve - The Second Category Reserve shall be composed of all able-bodied reservists whose ages are between thirty-six (36) and fifty-one (51) years, inclusive. © Third Category Reserve- The Third Category Reserve shall be composed of all able-bodied reservists whose ages are above fifty-one (51) years, but not more than sixty-five (65) years. Section 11. Classification _of Reserve Units. - Reserve units shall be classified into the Ready Reserve, the Standby Reserve, and the Retired Reserve based on their operational readiness and prioritization for utilization and employment. a. Ready Reserve - The Ready Reserve shall be composed of citizen soldiers belonging primarily to the First Category Reserve augmented by highly qualified officers and enlisted personnel from the Second and Third Category Reserves who shall be organized, trained and equipped as mobilizeable ready reserve, subject to call at any time to augment the regular units of the AFP not only in times of war or national emergency but also to meet local emergencies ai ing from calamities, disasters and threats to peace and order, including the need to provide assistance in rescue and relief work and developmental activities to enhance the attainment of local and national stability. (1) Any citizen soldier or reservist belonging to the Second Category Reserve and/or Third Category Reserve, particularly those commissioned officers and enlisted personnel who will volunteer to serve with the Ready Reserve, shall be allowed, if qualified and fit for duty, to join and actively participate as part of the Ready Reserve and serve with an appropriate Ready Reserve unit. 2) Members of AFPARUs in various government and private ulililies and services, regardless of their age categorization, shall be classified as Ready Reserve. (3) All citizen soldiers belonging to the First Category Reserve, except those exempted under R.A. 7077 and these Rules and Regulations, shall be required to serve with Ready Reserve units and will have assignments and promotions in accordance with existing policies of the Department of National Defense until transferred to the list of Retired Reserve by virtue of their age. b. Standby Reserve - The Standby Reserve shall be composed of citizen soldiers belonging mostly to the Second Category Reserve and Third Category Reserve, except as provided in R.A. 7077 and these Rules and Regulations. The members of the Standby Reserve shall be organized and assigned to specified reserve units and shall be maintained through limited periodic assembly tests or registrations to update their records and their present addresses, among, others. The Standby Reserve may be mobilized or ordered to active duty only in times of war or national emergency. The ranks of members of the Standby Reserve may be upgraded if they voluntarily participate in training or serve with the Ready Reserve units in their areas or if their Standby Reserve units undergo training. They will however be encouraged to upgrade their military knowledge and skills by taking up non-resident or resident courses at the training centers of the Major Services which shall be set up for this purpose. Retired Reserve - The Retired Reserve shall be composed of citizen soldiers or reservists who have qualified for retirement . 10 q eg pre a Cre Cent Ce ae eer Reese pee) eee ere Nes mend ee ee ee ee ee Section 12, Exemption from Service with Ready Reserve Uni through length of service, old age or disability. For this purpose, sixty- five (65) years shall be considered as the retirement age. However, if qualified and fit for duty, a member of the Retired Reserve may be ordered to active duty in terms of local or national emergencies if he volunteers for active duty and when the Secretary of National Defense, as recommended by the Chief of Staff, AFP, determines that, there are not enough qualified citizen soldiers or reservists with his special skills and qualifications in the Ready Reserve or the Standby Reserve, in his particular area of residence. ls. - The following citizen soldiers may be exempted from rendering service with Ready Reserve units: a. Active members of the Armed Forces of the Philippines and the Philippine National Police; b. Those who are residing abroad, but only during the duration of their absence from the Philippines; © Those who are physically and mentally unfit to serve their tour of duty; d. Those who are convicted of crimes involving moral turpitude; and ¢. ‘Those who may be exempted from duty for valid reasons which may be authorized on a case-to-case basis by an appropriate and competent authority. For this purpose, the Chief of Staff, AFP, shall issue such appropriate guidelines, rules and regulations as may be deemed necessary to implement this Section. " Section 13. Classification and Maintenance of State of Readiness of Ready Reserve Unils. - a. Units of the Ready Reserve shall be further classified as to the degree of readiness to respond to the call to service, as follows: (1) Ready Reserve I - Units classified as Ready Reserve I shall be maintained in a degree of readiness for operational employment in not more than