SEC 41A

1) Clause 1
i. Where the arrest of a person is not required under section 41
clause 1, and
ii. Against him a reasonable complaint or credible information or
reasonable suspicion exist that he has committed a cognizable
offence,
The police officer shall issue a notice to such person to appear
before him
2) Clause 2
i. When such a notice is issued to such person, he shall comply
with the terms of notice.
3) Clause 3
i. Where such person complies and continues to comply with
the terms of notice.
He shall not be arrested for the offence mentioned in the
notice.
ii. where the police officer is of opinion that he ought to be
arrested, and
iii. He has recorded his reasons for such arrest,
Such person may be arrested.
4) Where such person fails to comply with the terms of notice, or
he is an willing to identify himself,
The police officer may arrest him for the offence mentioned in the
notice,
Subject to any order which any competent court may have passed
in this behalf.
SEC 41B
Where a police officer is making an arrest,
a) He shall bear an accurate and visible identification of his name,
b) He shall Prepare a memorandum of arrest,
i. Which can be attested by at least one witness,
Who is family member of the arrested person, or a
respectable member of the locality where arrest is made
and
ii. Which shall be counter signed by the person arrested.
c) He shall inform the arrested person, that such person has a right
to inform about his arrest to his relative or friend by naming
them where memorandum is attested by his family member, the
police officer need not inform so.
SEC 41C
i. The state government established a police control room in every
district and state level.
SEC 41D
i. Where any person arrested, and
ii. The police interrogating him,
He shall be entitled to meet an advocate of his choice during the
interrogation, and
He Is not so entitled throughout the interrogation.
