4
Judicial Affidavit of Dr. Jas Mirano
8. Q: Where is your clinic located?

A: My clinic is located at 2nd Floor

Martinez Building General Luna St.,
Davao City.

9. Q: As the witness of this case, under

what circumstances have you
acquired the facts by which now
you are testifying?

A: I acquired such facts by conducting

Collateral Interviews, Mental
Status Examination (MSE), as well
as the following psychological tests:
RAVEN’s PROGRESSIVE MATRICES
(RPM), EMOTION PROFILE INDEX
(EPI), and BASIC PERSONALITY
INVENTORY (BPI).

10. Q: What is a Collateral Interview?

A: Collateral interview is a formal

interview with the client’s contact
person to obtain additional
information or obtain information
when the client cannot be interviewed
or is not a reliable informant.

In this case, the personality

description of RON and HAZEL were
based on RON’s narrative, as well as
his mother’s narrative.

11. Q: Who is the mother of RON?

A: His mother is JESSY JACALNE

(JESSY for brevity)

12. Q: You mentioned earlier that you

conducted a collateral interview
in order to assess and examine
HAZEL. Why is that?

5
Judicial Affidavit of Dr. Jas Mirano
A: I conducted a collateral interview
instead because HAZEL was
unresponsive to my invitation that I
personally examine and assess her.

13. Q: Why was she unresponsive?

A: She is unresponsive because she is

currently under treatment for cancer.

14. Q: What were the facts you acquired

when you interviewed RON and
JESSY, if any?

A: RON was born in an unusual family

set-up. His parents had an unstable
relationship which resulted to their
separation. They stayed with their
mother and her live-in partner for a
while. Later, RON and his siblings
transferred to Agusan where their
father and stepmother were staying.
During their stay in Agusan, RON and
his siblings were not taken care of.
There were even times when their
father and stepmother would
physically abuse them. Because of
that, RON and his siblings constantly
transferred from one relative to
another. They ended up staying with
their grandparents in Sta. Cruz,
Davao del Sur. Thankfully, he was
able to get a scholarship in college.
However, he was not able to finish his
studies because he unexpectedly got
HAZEL pregnant and was eventually
married to her.

15. Q: How about the Mental Status

examination? What is it all about?

A: The Mental Status Examination (MSE)

is a component of all medical exams
and may be viewed as the
psychological equivalent of the
6
Judicial Affidavit of Dr. Jas Mirano
physical exam. The purpose is to
evaluate, quantitatively and
qualitatively, a range of mental
functions and behaviors at a specific
point in time. The MSE provides
important information for diagnosis
and for assessment of the disorder’s
course and response to treatment.
Information is gathered about the
patient’s behaviors, thinking, and
mood.

16. Q: What was the result of the MSE

you conducted to RON?

A: It showed that RON’s behavior was

bordering between confidence and
superiority. He was responsive to the
questions. During the interview, eye
contact and rapport were established.
Tone of voice, posture and gait were
normal. He was alert and oriented.
Responses were linear and goal
directed. No looseness of association.
Speech was generally normal/ Fund of
knowledge was estimated to be
average. At times, he was vindictive
and insists on his personal views. But
he listens and is open to suggestions.

17. Q: Aside from Collateral Interview

and Mental Status Examination,
what were the other psychological
tests you conducted, if any?

A: I also conducted the following

psychological tests:

 Raven’s Progressive Matrices

(RPM)
 Emotion Profile Index (EPI)
 Basic Personality Inventory
(BPI).

18. Q: What is Raven’s Progressive

7
Judicial Affidavit of Dr. Jas Mirano
Matrices (RPM)?
A: RAVEN’s PROGRESSIVE MATRICES
(RPM) – is a nonverbal group test
typically used in educational settings.
It is the most common and popular
test administered to groups ranging
from 5-year-old to the elderly. It is
made of 60 multiple choice questions,
listed in order of difficulty. This format
is designed to measure the test-
taker’s reasoning ability, the
educative (“meaning-making”)
component of Spearman’s g.

19. Q: What was the result of the RPM

you conducted to RON?
A: Based on the RPM, the result is as
follows:

RAW SCORE PERCENTILE (50%) LEVEL

35 50 AVERAGE

20. Q: Please help us understand. What

does the above table mean?