seven (7) days after activation. ‘The individual clothing and equipment and crew-served weapons shall be ready for distribution upon their activation. The whereabouts and status of their reservists shall be constantly ascertained. As necessary, these units shall carry an excess of twenty percent (20%) of their authorized strength to compensate for those who fail to report or be late in reporting for duty. (2) Ready Reserve Il - Units classified as Ready Reserve II shall be maintained in a degree of readiness for operational employment in not more than fifteen (15) days. b. The Chief of Staff, AFP, shall recommend to the Secretary of National Defense the placing under Ready Reserve I and Ready Reserve II status of the reserve units in areas threatened by invasion, rebellion, or insurrection. 12 —_— + ak ok EE SS SE SE eee ee ek Ss me RULE Il PROCUREMENT OF RESERVE MANPOWER Section 14. Scope. - This Rule provides the procedural guidance in the procurement of reservists of the Reserve Force through the Compulsory Citizen Military Training, Reserve Officers’ Training, Corps, the AFP Affiliated Reserve Units, and the commissioning of elected officials and presidential appointees. Section 15. Registration for. Compulsory Military Training. - All male Filipino citizens between the ages of eighteen (18) and twenty-five (25) years who are not yet reservists or otherwise exempted from compulsory military training, are required to register for lary instruction. Registration shall take place during regular office, hours between the date of April 1 and 7 ata suitable place prescribed by the city or municipal government in which the registrants reside, commencing one (1) year after the effectivity of R.A. 7077. In case April 7h falls on a legal holiday, the registration period shall be extended to the following working day. Biennial registrations shall be held during the same period thereafter. Section 16. Registering Officers. - For the purpose of registration as provided in Section 15 hereof, the city/municipal treasures of chartered cities and municipalities are designated as registering, officers pursuant to Section 16 of R.A. 7077 and shall see to it that the registration is carried out in proper manner. 3 a ee eke eH HEH HEHEHE BEE Sh km! =e Section 17, Exemption from Compulsory Military Training. - The following persons are exempted from compulsory military training; a. Members of the clergy of any religious order or sect, except if they volunteer; b Those in the active service of the Armed Forces of the Philippines and police members of the Philippine National Police; © Uniformed members of the National Penitentiary, corrective institutions, and insane asylums; and d. Licensed air and maritime pilots, navigators, and merchant marine officers. Section 18. Disqualification_or Exemption from Registration. - The following persons are disqualified or exempted from registration: a. Those who are disqualified by law from employment in the government service; b. Those who are physically and mentally unfit as certified by an AFP medical officer; c Those who are suffering incarceration awaiting ial by a Court of Law: Provided, That upon their release from custody they shall register without delay; ud. ‘Those convicted by final judgment of a criminal offense involving, moral turpitude; @ Students of colleges, universities and similar institutions of learning who are undergoing ROTC training during the pendency of their tre ining recognized by the military authorities as among, those undergoing raining to qualily as reservists; and "4 {£~ Those who are constituted as_ members of affiliated units for the duration of time that they hold such membership: Provided, That upon the termination of their membership, they shall be subject to compulsory military training. Section 19, nducl e Reg eporling of Kesulls. - a, The Secretary of National Defense, through the concerned. ALP staff/field unit, shall provide the forms to be used by the registrants and shall coordinate with the government agencies concerned to ensure the smooth, orderly, and peaceful conduct of the registration. b. Each registrant shall be required to furnish the following, information, among others, in the Registration Form which shall be given by the registering officer in triplicate copies: (1) Name - Surname, Given Name, Middle Name (2) Permanent Address (3) Date and Place of Birth 4) Civil Status (5) Blood Type © Religion (2) Name of dependents, if any (8) Educational Attainment (9) Nature of Employment/name of employer (10) Occupational specialty c Upon the termination of the registration period, the registering officer shall collect all accomplished registration forms and immediately prepare the forms for transmittal. One (1) copy shall be forwarded to the corresponding Board of Canvassers and another copy shall be given to the military commander in the area designated by the Chief of Staff, AFP, to assist in the conduct of the registration. ‘The remaining copy shall be kept by the registering officer for record purposes. The military commander, upon the receipt of the registration forms from all cities and