“GENDER JUSTICE IS A HUMAN RIGHT, NOT A FEMALE RIGHT”

POSH ACT (Protection of Women from Sexual Harassement, Act 2013) this Act has been
implemented to prevent women at the workplace and thereby ensuring a safe working
enviroment for the women. Sexual Harrasement voilates the fundamental rights of women of
right to Equality under Article 14 and Article 15 of the Constitution Of India and which also
violates the Right to life under Article 21 to live with Personal Dignity and It degrads the
confidence of the women to trade and to do Occupation which also includes Right to Safe
Environment free from Sexual harrasment. The POSH Act was passed by the Ministry Of
Women and Child Welfare. POSH Provisions are applicable to Organizations, Companies
employing 10 or more employees. But only a woman can file a complaint, the POSH Act is not
GENDER NEUTRAL.
The main Question is that why everybody talks about women facing Sexual Harrasement but
nobody focus on that Men’s are also being Sexually Harrased….WHY?
When we think about Sexual Harrasment the first thing that comes to our mind is that it only
happens to Women. We don't have much information about that on the internet because the
citizens of our country still can't believe that such a thing can happen to a Men also. Sometimes a
Man or a Boy infact can be Sexually Assaulted by women but no one believes that a Man can be
assaluted by a Women.
The accurate answer to the Question”Are Men and Boys also Raped and Sexually Harrasment as
the Women or not?” still remains unanswered as there is not much information gathered to
answer anywhere surely.Even though Women are more prone to Sexual Assault than men, but
the fact cannot be neglected that Men and Boys are assaulted . They should also get equal
oppurtunity to report the assual and to get justice because Sexual Assault is a Gender Neutral
crime and no one should face discrimnation on the basis of Gender under Article 15(1) of the
Constitution of India.
