DETAILED COST IN TRANSFERRING LAND TITLE

Requirements:

1. Deed of Absolute Sale

2. Certified true copy of title - (ROD)

3. Certified true copy of tax declaration


- 3copies
- in city or municipal assessor's office
- if the land is vacant or no improvements ( certificate of no improvement)

4. Tax identification number (TIN) of both the buyer and seller - and valid i.d.

other requirements:

*Special power of attorney - if the person who sign the document is not the registered
owner.

*Certificate of the Philippine Consulate - if the SPA is made in foreign countries.

*Location plan or vicinity map issued by the local assessor's office


- if the lot area cannot be determined based on the documents presented.

5. All other documents required.

STEP ONE (1)

BIR - revenue district office (RDO) - which has jurisdiction over the land

PAY: 1. Capital gains tax


2. Documentary stamp tax

- computed by the BIR


- paid on any Authorized Agent Bank

3. receipt shall be submitted to the BIR

STEP TWO (2)

1. Capital gains tax - 6% - Selling price (based on the deed of sale)


- Fair market value (seen on tax declaration)
- Zonal value (seen on BIR web site or on the BIR)
* Whichever is higher

2. Documentary stamp tax - 1.5% - Selling price


- Fair market value
- Zonal value

* Whichever is higher
AUTHORIZED AGENT BANK (AAB) requirements:

1. Fill up the forms for the payment of CGT/DST (BIR).

2. Show the forms to AAB accompanied by your payment.

3.Keep the receipt and the forms of the CGT/DST marked or sealed with
RECEIVED

STEP THREE (3)

- return to the BIR on the day of release of CALIM SLIP

with the following documents:

1. Certificate Authorizing Registration (CAR)

2. Original copy of the Deed of Absolute Sale with stamp or marked by the BIR.

3.Owner's Duplicate copy of the CTC or OCT

4.Original copies of the BIR form 1706 (CGT) and form 2000( DST) stamped received
by the BIR.

5. Copies of the Tax Declaration for land and improvements.

6. All other requirements.

* After compliance with the above stated requirements - BIR will issue CERTIFICATE
AUTHORIZING REGISTRATION.

STEP FOUR (4)

go to LGU treasurer's office and pay:

1. transfer tax - 0.5% - if the lot is situated in municipality


- 0.7% - if the lot is situated in the cities

basis:
a. contract price
b. fair market value
c. zonal value
* Whichever is higher

2. Tax clearance

certification fee
show:
a. photo copy of Deed of Sale

b. Tax declaration

c. official receipt of payment of real property tax and special education fund tax for the
current year.

STEP FIVE (5)

- go to registry of deeds:

1. fill-up application form

2. submit the following documents on the registry information officer (RIO):

a. Photo copy of valid I.D.

b. Original copy of the Deed of Sale

c. Original copy of Certificate Authorizing Registration

d. Owner's duplicate copy of CTC or OCT

e. Original copy of the Tax clearance

f. Original copy of tax clearance

g. Receipt of Transfer tax receipt

h. Certified true copy of tax declaration for land and improvement.

i. all other documents - 1. SPA and 2. Secretary certificate and Articles of


incorporation (corporation).

* Pay to the cashier all requirements for registration


* Follow up on the date given by the registry of deeds.