A: It means that RON has the superior

intellectual capacity to perceive and
reason by analogy the relationship
between abstract figures and forms.

21. Q: What do you mean by Emotion

Profile Index (EPI)?

A: EMOTION PROFILE INDEX (EPI) –

this test is composed of 9 clinical
scales which assess the major
personality tendencies of a person.
When used in the clinical setting, this
test can detect pathological
indications of personality disorders or
malfunctions. EPI corroborates with
the findings of MMPI.

22. Q: What was the result of the EPI?

8
Judicial Affidavit of Dr. Jas Mirano
A: Based on the EPI, the result is as
follows:

DIMENSION RAW SCORE PERCENTILE RANGE

Trustful 7 5 LOW
Dyscontrol 17 86 HIGH
Timid 20 84 HIGH
Depressed 6 54 AVERAGE
Distrustful 10 50 AVERAGE
Control 29 27 LOW
Aggressive 11 63 HIGH
Gregarious 4 4 LOW

23. Q: According to the above table,

RON’s “Trustful” is at LOW LEVEL
while his “Distrustful” level is
AVERAGE. What does it mean?

A: It means that RON tends to be

unaccepting, distrustful, disobedient
and not very gullible. He does not
take things at face value.

24. Q: What about RON’s “Control” that

is at LOW level while his
“Dyscontrol” is at HIGH level?

A: It shows that RON tends to be

impulsive. He likes to try new things
and experiences. He likes surprises.
He might also be described as
adventurous or curious.

RON tends to live his life on a day-to-

day basis. He does not plan for the
future. He tends to be disorganized in
his thinking and his activities. He has
very little need for orderliness, and he
tends to have self-control.

25. Q: RON’s “Timid” level is HIGH while

his “Depressed” level is AVERAGE.
Kindly explain what does this
mean.
A: That means RON tends to be

9
Judicial Affidavit of Dr. Jas Mirano
cautious, careful, and anxious. He
worries about getting into trouble. He
also worries about what people think
of him and say about him.

26. Q: What about RON’s “Aggressive”

that is at HIGH level, Doc?

A: This means that RON tends to be

quarrelsome and aggressive, he tends
to say whatever is on his mind, and
he has a lot of anger and express it
overtly.

27. Q: What about RON’s “Gregarious”

that is at LOW level?

A: It shows that RON tends to be

unsociable, unfriendly, unaffectionate
and introverted. He tends to be
isolated and withdrawn.

28. Q: What is your conclusion on RON’S

EPI result?

A: The result shows that he is a

combination of Low gregarious + High
Dyscontrol.

29. Q: What does that mean?

A: It means that a person with this

combination seeks adventures and
novelty through things rather than
through people that is, by doing
dangerous things and taking risks.

30. Q: What are some examples of this

kind of combination?

A: For example, such person may enjoy

car racing, mountain climbing, among
others.
31. Q: What does a combination of Low
Gregarious + High Dysfunctional
10
Judicial Affidavit of Dr. Jas Mirano
suggest?

A: It suggests that there is a possibility

of impaired identification mechanism.

32. Q: What does Basic Personality

Inventory mean?

A: BASIC PERSONALITY INVENTORY

(BPI) – this test is an innovative,
multiphasic personality assessment
intended for use with clinical and
normal populations to identify sources
of maladjustment and personal
strengths. The BPI can be used with
both adolescents and adults, and is
completed in half the time of other
measures.

33. Q: What was the result of RON’S

BPI?

A: The BPI test result is as follows:

SCALE RAW T DESCRIPTION

SCOR SCORE
E
Hypochondriasis 3 47 AVERAGE
Depression 5 57 AVERAGE
Denial 10 57 AVERAGE
Interpersonal 4 39 LOW
Problems
Alienation 2 43 AVERAGE
Persecutory 2 44 AVERAGE
Ideas
Anxiety 4 45 AVERAGE
Thinking 1 43 AVERAGE
Disorder
Impulse 7 55 AVERAGE
Expressions
Social 13 72 HIGH
Introversion
Self- 5 66 HIGH
Depreciation
Deviation 2 51 AVERAGE

11
Judicial Affidavit of Dr. Jas Mirano
34. Q: Kindly briefly explain to us the
interpretation of the above table.

A: The above table represents that RON

avoids people generally. He has few
friends and does not say much even
to them. He seems to be
uncomfortable when around others.
He also prefers asocial activities.

