I, XXXX, S/o. Selvaraj, aged 31 years, Branch Manager at Tamilnadu Grama

Bank, Seyur Branch, office at D. No. 90, 1st floor, Raja street, Seyur, Avinashi
Taluk, Tirupur District do hereby state and declare oath as follows:-

1. I am the petitioner herein / Plaintiff in the suit.

2. I have filed the above suit for Recovery of amount based on the account
statement maintained in the bank and for other relief against the Respondents.

3. For the past more than 3 hearings, though I took much pain and proper
legal steps to serve summons and notice to 4th respondent / 4 defendant,
they had not received the same and purposely avoided to receive

the same for the reasons best known to them. Hence, it is essential for me to
serve summons and notices to 4th respondent / 4 defendant through the
available alternative remedy of serving summon and notices through any one of
the Tamil Daily News Paper to the area in which the 4th respondent / 4th
defendant is residing.

4. Unless and otherwise this Hon’ble court has passed an order to serve
summons and notices to 4th respondent / 4th defendant through a paper
publication in any one of Tamil Daily, I will be put to untold loss and hardships
and the delay in proceeding the a suit for further stage will be inevitable.

5. By serving the summon and notices to 4th respondent / 4th defendant

through a paper publication in any one of Tamil Daily, the 4th respondent / 4th
defendant is not going to be prejudiced. On the other hand refusal to pass an
order in my favour will cause irreparable loss to me and the same will not be
compensated by any money value.

It is therefore just and necessary that this Hon’ble Court may kindly be
pleased to pass an order to serve the summons and notices to 4th respondent /
4th defendant through a paper publication in any one of the Tamil Daily and
pass suitable orders.
