STATE'S MOTION FOR PRE-TRIAL RULING ON ADMISSIBILITY OF


REBUTTAL EVIDENCE (SWASTIKAS AND HATE SPEECH SOCIAL
MEDIA) (SF-202)

The State of Florida, by and through the undersigned counsel, pursuant to

Florida Statute 90.402, Admissibility of Relevant Evidence, respectfully files the

instant Motion for a Pre-Trial Ruling on Admissibility of Evidence to rebut the

expected mental health mitigationevidence presentedby the Defendant. The State is

prepared to introduce evidence in cross-examination of defense witnesses and the

State's rebuttal supporting the State's experts' conclusions and diagnoses of Anti-

Social PersonalityDisorder, previous diagnosisof Conduct Disorder, and malingering.

The State's rebuttal evidence includes the Defendant's use in jail of an alternate

identityor voice he hears that he calls "Swas", which is short for "Swastika", his use

of the swastika symbol, evidence of racist ideology, animal abuse, Nazism, hate

and child pornography. Such


speech,misogyny, and internet searches for mass killings

evidence will include, but not be limited to, (1) a firearm magazine etched with

swastikas on each side of the magazine located in the AR-15 firearm used in the