35. Q: What else, if any?

A: Considering his BPI test result, RON

also degrades himself as being
worthless, unpleasant, and deserving.
He generally expresses a low opinion
of self and refuses credit for any
accomplishment

36. Q: What is the final diagnosis of the

RON’S psychological examination?

A: In sum, my diagnostic impression

with regard to RON is that he has a
NARCISSTIC PERSONALITY
DISORDER.

37. Q: Why did you reach such

conclusion?

A: I reached such conclusion because the

integration of RPM, EPI, and BPI test
results shows that he has high level of
aggression and difficulty in adjusting
to people. He takes pride of his
achievements and always wanted to
be the center of attention without
consideration of the feelings of other
people. He has the tendency to put on
a mask instead of revealing his true
personality which makes it
challenging for him to maintain a
relationship.

12
Judicial Affidavit of Dr. Jas Mirano
38. Q: What else is your basis for such
diagnosis, if there is?

A: The Diagnostic and Statistical Manual

(DSM 5) of the American Psychiatric
Association Published in 2015. RON
has satisfied almost all the criteria for
NARCISSISTIC PERSONALITY
DISORDER 301.81 (F60.81).

39. Q: What are these factors that

resulted to his personality
disorder, Doc?

A: RON’s personality disorder was the

result of the different circumstances
specifically when he was growing up
He was feeling insecure because of
the abandonment. As a coping
mechanism, he projects as someone
who is confident and superior.

40. Q: How did the abandonment

contribute to RON’s personality
disorder?

A: It was explained by Dr. Heinz Kohut

(1989) that narcissism is developed
because of lack of parental empathy
and feedback from both parents. In
the case of RON, the family set-up
and environment have not developed
him to be a well-rounded person. He
was not given appropriate feedback
about his behaviour which results to
RON’s NARCISSISTIC
PERSONALITY DISORDER. Worse,
RON’s condition is considered grave
enough to bring disability to perform
the obligations of marriage.

41. Q: What behaviors do a person with

NARCISSISTIC PERSONALITY
DISORDER usually show?

13
Judicial Affidavit of Dr. Jas Mirano
A: A person with NARCISSISTIC
PERSONALITY DISORDER, like the
RON, may show the following
behaviours:

 Grandiose sense of self-

importance;
 Preoccupied with fantasies
of unlimited success,
power, brilliance, beauty, or
ideal love;
 Believes he is special and
unique and can only be
understood by, or should
associate with, other special
or high-status people;
 Requires excessive
admiration;
 Sense of entitlement;
 Interpersonally exploitative;
 Lacks empathy: unwilling to
recognize or identify with
the feelings and needs of
others;
 Often envious of others
believes that others are
envious of him/her; and
 Shows arrogant, haughty
behaviours or attitudes.

42. Q: When did RON’S NARCISSITC

PERSONALITY DISORDER
showed?

A: RON’s NARCISSISTIC PERSONALITY

DISORDER was present even before
he married HAZEL.

43. Q: Why is his condition considered

grave that it brings disability to
perform the obligations of
marriage?

A: This is due to his unstable emotion,

14
Judicial Affidavit of Dr. Jas Mirano
impulsivity, and becoming aggressive.
As a result, family environment may
not be healthy. To add, RON’s abusive
nature may create more problems to
the family. Clearly, he does not have
the qualities that will maintain a long-
lasting intimate relationship. Take
note that his personality disorder is
incurable.

44. Q: Please explain to us why is it

incurable.

A: The US National Library of Medicine’

PubMed Health explains that
Personality Disorders are challenging
disorders when it comes to treatment
because most people with this
disorder does not voluntarily submit
for treatment.

45. Q: Why do they not voluntarily

submit for treatment?

A: A narcissist would usually attribute

the problem to other people and they
always fail to see the self as the main
problem. Even if they submit to
treatment, the failure rate is high.

