STATEMENT OF CLAIM

1. The Plaintiff is a Malaysian individual with I/C No. [ ] whose address is at [ ].

2. The Defendant is a Malaysian individual with I/C No. [ ] whose address is at nO. 15A, Jalan
bandar, 50510 Kuala Lumpur.
3. By a written contract dated 31.12.2015 (hereinafter referred to as “Contract”), the Plaintiff
agreed to sell to the Defendant a double-storey bungalow house at No.1, Jalan Pelakon, Kota
Damansara, 750000 Selangor on as is basis (hereinafter referred to as “Property”) for the
purchase price of RM 5,000,000.00.
4. It was, inter alia, the terms of the Contract that:
 The Sales and Purchase Agreement (SPA) is to be executed within 2 weeks from 31.12.2015.
 Defendant must pay 5% of the purchase price upon the signing of the Contract.
 A further payment of 5% of the purchase price upon the execution of the SPA.
 Time is of the essence.
5. The Plaintiff is willing and able to complete the sale of the Property.
6. In breach of the Contract:
 The Defendant did not sign the SPA within the stipulated time.
 The Defendant refused to proceed with the purchase of the Property.
 Due to the said breaches, the Plaintiff have suffered loss and damage and have been put
expense.
AND the Plaintiff claims:
 An order of specific performance to compel the Defendant to complete the Contract.
 Damages in addition to or in lieu of specific performance.
 Declaration that the deposit of 10% of the purchase price is rightfully forfeited if specific
performance is not granted.
 General damages.
 Interest.
 Cost.
 Any further and other relief which this Honourable Court deems fit and proper to grant.
