AFFIDAVIT OF ARREST

I, PO1 Boysi Nunez y Vega, of legal age, single, a native of Zamboanga City
and presently residing at #201 A. Villa Street, Barangay Batis, San Juan City, after
having sworn to according to law do hereby depose and state:

That, I am assigned as Mobile Crew of the PCP 3 Bagong Bayan, Police Station
8, Quezon City Police District Office and with 12 hours tour of duty scheme of 8:00 PM
to 8:00 AM;

That, I report for duty in GOA C uniform on or about 2:00 AM of May 5, 2009 and
was directed to conduct Checkpoint operation from 2:00 AM to 4:00 PM of the same
date, together with SPO1 Oscar Tandoc y Perez and PO1 Nicanor Gapuz y Basa along
E. Rodriguez Ave., Bagong Bayan, Quezon City. At about 2:30 AM of the same date,
while conducting checkpoint, I received a radio alarm from STOC, that one victim who
was identified as (1) MANUEL RIGONES y TOBIAS, of legal age, married, employee of
GSIS, a native of Baliwag, Bulacan and residing at #123 Pinagkaisahan St., Brgy. West
Crame, Quezon City was kidnapped by three unidentified armed male suspects while
on board at his white TOYOTA REVO with Plate Number BBY-345, who was identified
driven by one (1) NOBERTO GONZALES y ROBLES, 50 years old, married, family
driver of the victim, a native of Bulacan and residing at #5 P. Gomez Street, Barangay
Sta. Rosa, Pasig City.

That, on or about 2:40 AM of the same date, reportedly the said Toyota Revo
headed towards Quezon City and was seen approaching headed to our Checkpoint.
Few meters away from our post, I noticed the said alarmed vehicle approaching.
Sensing no opportunity to maneuver, the vehicle stopped and two of the suspects
alighted from the vehicle in the attempt to evade arrest, who was later identified as one
(1) BARTOLO NEMIAS y PEREZ @ NYOK, 27 years old, married, construction worker,
native of Masbate and resident of #10 Sitio Lambak, Nagpayong, Pasig City together
with one (1) MARIO GALVEZ y GASTON @ LOLOY,29 years old, single, security
guard, native of Iloilo City and residing at #98-C Area 3, Nagpayong, Pasig City. While
the third one was left inside the car and held the victim hostage, who was later identified
as one (1) Diego Solomon y Gaston @ BOBOY, 21 years old, single, jobless, a native
of Bulacan and residing at #9 Sgt. Buscano Street., Brgy. East Rembo, Makati City.

That, I together with PO1 Nicanor Gapuz wasted no time and ran after the two
(2) fleeing suspects and then, l caught one of the suspects in the person of MARIO
GALVEZ y GASTON @ LOLOY, who was eventually subdued and arrested.
 That, I informed the suspect of his offense and his constitutional rights after
which he was brought to the office of the Police Station 8, Quezon City Police District,
Quezon City for investigation. Recovered from his possession is a one (1) .45 caliber
pistol marked Colt, chrome with defaced serial number marked as “MGG-1” and with
one(1) magazine marked as “MGG-2” and six (6) live ammunition marked as “MGG-3”,
“MGG-4”, “MGG-5”, “MGG-6”, “MGG-7” and “MGG-8” and the one (1) vehicle White
Toyota Revo with Plate Number BBY-345. All recovered from the possession of the
suspect, were properly turned over to the Investigator-On-Case SPO4 Ronaldo Diaz y
Ferrer.

That, I am executing this affidavit to attest to the foregoing facts and for purpose
of filing appropriate charges against one (1) of the three (3) suspects, identified as
MARIO GALVEZ y GASTON for violation of Art. 267 of the RPC also known as
“Kidnapping”, and violation of R.A. 8294 under Sec. 3 Tampering of firearm's
serial number and illegal possession of Firearms.

That, affiant further sayeth naught.