46. Q: Why is the failure rate high?

A: It is high since this disorder is already

integrated in his personality, the
success rate in therapy is considered
low-incurable in other words. Full
recovery is almost impossible;
therefore, they may never again
engage in a relationship successfully.

47. Q: You mentioned earlier that HAZEL

was unresponsive to your
invitation. How many times did
you contact her?

15
Judicial Affidavit of Dr. Jas Mirano
A: I called her three to four times.

48. Q: You also mentioned earlier that

she is currently under treatment
for cancer. How were you able to
know this fact?

A: I knew that HAZEL is currently under

treatment for cancer because that
was disclosed to me by RON’s mother,
JESSY, during one of my interviews
with her.

49. Q: What were the facts about HAZEL

that you have acquired when you
interviewed RON and JESSY, if
any?

A: Based on the Collateral Interviews,

HAZEL grew up in a broken family.
Her parents separated at a young
age. When her parents separated, her
mother had a live-in partner. She
served as the figure of authority in
her family because her mother
decided to work in Manila.

50. Q: Based on your collateral

interview, when did RON and
HAZEL meet?

A: They met sometime in April to May

2000.

51. Q: How did they meet?

A: They were introduced to each other

when they both participated in the
mountain climbing organized for the
varsities, scholars and employees of
Holy Cross of Davao City.

52. Q: What happened next, if any?

16
Judicial Affidavit of Dr. Jas Mirano
A: After that, they would frequently see
each other at school.

53. Q: Why would they frequently see

each other at school?

A: They would frequently see each other

at school because RON was a scholar
and varsity player, while HAZEL was
working as a secretary.

54. Q: What happened next, if any?

A: For a short period, RON got HAZEL

pregnant.

55. Q: What did RON and HAZEL do when

City.

57. Q: When did they get married?

A: They got married on June 3, 2002.

58. Q: Why did they decide to get

married immediately?

A: They decided to get married right

away because HAZEL was working in
a Catholic School where they were
encouraged to get married when they
were already pregnant.

59. Q: What happens if HAZEL does not

comply?

A: If they do not comply, there is a

17
Judicial Affidavit of Dr. Jas Mirano
possibility that she might lose her job.

60. Q: What happened during their

marriage?

A: They have two children together. But

despite that, their relationship
deteriorated.

61. Q: Why did their marriage

deteriorate?

A: Their marriage deteriorated because

they always argued.

62. Q: What is the cause of their

constant arguments?

A: They argued because of jealousy and

lack of support.

63. Q: What was the cause of this

jealousy and lack of support?

A: HAZEL was adamant that RON might

find another girl if he continues to join
his mountaineering group. Hence, he
forbade RON to join any climbing
events.

64. Q: You mentioned earlier that they

have two children. Who are the
children of RON and HAZEL?

A: Their eldest is Justin Gawat who was

born on January 6, 2003. Their
second child is Samatha Gawat who
was born on October 19, 2004.

65. Q: Who was supporting their family

financially that time?

A: HAZEL was supporting their family

financially. She even pays for RON’s
college education.
18
Judicial Affidavit of Dr. Jas Mirano
66. Q: Why was she paying the college
education of RON?

A: RON lost his scholarship when HAZEL

got pregnant. Since HAZEL has a
stable income, she helps RON with
his tuition fees.

67. Q: What was the contribution of RON

to the family that time?

A: RON would sometimes contribute

financially whenever he has extra
money from his salary.

68. Q: Where was RON working during

that time?

A: He was working at HABAGAT

OUTDOOR SHOP (HABAGAT for
brevity).

69. Q: What significant events happened

when RON was working at
HABAGAT, if any?

A: RON had an affair with another

woman when he was working at
HAGBAGAT.

70. Q: What was the work of the woman

RON had an affair with while he
was working at HABAGAT?

A: She was a supervisor.

71. Q: Where does she work?

A: She works at RUDY PROJECT.

72. Q: What did HAZEL do about RON’s

affair, if any?

A: HAZEL went to RUDY PROJECT where

19
Judicial Affidavit of Dr. Jas Mirano
the woman whom RON had an affair
with works.

73. Q: What did HAZEL do when she met

RON’s paramour?

