About the Moot Proposition

The Moot proposition highlights several fundamental issues about plight of a group of people
known as “Muslims” with regards to various themes such as citizenship, illegal migration and
laws passed by the government of Akhanda which are believed to be fairly unconstitutional,
denying them basic Human Rights.

Despite being a culturally rich nation where in the past many indigenous and tribal faiths
have survived the influence of major religions for centuries to come, is now believed to be
deporting close to 40000 individuals belonging to a group called “Rohingyas”. They have
been subjected to inhumane conditions because of which various Human Rights organisation
term them as the “"most persecuted community" in the world.

The state of Akhanda does not have national refugee protection mechanism in Akhanda, nor
is the country a party to the 1951 Refugee Convention or its 1967 Protocol. The state merely
accommodates refugees on humanitarian grounds and now believes that the illegal migrants
in question pose a threat to the national security of the country.

The proposition highlights the principle of "non-Refoulement,” and targets not only the
Applicable laws of the country like the CAA, 2019 but also involves various provision of
international laws governing the rights of Rohingyas with respect to violations of
Fundamental rights guaranteed under the Constitution of Akhanda.

Writ Petitions have been filed by individuals belonging to the community on the basis of
media reports, before the Hon’ble Supreme Court of Akhanda challenging the deportation of
Rohingyas, whether the principles of non-Refoulement have to be followed by Akhanda and
the validity of the Citizenship Amendment Act, 2019
