HAVING READ the documents filed of record, heard counsel and having considered
the matter –

IT IS ORDERED THAT:

1 The applicant's prayer 3 in the action proceedings instituted under case

number 6704/2019 which reads as follows, is abandoned:

2 Summary judgment is granted against the first respondent and the first

respondent is ordered to pay the applicant the sum of R 6 500 000.00 ( six

million five hundred thousand) together with interest on the aforesaid amount

at the rate of 10.25% per annum from 31 August 2019 to the date of final

payment, both days inclusive.

3 The first respondent is ordered to pay the costs of the application on an

attorney and client scale.
