RESOLUTION

THIS RESOLVES the issue on the execution of a Leasehold Contract between Marlene G. Casana
represented by Harold Joel G. Casana and Francisco B. Salibay

The landholding subject of this resolution is an agricultural land owned by Marlene G. Casana
containing an area of 0.2300 hectare and is located at Poblacion now Diaz, SF, Surigao del Norte.

The parties assisted by the Municipal Agrarian Reform Program Office of Surigao City, in
accordance with RA 6657 and DAR AO No. 2 series of 2006, had forged a leasehold contract indicating
therein their agreement among others, to wit;

1. Field Investigation Report dated January 6, 2021


2. Agricultural Leasehold Contract dated June 15, 2021
3. Tax Declaration No. 2017-14-0001-00874

RA 3844 as amended by RA 6389- declared agricultural share tenancy as contrary to public


policy. Moreover, Sec. 4 of RA 6389 automatically converted share tenancy throughout the country into
agricultural leasehold relationship.

Attached herein is a copy of agricultural leasehold contract duly notarized by Atty. Jonalo Ace C.
Chua.
Based on the foregoing and after thorough examination of the attached document, hence, this
resolution.
WHEREFORE, foregoing premises considered, this Office RESOLVES to:

1) DIRECT the Legal Services Division to render free legal assistance to parties herein for the
confirmation of their leasehold contract;
2) FILE a petition for Confirmation of Leasehold Contract before the Department of Agrarian
Reform Adjudication Board;
