Ethical codes for pharmas, EPFO, FMCG margins and moonlighting

The Federation of Medical & Sales Representatives Association of India, or FMRAI, has moved the
Supreme Court with a petition. It wants the apex court to direct the Centre to formulate a Uniform Code
of Pharmaceutical Marketing Practices to curb alleged unethical practices of pharma companies.
Against this backdrop, the Business Standard in its Morning show segment discusses why the Uniform
Code of Pharmaceutical Marketing Practices is still voluntary and not legally binding. Nishant Shah,
Partner at Economic Laws Practice (ELP) has been quoted by Business Standard. He says that under
the Prevention of Corruption Act, the question arises whether a medical practitioner can be viewed as a
public servant. If so, then it would attract undue gratification. He is of the opinion that the UCPMP
should be given a statutory status.