A: HAZEL confronted her.

74. Q: What happened next, if any?

A: RON’s paramour left him for good.

75. Q: Why did RON’s paramour left

him?

A: She left RON because of the

embarrassment HAZEL caused when
she confronted the former in her
workplace.

76. Q: How did that affair affect RON and

HAZEL’s marriage?

A: HAZEL became more jealous which

caused their arguments.

77. Q0: What significant events happened

after that affair, if any?

A: RON also attempted to harass the

“Yaya” of their children.

78. Q: Why did RON attempt to harass

the “Yaya” of their children?

A: RON merely told me that he cannot

understand why he attempted to
harass the yaya of their children.

79. Q: What happened next, if any?

A: The “Yaya” reported the incident

immediately to HAZEL.

20
Judicial Affidavit of Dr. Jas Mirano
80. Q: What was the reaction of HAZEL
when she learned such fact?

A: HAZEL became more furious.

81. Q: How about RON? What was his

reaction?

A: RON hurt HAZEL physically which

resulted to the swelling of her arms.

82. Q: What happened next, if any?

A: RON and HAZEL decided to fix their

relationship. Their relationship was
peaceful in the beginning until RON
committed another affair.

83. Q: What did HAZEL do when she

learned about this affair, if any?

A: She confronted RON’s paramour

again, but she got tired.

84. Q: What made HAZEL tired of their

relationship?

A: HAZEL got tired because she started

becoming cold. She would come home
late. There was also a time when RON
saw HAZEL coming out of a motel.

85. Q: What did RON do when he saw

HAZEL coming out of a motel?

A: RON became jealous, doubtful and

suspicious of HAZEL’s faithfulness.
This time, they changed roles. RON
was the one who was jealous and
suspicious. This made him feel
insecure and guarded her most of the
time at school.

86. Q: What happened next, if any?

21
Judicial Affidavit of Dr. Jas Mirano
A: RON left for Manila to work.

87. Q: How long was RON staying in

Manila?

A: He stayed there for a couple of

months, then left again.

88. Q: Why did RON leave Manila?

A: RON left Manila because he learned

that HAZEL was always seen with her
boss whom she was having an affair
with.

89. Q: What did RON do when he came

back to Davao?

A: RON waited for HAZEL in a corner

road in Tibungco. When they arrived,
RON saw HAZEL hugging and kissing
her boss inside the car.

90. Q: What was RON’s reaction when he

saw HAZEL kissing and hugging
her boss?

A: RON punched the windshield of the

car, but they sped up and left right
away.

91. Q: What did RON do after, if any?

A: He waited for HAZEL in their house.

When she arrives, RON confronted
her.

92. Q: What did RON DO WHEN HAZEL

arrived?

A: RON confronted HAZEL, but HAZEL

denied RON’s allegations.

22
Judicial Affidavit of Dr. Jas Mirano
93. Q: What did JERSON do next, if any?

A: He left their house for good out of

fear that he might physically hurt
HAZEL AGAIN.

94. Q: What happened to their children

when RON left?

A: Their children stayed with HAZEL.

RON would occasionally visit them.
However, when HAZEL left the
Philippines to work as an Overseas
Filipino Worker (OFW), she left their
children to her mother’s house.

95. Q: Why were they left in HAZEL’s

mother’s house instead of leaving
them to RON?

A: HAZEL did not leave her children to

RON because RON was not financially
stable that time.

96. Q: Where is HAZEL staying now?

A: In the last interview I had with RON’s

mother, JESSY, she said that she
personally saw HAZEL carrying a child
with Arabic features during the wake
of one of her relatives.

97. Q: What was the reaction of JESSY,

when she saw HAZEL carrying a
child with Arabic features?

A: Out of curiosity, she asked one of

HAZEL’s relatives if the child she was
carrying was her own child. HAZEL’s
relative confirmed that the child she
was carrying was indeed her own
child.

98. Q: What other facts have you

23
Judicial Affidavit of Dr. Jas Mirano
acquired during your collateral
interview?

A: It has also come into my attention

that HAZEL is sick. She has cancer
and is currently under treatment.

99. Q: What is your final diagnosis of the

HAZEL’s psychological
examination which facts are
based on collateral interviews?

