1. Why do employers need to offer benefits and services? (5pts)

 Benefits and services for employees play important roles in the culture of a company. For
employees, these provisions can create a sense of loyalty to the employer and indicate the
employer cares for their well-being. It's an added benefit vs paying higher salaries. The more an
employer can make an employee's life easier, happier, more secure, the longer a “good”
employee will stay with the company.

2. You are the HR consultant to a small business with about 50 employees develop a list of

other benefits you believe it should offer, along with your reasons for suggesting them.

 Advice on hiring and firing employees, salary advice for management and job clarifications for
each employee with a salary range, benefit plan analysis and training for staff, performance
review procedures and policy on raises, dispute resolution procedures and education in new
laws concerning employee rights. They need to have some security to take paid time off, the
health insurance including dental and vision, to know what is expected to them and also to
know the rules.

3. What conditions in the workplace are most likely to trigger the campaign to organize a

labor union? Why? (5pts)

 To ensuring fairness and equitable treatment labor union, many employers recognize that there
are advantages to offering workers better wages and benefits. Companies concerned about
long-term profitability want to maintain a supply of skilled labor and minimize turnover. The
basic reason for this is simple: if unions provide a voice to workers, the number of dissatisfied
workers who leave is reduced. Another valuable function of an organized workforce is that
workers are able to contribute their knowledge about the job, which helps increase productivity.
Belonging to a union gives you rights under the law that you do not have as an individual. Once
you have formed a union, your employer must bargain with your union over your wages,
benefits, hours and working conditions. Union workers, on average, earn higher wages and get
more benefits than workers who don’t have a voice on the job with a union.
4. Are you for or against in union? Justify your position. What can you say about weakening of labor
movement in the Philippines because of the growth of business process outsourcing? (10pts)

 Yes, it is better to have a union because if I were a union member I can earn better wages and
benefits than workers who aren’t union members and labor unions can give the workers the
power to negotiate for more favorable working conditions and other benefits through collective
bargaining. The Philippines was encompassing the difficulties faced by wage-earners and
employers who began to cut wages for various reasons including increased technology, desire
for lower costs or to stay in business and the wage-earning classes responded with strikes by
unionizing and by committing acts of outright violence.

5. When can you say that termination or dismissal of an employee is legal? Why do you

need to be careful in terminating an employee? What are the possible consequences of wrongful
discharge? (10pts)

 It’s when a person's employment is ended in accordance with the employment laws on the
national, state, and local levels. This means that the termination does not violate any labor and
civil rights laws, and the employer isn't being discriminatory in their reasoning. Sometimes, a
person will quit their job and terminate their employment themselves for personal or
professional reasons and it is because there is a justifiable reason behind the decision that does
not impinge upon the person's legal rights.

6. If you were the supervisor who is about to enforce discipline to one of your subordinates, how would
you go about it? What approach would you use? (10pts)

 As the supervisor, I should conduct a disciplinary meeting and take a steps to help prevent some
problems from occurring such as clearly communicating workplace rules and procedures so that
employees know exactly what is expected of them. After the meeting, follow up with the
employee and look for improvements in performance or behavior. If their performance has not
improved, further disciplinary action may be necessary. While delivering discipline is difficult for
any employer, an effective disciplinary process is necessary to ensure a fair and productive work
environment.

7. What are major causes of occupational injuries and death in the workplace? (5pts)

 The leading cause of workplace deaths was motor vehicle accidents. Roughly 40% of workplace
deaths occurred in transportation incidents. Other leading causes were fall/slips and trips,
deaths from being struck by objects or equipment, and exposure to harmful chemicals.
8. You have been named safety officer in your company. Outline the steps you would

follow in developing an effective safety management program for the company (15pts)

The critical elements of an effective safety management program are:

 Management commitment.
 Communication.
 Employee involvement.
 Worksite analysis.
 Hazard prevention and control.
 Training for employees, supervisors and managers.

9. Explain the promoting health and safety in the workplace (5pts)

 Health and safety promotion in the workplace is vital to the functioning and overall satisfaction
of staff. When employees are sick or injured and cannot work, other employees need to take on
the extra work. This can cause stress, which slows down productivity and hurts morale. For
employers, job-related injuries among employees cause production losses, an increase in
workers' compensation, possible damage to equipment or product, a potential increase in cost
for hiring and training new employees, and a decline in productivity and worker morale.
Promoting health and safety in the workplace makes it a safer and more pleasant place to work.
Employees can promote health and safety in the workplace by always wearing proper protective
equipment. Employees are less likely to forgo safety equipment when the rest of their
coworkers continue to wear theirs. Employees can also promote health and safety by knowing
their rights as workers and their rights for compensation and refusal to work. By educating
themselves on union labor codes and state laws, employees are better equipped to assess a
situation.
Case study

Sexual harassment in the office (15pts)

Anabel is a young woman worker in her early 20’s who works for Loyola’s trading, she is

single and very outgoing, and she is also smart and good looking. Sometimes her outgoing

ways are misunderstood by her office mates, especially by male coworkers.

One time, while, she was talking to Rodel, the manger she sat down on the edge of the

manager’s desk, and crossed her leg showing her smooth skin. Rodel without any malice

(according to him during the investigation) put his hands on the leg of Anabel and let it stay

there for some time. Anabel felt uncomfortable and she swore in the interview that she also felt

Rodel’s hand pressing and sliding, even as they kept on discussing some official matters.

Anabel also says she was embarrassed and did not want to offend the manager that

was why she did not attempt to remove his hand.

Anabel filed sexual harassment charges against Rodel.

1. If you were the head of HRD, how will you handle the case filed by Anabel?

 Quick action is key. I don’t pre-judge the situation or make an assumption of Anabel and I will
take every harassment complaint seriously, treat her as the complainant with both respect and
compassion. I don’t brush off her complaint or downplay it. Showing that I am open and
receptive to complaints encourages employees to come forward to me when she experiences
harassment at work. Start investigating the situation of the complainants. Whether or not the
employee is in danger, I immediate reporting of the allegation protects them and my
organization.

2. Who is at fault here, Anabel or Rodel? Explain your choices.

 In the case about, the fault was Rodel because when a woman crossing their legs does not mean
it is a tension that they showing off their sexy body or smooth skin just to get an attention to a
man, Rodel should not put his hand on the legs of Anabel and he is the manager so that he
would respect the women employees in a good way especially Anabel even she is having a good
looking.
