Alicia Dexson, during 2014 FHM 100 Sexiest Women, suffered

wardrobe malfunction making a full exposure of her breast. Manny Yak,
one of the audiences was videotaping her using his mobile phone. Alicia
requested Manny Yak to delete the video from his mobile phone. Manny
denied her request. Alicia filed a criminal report against Manny Yak for
violation of RA 9995. Do you think the case against Manny Yak will
prosper? Justify your answer.

Answer:
Yes, the case against Manny Yak will prosper because he was videotaping
Alicia Dexson’s wardrobe malfunction without her consent. Manny refusing to delete
the video is very disrespectful for Alicia’s end because it is her right to protect her
own privacy. According to the RA 9995, It is prohibited to take photo or video
coverage of a person or group of persons performing sexual act or any similar
activity or to capture an image of the private area of a person/s such as the naked
or undergarment clad genitals, public area, buttocks or female breast without the
consent of the person/s involved and under circumstances in which the person/s
has/have a reasonable expectation of privacy (“Anti-Photo and Video Voyeurism Act
of 2009). Manny Yak definitely violates this Act for refusing to take down the video.
