AFFIDAVIT OF DESISTANCE

I, LEAH LAAG, of legal age, single, Filipino and a resident of Brgy. Sta. Cruz, Liloan,
Cebu, after having been sworn in accordance with law do hereby depose and state
that:

1) I am the private complainant in Criminal Case No. 2004-05-330, against accused

KYLE TALISIC, JURDAN DURANO, and MYJEL PANTALITA, now pending pre-trial
at RTC 06, Cebu City;

2) That after deliberate thought and examination of the whole facts and
circumstances surrounding the incident subject of my complaint, i am now fully
convinced that the same arose only from misunderstanding between the accused
and the victim;

3) That side from that, i cannot anymore contact the lone eyewitness to the incident,
PAMELA GEREBESE I despite earnest efforts;

4) That in view thereof, I am now desisting in prosecuting my complaint, hence, i can

no longer act and appear as the private complainant;

5) That I executed this instrument freely and voluntarily, without any consideration,
promise or reward of whatsoever in exchange for my desistance but solely for the
reason as above-mentioned;

6) That I executed this Affidavit of Desistance with full knowledge of its

consequences, that the said case can be dismissed at this stage;

7) That I attest to the truthfulness of the foregoing.
