Standard Conditions:- A eae acee ey The qualified firm/company/institution will have empanelled by Category wise (mentioned in Eol document) in accordance with the UP Procurement Manual-2016 and will be offered for one product at one rate and high quality materials/inputs will be supplied according to the standards in the schemes and programs of the Horticulture Department. The Firm/company/institution must be agreeable to have the business transactions with HOFED strictly on back-to-back basis (ie. the payment to the Manufacturer/ Authorized Supplier against the supply will be released by HOFED only after getting payment from the buyer and after deducting the service charges of HOFED). The Firm/company/institution must be agreeable to fix the selling prices of its products strictly as per prevailing market rates and with the concurrence of HOFED. The Firm/company/institution agree to carry out marketing activities of the product from its own resources. ‘The Firm/company/institution should be in a position to supply the product under the brand name of "HOFED" wherever required. The formalities required to be fulfilled in this regard shall be at the expenses of the manufacturer. Territory of supply earmarked by HOFED must be agreed upon by the Firm/company/institution. The Firm/company/institution is responsible for all Central / State laws pertaining to the quality control, weight & measurement, etc. 10. 11 2. 23. 14, The Firm/company/institution is solely and wholly responsible for the quality of the products in terms of specified acts/standards/ as per requirement of the indenting organization and in case of any complaint inthis regard, the Firm/company/institution is absolutely responsible. Service charges payable to HOFED by the Firm/company/institution shall be determined in advance and revision/enhancement in service charges shall also be made as and when deemed fit, HOFED shall be authorized and empowered to empanel one or more Firm/company/institution for ‘any product/products, and the Firm/company/institution shall not have any right to object. The Firm/company/institution whose offer has been agreed upon by HOFED will have to compulsorily complete the following work within 15 days:- a) Execute an Agreement with HOFED. b) Deposit an amount of Rs 1.00 Lakh (Rupees One lakh) with HOFED as interest-free security deposit, which shall be returned to the depositor by HOFED on expiry/termination of the agreement and along with final settlement. HOFED reserves the right to terminate the agreement with the Firm/company/institution in case of breach of the terms and conditions of the agreement and/or any cause without assigning the reasons thereto. HOFED will not be bound to purchase any quantity of the product of the Producer/ Supplier/Authorised Distributor & Dealer merely by applying or getting empanelled against this expression of interest. {mn case of any dispute, the decision of the Managing Director, U.P. State Horticultural Cooperative Marketing Federation, Lucknow will be final and binding. Jurisdiction in legal matters will be Lucknow. ‘The Firm/company/institution who is interested to market their products through HOFED on the above detailed guidelines, may submit their offer in the prescribed application format, duly filled in and complete in all respects and enclosing the all required documents can be submitted by-post or by hand before the due date and time.
