1. A and B Lease agreement.

A (Leasor), B(Leasee)- Oral Contract of Lease for 2 years (Monthly


rental of 2, 000). After 1 year, A demands increase due to inflation. B do not want. A brought an
ejectment case.
a. Can B testify for oral contract- Not included in the Statute of Frauds. The contract is no
longer executory. Partially executed. The SF is only applicable to executory. There is already
partial execution (1 Year)
2. C entrusted to her nephew R. R though fraud and misrepresentation (Deed of Sale not
mortgage). C died without receiving any consideration. What is the status contract.
a. Void contract- Element of consideration is absent.
3. A (buyer) and B (seller)- Delivery of parcel of land on Dec 1, 2021. Buyer went to pay the land
but Seller do not want to convey.
a. Can A be B for specific performance? No. Real property requires it to be written. This is
unenforceable contract.
b. What is the defense of B? Statute of Frauds
c. Will it prosper? The contract is identified as one of the contracts that needs to be in written.

4. P accused A of estafa. Later P agreed for dismissal for settlement that A will pay the amount. P
made a note. A did not pay.
Is the defense of A (promissory note) tenable?
No, A is wrong. The promissory note is not a void contract. It is a valid contract.