A: My diagnostic impression on HAZEL is

that she has satisfied almost all
criteria for BORDERLINE
PERSONALITY DISORDER 301.83
(F60.3) from Diagnostic and
Statistical Manual (DSM 5) of the
American Psychiatric Association
Published in 2015.

100. Q: What does that mean?

A: It means that there is a pervasive

pattern of instability of personal
relationships, self-image, and affects,
and marked impulsivity, beginning by
early adulthood and present in a
variety of contexts. This is incurable.

101. Q: Why is it incurable?

A: As mentioned earlier, The US National

Library of Medicine’ PubMed Health
explains that Personality Disorders
are challenging disorders when it
comes to treatment because most
people with this disorder does not
voluntarily submit for treatment.

102. Q: Why do they not voluntarily

submit for treatment?

A: A person with BORDERLINE

24
Judicial Affidavit of Dr. Jas Mirano
PERSONALITY DISORDER such as
SANDRA will always have unstable
self-concept and emotionality/ This is
the main struggle of therapists in the
treatment process. In HAZEL and
RON’s case. There were many
attempts to save their marriage but it
all failed.

103. Q: What behaviors does a person

with BORDERLINE PERSONALITY
DISORDER usually show?

A: A person with BORDERLINE

PERSONALITY DISORDER, like the
HAZEL, may show the following
behaviors:

 Frantic effort to avoid real or

imagined abandonment;
 A pattern of unstable and
intensive interpersonal
relationships characterized by
alternating between extremes of
idealization and devaluation;
 Identity disturbance: markedly
and persistently unstable self-
image or sense of the self;
 Impulsivity in at least two (2)
areas that are potentially self-
damaging such as sex,
substance abuse, reckless
driving or binge eating;
 Recurrent suicidal behavior,
gestures or threats, or self-
mutilating behaviors;
 Affective instability due to
marked reactivity of mood;
 Chronic feeling of emptiness;
 Inappropriate, intense anger or
difficulty controlling anger; and
 Transient, stress-related
paranoid ideation or severe
dissociative symptoms.
104. Q: What may have been the cause of

25
Judicial Affidavit of Dr. Jas Mirano
HAZEL’s BORDERLINE
PERSONALITY DISORDER?

A: The cause of HAZEL’s BORDERLINE

PERSONALITY DISORDER originates
from the emotional vacuum and
insecure attachment she has to her
mother. This has contributed for her
to search for attention and care from
other people which greatly affected
her self-concept.

105. Q: What were the effects of HAZEL’s

condition to her marriage, if any?

A: HAZEL’s condition shows that she will

have a difficulty maintaining a
married life since she has the
tendency to be carried away by her
emotions especially if her emotions
are not met.

106. Q: What happens if her emotions are

not met, if any?

A: If her emotions are not met, she is

tempted to look for security from
someone else. Hence, she ended up
having an extra-marital affair.

107. Q: How do the conditions of RON and

HAZEL affect their marriage?

A: The conditions of RON and HAZEL

were considered grave enough to
bring disability to perform the
obligations of their marriage. Hence, a
family environment for both of them
may not be healthy.

108. Q: Why is a family environment

where both RON and HAZEL are
present considered not healthy?

A: RON and HAZEL’s abusive nature may

Judicial Affidavit of Dr. Jas Mirano
create more problems to the family.
Both parties may suffer. Their
marriage may cause discomfort and
affect their well-being, productivity
and capacity for personal growth.
Hence, they do not have the qualities
that will maintain a long-lasting
intimate relationship.

109. Q: What is your recommendation as

to the marriage of RON and
HAZEL?

A: In view of both RON and HAZEL’s

psychological incapacity to comply
with the essential marital obligations
as embraced in Article 36 of the
Family Code of the Philippines, it is
therefore recommended that RON be
entitled to declaration of nullity of his
marriage to HAZEL for reasons
previously discussed.

110. Q: Who prepared a Psychological

Report with regard to the
Psychological Evaluation that you
conducted with the parties, doc?

A: I did. Here is the copy of the

Psychiatric Report, dated May 24,
2021, that I personally prepared and
which has my signature that can be
found on the last page.
