Respected Sir,

Please refer to the captioned subject matter, the EPC Contractor hereby request the
Authority/Authority engineer to release our Performance Security which was Submitted as per
Clause 7.1.(A)(a) “5% of the Contract price” with terms and conditions as specified in the EPC
Agreement executed on 1st July, 2020 between the EPC Contractor and the Authority.

Though the contractor would like to state that the Authority Awarded the Project to the contractor
in the amidst of Covid-19 (Novelle Corona Virus) epidemic and the MoRTH issued an office
memorandum which is attached with this letter in the form of annexure which clearly states that the
performance security 5-10% to 3% of the value of the contract and later MoRTH reupdated the
office memorandum (attached) mentioning the time period till its active. The Project has sustained
several bandhs i.e., Local strikes. Despite that the EPC Contractor is executing the work due diligence
to complete the work within minimum time

So, at last the contractor asks the governing body to release the performance security of the
difference value as per the office memorandum of MoRTH.
