1. Managerial employees are prohibited to form, join, assist any labor union under the labor code.

Explain the rationale behind this prohibition.

- Managerial employees shall not be eligible to form, join or assist any labor union for purposes of
collective bargaining because under article 212 “managerial employee” is one who is vested with
powers or prerogatives to lay down and execute management policies and/or to hire transfer, suspend,
lay off, recall, Discharge, assign or discipline employees. They are only in charge of ensuring that such
policies are implemented and presented by expresses the work done by the rank and file.

- Managerial employees are responsible for the company's success in the main line of business by
managing their respective teams. Specific teams and areas shall be properly planned, directed,
operated, and evaluated as part of such management.

2. Supervisor's right to form and join a labor union of their own was restored by the amendments
of R.A 6719. Provide an explanation of this right that pertains to supervisory employees.

- Supervisors employees have no rights to form and join a labor union of their own. Under Sec. 11, Rule
2 stated of the Omnibus rules implementing the Labor Code that supervisory unions are presently no
longer recognized nor allowed to exist and operate as such. Under article 212 supervisor managerial
responsible for actions if the exercise of such authority is not merely routinary or clerical in nature but
requires the use of independent judgment.

According to R.A 6715 has separate definition of two terms supervisor's authority is permitted to make
recommendations requires the use of independent judgement, but a managerial employee has the
authority to determine and implement out certain actions.

3. As an HR employee/personnel, are you in favor of labor organizations/unions in your


workplace?

For me yes, forming a labor union or collective bargaining is not a threat for the company/organization is
refers to a group of workers within an organization aimed at fighting for their interest of its member,
mainly in the improvement of wages and working conditions. Labor unions are governed by and for
members who have come together for a common purpose. The purpose of the unions is to bargain for
members with their employers for the welfare of the workers. They negotiate for better salaries, work
rules, employment contract, disciplinary procedures, promotion of workers, and privileges.
