Ans. A was doing an unlawful act but he was not guilty of culpable homicide under section
299 of IPC, as he did not intend to kill C or to cause death by doing an act that he knew was
likely to cause death.

Q2. A is lawfully arrested by B, a police officer. A got excited by sudden and violent
arrest and kills B. Has A committed any offence?

Ans. The offence committed by A is murder under Section 300 of IPC. The provocation is
not sought or voluntarily provoked by the offender as an excuse for killing or doing harm to
any person and provocation is not given by anything done in obedience to the law or by a
public servant in the lawful exercise of the powers of such public servant.

Q3. “X” drives very fast through a crowded road to catch a flight, knowing that his
actions in all probability may cause death. “Y” is killed by his vehicle. Has “X”
committed any offence?

Ans. X has committed the offence of culpable homicide under section 299 of IPC as he
caused the death of Y by doing an act with the knowledge that he is likely by such act to
cause death.
