Above permission/approval is valid for FY 2022-23 till further orders. The above said sale permission is subject to the conditions mentioned in the Annexure — J of this letter and guidelines issued by this Department vide OM No. 2301 1/10/2014- MPR dated 29.12.2014, corrigendum No. 23011/10/2014-MPR dated 2.6.2016 & 11,8.2017, OM No. 23011/10/2014 dated 12.1.2018 and any subsequent guidelines to be issued by the Department under the NBS policy. The approval is further subject to the following conditions: i, Nutrient Based Subsidy shall be released to M/s RV Global Private Ltd, Jhagadia only after all the condi-ions mentioned in Annex-I are fulfilled ii, This sale and payment arrangement will be applicable where SSP produced by the manufacturer shall be sold by the above registered fertilizer company in the brand name of the manufacturer and payment of NBS is to be claimed by the manufacturer as per the agreement between the manufacturer and registered fertilizer company. 3. The company should ensure that cost data for every preceding fiscal year is submitted to Department of Fertilizers on or before 31st August of current fiscal year positively. Direct Benefit ‘Transfer (DBT) system has been introduced for fertilizer subsidy payments. Under the DBT system, 100% subsidy on various fertilizer grades is released to the fertilizer companies instead of the beneficiaries, on the basis of actual sales made by the retailers to the beneficiaries. Sale of all subsidised fertilizers to farmers/buyers is made through Point of Sale (PoS) devices installed at each retailer shop and the beneficiaries are identified through Aadhaar Card, KCC, Voter Identity Card ete ‘The name of the manufacturer and the Registered Fertilizer Company should be clearly printed on the bags of SSP in the manner required under the relevant provisions of FCO and as required under the NBS Policy. The names of the Registered Fertilizer Company and manufacturer printed on the bags shall preferably be of the same size. Each bag of SSP released in the market should contain the stamp ‘Quality Certified’ and manufacturer shall submit a certificate of quality of SSP produced by it. ‘The SSP manufacturer will be required to print Maximum Retail Price (MRP) along with applicable NBS on the fertilizer bags clearly under FCO. Any sale above the printed MRP. will be punishable under the 3C Act. ‘Along with each of the clains for NBS under this sale arrangement, the manufacturer shall submit a summary repert giving details of quantity sold during the relevant month, ‘cumulative quantity sold up to the relevant current month including the quantity sold for the current month and balancs quantity remaining to be sold under this sale arrangement. ‘The manufacturer shall also submit a summary report at the end of the financial year giving details of the total quantity sold and certifying that the registered fertilizer ‘company under this arrangement has neither claimed nor received any NBS on sales of SSP by the manufacturer under this sale arrangement. ‘The manufacturer should also certify that no NBS has been claimed for the quantities that remained unsold out of the total quantity allowed under this sale arrangement, ‘The manufacturer as well as the registered fertilizer company shall separately submit an Indemnity Bond in favour of Department of Fertilizers against any inadvertent NBS claimed/teceived by the manufacturer/tegistered fertilizer company on the quantity of SSP sold under this sale arrangement, ‘The manufacturer shall furnish an undertaking to Department of Fertilizers to the effect that in the event of SSP sold under this sale arrangement being declared sub-standard or is found contravention of any of the conditions laid down in FCO / NBS policy, jes will be made from the manufacturer and the decision of Department of 5 will be final. ‘The manufacturer shall furnish a certificate that the plant in which SSP has been ‘manufactured has a well-equipped laboratory which has also been certified by: the State Government. Only such quantity of SSP would be eligible for NBS, which has been covered under the quality inspection by the State Government and has been certified as per the criteria contained in the FCO through Proforma ‘B’ by the State Government. Ino (am) () () ©) case of any short supply or supply of sub-standard SSP, as identified by the State Government through Proforma ‘B” or by the Department of Fertilizers! Department of Agriculture and Cooperation, GOI through inspection, necessary recoveries would be effected from the manufacturer. In those cases, where NBS has been claimed on the basis of sale of sub-standard SSP and/or SSP has been produced by using non-qualified rock phosphate, recovery of the ‘amount involved would be made from the manufacturer along with a penal interest @ Prime Lending Rate (PLR sased on SBI rate) plus 3% of the amount involved. ‘This condition does not take away the right of the concemed State Government to take appropriate action including penal action against the SSP_manufacturer/registered fertilizer company for contravention of any of the provisions of the FCO, Department of Fertilizers shall monitor details of raw materials, production, dispatch and sales of SSP under the integiated Fertilizer Monitoring System (iFMS), as required under the NBS Policy. Manufactwer is required to provide requisite data under the FMS/m- FMS as per the Proforma prescribed for this purpose. ‘The manufacturer and the registered fertilizer company are required to submit to Department of Fertilizers a copy of their sale Agreement/MOU. However, none of the conditions of the said sale AgreemenMOU, in any manner whatsoever, shall be binding ‘on Department of Ferilizers and neither the manufacture nor the registered fertilizer company shall hold the Department responsible for any violation of the terms/provisions of their sale AgreemenMOU by either of them. All records maintained by the manufacturer and the registered fertilizer company in compliance of requirements of the NBS policy or the FCO, including transactions under this sale arrangement, shall be open for inspection/scrutiny by the officials of Department of Fertilizers or any inspection team authorized/appointed by Depariment of Fertilizers. ‘The SSP uni registered Fattlizer company are advised to strictly confirm to quality standards. Any violation would be dealt severely as per legal provisions.
