Sanjeev soni both r/o 121 part 1 Priyadarshani Vihar, Dr Mukharjee Nagar, Model Town Delhi-110009 and accordingly meeting was taken place between accused persons and the complainant regarding one flat bearing number 124, 1" (First floor) Gagan Vihar East Delhi-110051 measuring Area 126.67 Sq.yds is suitable as per his budget and thereafter seen the said flat meeting was took place between the complainant and above stated accused persons and the on dated 7th day of may 2018, deal for the said floor/house was finalize ih Rs 1,27,00,000/-(One Crore Twenty seven lakhs) at House no 124, 1" (First floor) Gagan Vihar,East Delhi-110051 and finally after trusting and beliving the words of the above stated accused persons that they are the absolute owner of the said property and the said property is free from all sorts of encumbrances, burden, sale, gift, loan liensurety,security, mortgage (As agreed in the para no 4 of the Agrrement to sale) ), complainant has made the cash payment of Rs 10,51,000/- (Rs Ten Lakh Fifty (One thousand) and in this regard one agreement to sale was also made between the parties. persons to provide the original papers of the property as complainant has to apply for home loan but above stated accused persons taken a plea that they will provide the same within one week as the same is kept in their bank locker, even after passing the week complainant again made the call to accused person but again they had taken the plea that they need some time as there is some problem in his bank and thereafter again after passing of period complainant again requested the accused persons to provide the original papers but accused person stated making excuses one by one and also started avoiding the calls of the complainant. After passing of the period of 2 months, complainant got to know from his sources that the same flat is already been sold to another person namely Pawan Kumar on same day le 7/05/2018 and they had taken the bayana amount of Rs 10,00,000/-(Rs Ten Lakh Only) for the said flats from him too and in the same manner the accused person had cheated the complainant by impersonation and with ulterior motive and and dishonest intention to cheat the complainant in the tune of Rs 10,51,000/ (Rs Ten Lakh Fifty One thousand) and after Knowing the same fact complainant approached the accused person and ask them to return his money but the accused person assured the complainant the same money will b refunded to the complainant with in the period of six months Le December 2018, even after passing of the said period accused had taken the plea that they need some more time and complainant in a good faith given the further time of 6 months Le June 2019 but since thereafter complainant trying to trace the accused persons but complainant is shocked to know that the accused person has been shifted from their given addresses thus the accused persons had cheated the complainant with their malafide intention to cheat him with by designing their illegal Act of conspiracy.Request you to kindly register an FIR against the accused persons under Section 420/406/34 of Indian Penal Code and the relevant sections of IPC and take the necessary action against them as per Law of land.
