Misclassification means the use of insufficient or inaccurate description of the

goods or the use of erroneous tariff headings resulting in the deficiency between
the CUD and tax paid and collected of 10% or more than should have been
collected.

Misdeclaration shall refer to the a false, untruthful, erroneous or inaccurate


declaration as to quantity, quality, description, weight or measurement of the
goods resulting in the deficiency between the CUD and tax paid and collected of
10% or more than should have been collected.

Undervaluation shall refer to a situation when the entered or declared value fails
to disclose in full the PAPP or dutiable adjustment or charges to the PAPP or when
incorrect valuation method is used or valuation rules are not properly observed,
resulting in the deficiency between the CUD and tax paid and collected of 10% or
more than should have been collected.
