The Domestic Administrative Adoption and
Alternative Child Care Act is the law creating
the National Authority for Child Care (NACC) in
pursuit of simpler and inexpensive domestic
administrative adoptions and streamlined
services for alternative child care.

SALIENT POINTS:
1. Transfer of Adoption proceedings from judicial to administrative &
reorganize the ICAB to NACC to implement the Domestic
Administrative Adoption and Alternative Child Care programs.

2. Adoption Telling is expressly stipulated in the law. This is premised on


the idea that the earlier adoption telling is done, the better its impact to
the child.

3. It is mandatory for social workers to conduct adoption-themed activities


to adopted children. Adoption telling is mandatory before the adoptee
reaches the age of 13 years old, to be disclosed by the parents
(adoptive parents).
SALIENT POINTS:
4. Inclusion of social media as means in locating the birthparents.

5. Process of Matching is expressly stipulated in the bill.

6. Database on Adoption will be maintained by the NACC to have a


general statistics of domestic adoption in the country.

7. The legal relationship created by adoption is extended to the PAPs’


relatives (PAPs’ parents, legitimate siblings and legitimate descendants)

8. Foreign Nationals who are permanent or habitual residents of the


Philippines for at least five (5) years may adopt.
SALIENT POINTS:
9. Requirement for Foundling children to be registered/issued with a Birth
Certificate of Persons with Unknown Parents prior to issuance of
CDCLAA.

10. For cases of Independent Placement (IP), the law covers only those
independently placed children before the effectivity of the Act

11. Mandatory appearance of PAPs before the RACCO during the


application period and on a specific date to be required by the office.

All duties, functions, and responsibilities of the ICAB,
the DSWD, and other government agencies relating to
alternative child care and adoption will be transferred
to NACC within 3 years.

During the transition period, a portion of the ARRU of the Field


Offices will act as RACCO who will perform the duties and responsibilities
stated in the Section 56 of the Act.
Those who will be retained at the ARRU will implement the remaining
program and services (CDCLAA, Foster Care & RA 11222) on alternative child
care under DSWD.


Adoption

Refers to the socio-legal process of providing permanent family


to a child whose parents had voluntarily or involuntarily given up
their rights and responsibilities, along with filiation, making the
child a legitimate child of adoptive parents: Provided, That adult
adoption shall also be covered by the benefits of the Act.
In the interest of clarity, adoption shall cease to be part of
alternative child care and becomes parental care as soon as the
process is completed.

Requirements

1. Social Case Study Report

find biological parents

(except for relative adoption)

⮚ Returned registered mail to the last known address
(involuntary commitment) or DVC (voluntary commitment)

Requirements

★ Notarized petition for adoption


★ HSR and CSR or SCSR
★ Birth Certificate of PAPs and Child in SECPA copy
★ Marriage certificate or CENOMAR in SECPA copy
(if applicable, Divorce Decree, Declaration of Nullity or Legal Separation Documents)
★ NBI or Police Clearance. If foreign national, clearance from the police authorities where
he/she has lived for more than 12 months any time in the past 15 years.
★ Death Certificate of the child’s biological parents
★ Original CDCLAA, if applicable
★ Medical Evaluation PAPs (prepared within 6 months)
★ Health and Medical Profile of the child (prepared within 6 months)
★ Psychological evaluation of the PAPs and child (for child 5 years old and above)
★ Child Care Plan with a list of at least three (3) temporary custodians of the child
★ Letters attesting the character from at least three (3) non-related character references
★ Recent 5R close up and whole body photos of PAPs and child taken at least 6 months
★ Documents showing the financial capacity
★ Attendance at Pre-Adoption training, undertaking to complete pre-adoption training
★ Certificate of Matching when applciable
Requirements

★ Written Consent from the appropriate person/s as enumerated under Section 23 of the
law;

 The adoptee, if ten (10) years of age or over;


 The biological parents of the child, if known, or the legal guardian, or the proper
government instrumentality which has the legal custody of the child, except in the
case of a Filipino of legal age if, prior to the adoption, said person has been
consistently considered and treated as their own child by the adopters for at least
three (3) years;
 The legitimate and adopted children, ten (10) years of age or over, of the
adopters, if any;
 The illegitimate children, ten (10) years of age or over, of the adopter if
living with the said adopter or over whom the adopter exercises
parental authority and the latter’s spouse, if any; and
 The spouse, if any, of the person adopting or to be adopted.
