DEED OF CONDITIONAL SALE OF MOTOR VEHICLE WITH

ASSUMPTION OF MORTGAGE

KNOW ALL MEN BY THESE PRESENTS:

This AGREEMENT made and executed by and between:

JESSIE OTERO ABRIGANA, Filipino, of legal age, and a resident of

P2, South Poblacion, Maramag, Bukidnon, hereinafter called the
VENDOR

-and-

CHRISTOPHER JIMENEZ RAMOS, Filipino, of legal age, and a

resident R2-18, Smart Condominium, Fr. Masterson Avenue, District 8,
Upper Canitoan, Cagayan de Oro City, hereinafter called the
VENDEE;

WITNESSETH:

That, FOR AND IN CONSIDERATION OF THE SUM OF One

Million Eight Hundred Eighty Eight Thousand Philippine currency
(Php 1,888,000.00), wherein the amount of Ninety Three Thousand
Philippine currency (Php93,000.00) as down payment, and the
remaining balance shall be paid monthly including its interest
starting on the 10th day of October 2022 until 10th day of October
2027 thru cash/postdated checks in the amount of Thirty Eight
Thousand Two Hundred Sixty Five Philippine Currency (Php38,
265.00), are hereby acknowledge from the VENDEE, by and to
the partial satisfaction of the VENDOR, said VENDOR HEREBY
SELLS, TRANSFERS and CONVEYS unto the VENDEE the
motor vehicle described as follows:

That, the cash down payment of Ninety Three Thousand

Philippine currency (Php93,000.00) as stated above covers one (1)
year insurance while the succeeding annual insurance renewal
shall be for the account of the VENDEE;

That, the VENDEE shall bear the yearly registration costs

beginning after the expiration of 3-year free LTO registration. The
month of registration is subject for identification depending on the
plate number;

That the VENDOR hereby warrants that the said motor

vehicle is still under mortgaged with EASTWEST BANK;

That the VENDEE agreed to pay the remaining balance

which shall be paid monthly in cash every 10th day of the month
in favor of the VENDOR, to cover the monthly a m o r t i z a t i o n
amounting to Thirty Eight Thousand Two Hundred Sixty Five
Philippine Currency (Php38, 265.00) starting on the 10th day of
October 2022 to 10th day of October 2027;
 That in the event that the VENDEE failed to pay the
amortization for three (3) consecutive months, the total
outstanding balance, inclusive of penalties, shall be due and
demandable.

That the VENDOR shall retain the title of the vehicle sold until
the full payment of the agreed price is paid. Once fully paid, a deed of
absolute sale shall be issued between the VENDOR and the VENDEE.

          IN WITNESS WHEREOF, we have hereunto affixed our hands

this ____ day of _________, 2022 at Cagayan de Oro City, Philippines.

 Said instrument refers to the Deed of Conditional Sale of Motor

Vehicle with Assumption of Mortgage consisting of two (2) pages,
including this page of Acknowledgment, signed by the parties