municipalities within his jurisdiction, shall render a consolidated report of the results of the registration to the Chief of Staff, AFP, through channels. The Chief of Staff, AFP, shall prepare a consolidated report of the registration which shall be forwarded to the Secretary of National Defense within sixty (60) days after the registration period. Section 20. Quota for Compulsory Military Training. - The Chief of Stall, ALP, shall recommend to the Secretary of National Defense the quota for compulsory military training. Section 26. Registration of Citizens Residing or Working Abroad. ~ Fili citizens residing or working abroad, when they become liable lo register for compulsory military training, shall register with the nearest Philippine diplomatic or consular office which shall transmit the registrant's data to the Secretary of National Defense for proper disposition. Section 27. Composition and Operation of Acceptance Boards. - a. Students who successfully complete such training shall be exempted. Those who fail to complete, or discontinue the training, shall be subject to compulsory military training; (3) Seminary students of any religious sect shall be granted deferment not exceeding the prescribed course in the seminary. Those who complete the course shall be exempted from training, Those who fail to complete shall be subject to training; (4) Cadets of the Philippine Military Academy and of other military or police service academies, local or foreign, to include cadets of the Philippine Merchant Marine Academy and other similar merchant marine academies duly recognized by the Government for the training of officer candidates, including those selected for cadetship in such academies shall be granted deferments for not exceeding two (2) years. Those who successfully complete at least one-half (1/2) of the prescribed period of the course shall be exempted from training. ‘Those who fail to complete one-half (1/2) of the prescribed period shall, upon their discharge from their courses, be subject to training. The same deferments shall be granted to cadets of the Fire, Jail Management and Penology Academies; (5) High school students who are graduating may be granted deferment for not more than one (1) year; a Section 29. A draftee during the period of his active duty service to include the extension of such service is entitled to receive all the pay and allowances due his grade as received by any member of the Regular Force: Provided, That upon termination of his draftee service, he shall receive a separation gratuity of not less than ‘one (1) month basic pay for every year of his service to include the six (6) months of training, upon the condition that a period of six (6) months shall be considered a complete year for purposes of this gratuity. nt_of Reserve Officers and ted Personnel for ni Affiliated Reserve Units. - Key officers and employces of vital government or private entities, corporations, establishments and organizations that have affiliated units who are ne ary for the continuous and unhampered operations of the essential services they are rendering, shall be encouraged to undergo military training to clive qualify them as reserve officers or enlisted personnel in the i slatus. They shall be assigned to key positions in the affiliated units commensurate to their actual duties and responsibilities in the utility or firm where they are employed and called to active service with these unils once they are activated. The procedures governing the procurement, training and call to active duty of such reserve officers and enlisted personnel shall be as stipulated in existing AFP rules and regulations or others that may be promulgated later. Section 34. Other Sources of Commission in_the Reset ve Force, Commission in the Reserve Force, AFP, based on the following sources shall continue to be conducted by the AFP based on existing rules and regulations in order to sustain the procurement of reserve officers: a. Commission under P.D. 1908 b. Commission under P.D. 190 as amended c Commission under R.A. 718 RULE IV ORGANIZATION OF THE RESERVE FORCE Section 35. The Manpower Objective of the Reserve Components. - The Secretary of National Defense shall prescribe, subject to the approval of the President of the Philippines, the organization and manpower objective of each component of the Reserve Force based on currently approved AFP force development plans. Section 36. Organization for Maintenance _and Administration of the Reserve Force. - a. Staff Offices for Reservist and Retiree Affairs. ~ (i) At the General Headquarters, AFP, the office of the Deputy chief of Staff for Reservist and Retiree Affairs (DCSRRA) shall be maintained for the planning and formulation of policies for the 26 administration, development, organization, training, equipage, maintenance and utilization of the Reserve Force. (2) At the Major Service level, the office of the Assistant Chief of Staff for Reservist and Retiree Affairs shall be maintained to plan and formulate policies in the aduinistration, training, equipage, maintenance and utilization of the Major Service reserve components, b. Reserve