1. The result of the Combined Competitive Examination (Main) for the post of Deputy
Section Officer (State Secretariat), Deputy Section Officer (Gujarat Public Service
Commission), Deputy Section Officer (Vidhansabha) and Deputy Mamlatdar
(Revenue Department), Class-III (Advertisement No. 55/2018-19) held on 19-May-
2019 and 26-May-2019 is hereby declared as per Annexure‐I.
2. The above result is declared taking into consideration the provisions of the Deputy
Section Officer, Class-III & the Deputy Mamlatdar, Class-III (Combined Competitive
Examination) Rules, 2018 and amendments made thereafter from time to time and
other relevant applicable criteria.
3. As provided in the Deputy Section Officer, Class-III & the Deputy Mamlatdar, Class-
III (Combined Competitive Examination) Rules, 2018 and amendments made
thereafter from time to time,
(i) As per Rule-14(1) : the merit has been determined on the basis of the
aggregate marks (total marks) awarded to the candidates in the Main
Examination (i.e. 400 marks of written examination.
(ii) As per Rule 14(4) : No Waiting List is prepared by the Commission.
(iii) As per Rule 16 : the candidate, who fails to attend the main examination or
fails to attend any of the main examination papers shall not be eligible for
selection.
(iv) As per the Rule 15(2)(b) where a candidate has not given preference for
any post, or the candidate has given preference only for one post, and the
number of posts for which he has given preference are not available to
accommodate the candidate as per his preference, he shall be allotted to
any of the remaining Vacant posts after allocation of all the candidates to
the posts in accordance with their preferences.

4. (i) The Reserved Category Candidates (SC / ST / SEBC), who get either equal or
more than minimum marks fixed as qualifying standard for general candidates
and have not availed of any relaxation in age, qualifying standard etc. at any
point of the examination process (Meritorious reserved Category {MRC}
Candidates) have been selected against unreserved common posts as per their
preference in order of merit
(ii) The Reserved Category Candidates, though have secured their place in the
merit of general common category, but due to better preference available to
them, they are selected against the posts reserved for their respective
categories in accordance with the Judgement of the Honourable Supreme
Court in the case of Union of India versus Ramesh Ram and others (Civil
Appeal No. 4310-4311 of 2010) [Arising out of SLP(C) Nos. 13571-72 of 2008].
(iii) The Reserved Category candidates, who have though secured their place in the
merit of General common category, however, they are selected against the
posts of their respective categories as they have availed the benefit of
relaxation in age/ Cut-Off Marks in P.T. or Main Written Examination as per
Government circular, GAD No. PVS-1099-MM-13-G4 dated 29-1-2000 and
PVS-2010-03-900-G4, dated 23/07/2004.
(iv) With regard to women reservation, the result is prepared taking into
consideration the Government Notification GAD No. GS/97-13-
CRR/1096/2213/G-2, dated 9th April, 1997, GAD Circular No.
CRR/1096/2213/G-2, dated 22/05/1997, GAD Notification No.
GS/2014/37/CRR/1096/2213/G-2 (Part-I) dated 11/11/2014, Government
Notification No. GS/2012/12/CRR/1096/2213/G-2, dated 14/06/2012, and
GAD G.R. No. CRR/1096/2213/G-2, dated 01/08/2018,

(C) In case of equal marks, the merit was assigned taking into consideration the
date of birth (i.e. preference is given to the elder).
(D) The result is prepared following the ratio laid down by the following
Judgements of the Hon'ble Supreme Court:
(i) Rajesh Kumar Daria V/s. Rajasthan Public Service Commission, - Civil
Appeal Nos. 3132 of 2007, 3773 of 2007 decided on 18-07-2007.
(ii) Public Service Commission, Uttaranchal V/s. Mamta Bist & Others, - Civil
Appeal Nos. 5987 of 2007, with Civil Appeal No.5982 of 2007 decided on
03-06-2010.
(iii) Union of India V/s. Ramesh Ram and Others - Civil Appeal Nos. 4310,
4311 of 2010 [arising out of SLP(C) Nos.l3571-72 of 2008] decided on
07-05-2010.
6. The Reserved Category Candidates (SC / SEBC), who get either equal or more than
minimum marks fixed as qualifying standard for general common category
candidates, and have not availed of any relaxation in age, qualifying standard etc.
at any stage of examination were recommended against unreserved posts.

As per the Government Notification No. GAD G.R. No. CRR/1096/2213/G-2, dated
01/08/2018, the above stated 02 SEBC category Female candidates (MRC), are to
be recommended against Unreserved Common posts and have been counted
as SEBC category Female candidates.
7. The MRC candidates who have not availed any of the benefits / relaxations
available to a Reserved Category Candidate at any stage of the examination
process are considered as a Reserved Category Candidate, for they are getting
more preferred service / post while treated them as a Reserved Category
Candidate. Number of Category-wise RC (Having Better Preference) candidates

9. Four candidates with Physically Disabled status have been considered by relaxing
the Cut-Off Marks (Qualifying standard) of the respective categories by 10%.
10. (A) The result of the Petitioners who have availed interim relief in the peititon to
conditionaly appear for the main written examination is kept in the sealed
cover pursuant to the common oral order dt.02/04/2019 of the Hon’ble High
Court of Gujarat. Consequently, one post is kept vacant in the result.
(B) The Result of the 1 petitioner belongs to the Physically Disabled Category
who has availed interim relief in the peititon to appear for the main written
examination without condition to keep the result in sealed cover is declared
herewith.
11. The result is subject to the final decision of the Hon’ble High Court in SCA No.

12. The following details are relevant in respect of certain candidates who are treated
as ineligible for the examination for one reason or the other, the brief details of
which are given below:-

All the candidates who had applied online for the Preliminary Examination were
allowed to appear for the Preliminary Examination without any scrutiny of the
details given in the online applications. The candidates who were declared
successful in the Preliminary Examination and allowed to appear for the Main
Examination were asked to send the application forms for the Main Examination
along-with all the requisite / stipulated documents / certificates. Such candidates
were allowed to appear at the Main Examination subject to the verification of the
documents / certificates sent by them along-with the application forms for the
Main Examination.
(i) The candidates who have shown the details of sports in the online
application and not submitted sports certificate / sports details in the
prescribed format or in order were treated as candidates without sports
hence the 5% bonus marks of the obtained marks, granted to these
candidates being sports-person during preliminary test was required to be
deducted. While doing so, mark of those candidates went below the
minimum cut off marks prescribed for the respective category of
candidates to be eligible to appear for the Main Examination, such 7
candidates became ineligible to appear for the Main Examination and
therefore they are declared as unsuccessful in the Preliminary Examination
& become abinitio ineligible to appear for Main Examinaiton hence, the
candidature of the candidates for the Main Examination have been treated
as cancelled by the Commission. The Roll number of such candidates are :

(ii) The candidates who have shown their status as physically disabled
candidate and found not complied in application scrutiny are to be treated
as candidate without physical disablility. Hence benefit of 10% relaxed
standared of the Cut-off marks of the respective category granted to these
candidates during preliminary test was required to be cancelled. While
doing so, mark of those candidates went below the minimum cut off marks
prescribed for the respective category of candidates to be eligible to appear
for the Main Examination, such 4 candidates became ineligible to appear
for the Main Examination and therefore they are declared as unsuccessful
