ELECTION PROTEST

PETITION

Petitioner thru counsel and unto this Honorable Court, respectfully alleges that:

1. He is a qualified voter and was one of the registered candidates voted for in the
local elections held on ______________ in ____________, Philippines, within the jurisdiction of
this court;

2. According to the certificate of canvass of the provincial board of canvassers for


_____________, the total number of votes for the said office was ________________,
respondent appearing to have received _______________, the petitioner _____________ votes
and the other registered candidates voted for, received the following votes:
____________________________;

3. On________, the board of canvassers of _____________ proclaimed the


respondent _________________, elected to the office

4. The petitioner contests the election of the said respondents on the following
grounds: (State the acts or omissions complained of)

5. Petitioner is willing to give a bond, as this Honorable Court may determine to


cover all reasonable expenses and costs and damages incidental to these proceedings.

WHEREFORE, it is respectfully prayed that:

(a) upon service of summons in accordance with law, a day be set for the hearing of
the protest;

(b) an order be issued to the________________, to bring and present before this


Honorable Court, on or before the day of the hearing of this protest, the ballot boxes, copies of
the registry lists, the election statements, the voter’s affidavits, and other documents used in the
said election, in order that this Honorable Court may re-examine and revise the same;

(c) after due proceedings, the election of the respondent for the office of
_______________, be annulled and that the petitioner be declared duly elected instead;

(d) the expenses and costs incurred in these proceedings be assessed against the
respondent.