Commands. - (2) To implement policies at GHQ level, the AFP Reserve Command shall be organized and activated as an AFP-Wide Support and Separate Unit under the collective general staff functional supervision of DCSRRA. It shall provide direction for the development, adininistration, organization, training, maintenance and utilization of the Reserve Force as a base for rapid expansion of the AFP. The Chief of Staff, AFP shall recommend for the approval of the Secretary of National Defense the Table of Organization and Equipment (TOL) of the AFP Reserve Command. Additional units shall be organized for reservists of the First Category Reserve who could not be absorbed in the Ready Reserve units. {Ready Reserve unils shall be filled up 120% so that the excess 20% shall be organized into a replacement unit which shall be a ready pool of reservists to fill in the personnel losses of their counterpart units in the regular force. , Functional Organizations - reserve units and individuals for all categories shall further be organized, tasked and prepared to undertake rescue and relief and community assistance functions in accordance with the mission of the Reserve Force prescribed in Section 7 of R.A. 7077. h. — Staffing of Reserve Units and Offices - in staffing the command structure of these reserve units and offices, preference shall be given to qualified reserve officers and integrees in the active service. RULE V TRAINING AND DEVELOPMENT OF THE RESERVE FORCE Section 38. Concept. - Training of the Reserve Force shall be geared towards the production of well-trained and militarily proficient soldiers who 2 are prepared to fill the requirements of the Active Component of the Armed Forces of the Philippines in times of contingency and to perform non-military or civil auxiliary services, such as civic welfare service and law enforcement service in time of need and emergency. In this regard, the training programs shall be classified as follows: a. Reservist Training b. Individual Training © Unit Training Section 39, Reservist ‘Training. - ‘This refers to training programs to = prepare and qualify individuals to become officer reservists and enlisted reservists. To this end, there shall be seven (7) types of reservist training programs: a. Compulsory Citizen Military Training (CCMT). - A basic military Uraining course of not more than six (6) months, the course of instruction of which shall be patterned after the program of instruction (PON) offered to candidate-soldiers of the regular force. b. National Service Program (NSP). - As provided for in Sections 38 and 39 of R.A. 7077, miliary training for students enrolled in colleges and universities and similar institutions of learning, is mandatory pursuant to the National Defense Act and the 1987 Constitution, The traditional ROTC taining being offered to college 5 students shall be expanded {o include instructions/training to prepare them for civic welfare service and law enforcement service. Reservist Registry. - Pursuant to Section 48 of R.A. 7077, the Chief of Stal, AFP, shall furnish all city/municipal treasurers of chartered cities and municipalities of the list of all those who have successfully completed military training, indicating, therein, among others, their ranks, serial numbers, unit assignments and mobilization centers. Disposition of Graduates of the Advance ROTC. - Those who successfully complete the ROTC Advance Course shall be recommended for commission in the Reserve Force, AP, as Second Lieutenants and assigned to the reserve units and mobilization centers in their chosen residences. Those with manifest potential may be commissioned in the Regular Force as Second Lieutenants subject to the criteria for this rank in the Kegular Force. Those who fail to complete the course shall be conferred the enlisted rank of Sergeant or equivalent and similarly assigned to reserve units and mobilization centers. Probationary training as a requisite before commission in the Reserve Force, AEP shall be determined by the Major Service concerned and shall be based on the technical skills, experiences and qualifications of the applicants. Section 54, Nolification of Unit Assignment. - Graduates of the CCMT and ROTC basic and advance courses shall be notified in writing of their assignment to their respective reserve units and mobilization centers, ‘They shall be made to acknowledge receipt in writing of such notification, Section 55, Requisite for Promotion - Successful completion of ADT of not Jess than thirty (30) days in a given year, and completion of the non- resident instruction courses shall be among the requisites for re e officers secking their promotion to the next higher grade. Existing AEP rules and regulations on the promotion of reserve officers shall apply. Section 56. During the period of hospitalization, he shall be entitled to subsistence allowances and hospitalization benefits as are available to the members of the Regular Force who are patients in the ALP hospitals. - a. In the conduct of this task, they may seek the assistance of various reservist organizations and local government units.
