P.C.:

1. The above Petition is filed against the Respondents for

non compliance of the order passed by this Court on 31 st August, 2021.

By the said order, the 1 st Respondent was directed to deposit a sum of

Rs. 3,02,04,715/- in this Court within a period of eight weeks from the

said date. In addition, the 1 st Respondent was also directed to disclose

on oath all assets and properties owned by it including the land along

with the said Factory as specified in Exhibit-K to the Section 9 Petition

as well as the current status of its assets, past and proposed dealings

thereof along with all other details of the same.

2. The aforesaid order has not been complied with. Neither

the deposit has been made nor any disclosure affidavit filed. Prima

facie therefore, the 1st Respondent is guilty of contempt. Respondent

Nos. 2 and 6 are the Directors of Respondent No.1 and are deemed to

have knowledge of the proceedings, being Directors in control of the 1 st

Respondent. Respondent No.7 is the Company Secretary of the 1 st

Respondent.

3. In these circumstances, the above Petition is admitted

against all the Respondents and the Office is directed to issue a Show

Cause Notice under Rule 1036 of the Bombay High Court, Original

Side Rules, 1980 to all the Respondents returnable on 15 th December,

2021 to show cause as to why they should not be punished under the

Provisions of the Contempt of Courts Act, 1971.

4. Stand over to 15th December, 2021.

5. All parties to act on an authenticated copy of this order

digitally signed by the Personal Assistant /Private Secretary/Associate

of this Court.
