Sudan Civil Aviation Regulations (SUCARs)

FOREWORD

1. Legal Background

Pursuant to Article 33 of the Civil Aviation Act, 2010 regarding the empowerment of the Board of Directors
of Civil Aviation to issue and amend Sudan Civil Aviation Regulations (SUCAR) for the approval of the
Competent Minister, Sudan Civil Aviation Safety Regulations are issued to ensure compliance with the
Convention on International Civil Aviation, signed in Chicago on 7 December 1944 (Chicago Convention)
to which the State of Sudan is a Party. The Convention, through its Annexes, provides for the minimum
standards to ensure the safety of civil aviation activities and environmental protection throughout the
application and implementation of common standards and technical requirements. Sudan Civil Aviation
Regulations provide an appropriate and comprehensive framework for the definition and implementation of
common technical requirements and administrative procedures in the field of civil aviation. Standards and
Recommended Practices (SARPs) contained in ICAO Annexes as well as the technical information in its
related publications form a main source in the making of Sudan Civil Aviation Regulations and therefore
represent an acceptable guidance in the areas that are not covered by Sudan Civil Aviation Regulations.

a) An aircraft, other than an aircraft registered in the State of Sudan, shall not fly over or land in the
territories of the State of Sudan except under an authorization granted by the Civil Aviation
Authority (CAA) on behalf of the Government of the State of Sudan.
b) An aircraft other than an aircraft registered in the State of Sudan shall not take on-board or
discharge any passengers or cargo at any location within the territories of the State of Sudan, being
passengers or cargo carried or to be carried for hire or reward, without the permission of the CAA
granted for the aircraft in accordance with any conditions and limitations to which such permission
may be subjected.
c) An aircraft shall not fly over or land in the territory of the State of Sudan unless it is registered in:
i. The State of Sudan; or

ii. An ICAO Contracting State; or

iii. Any other State where an agreement/arrangement between the State of Sudan and that State
making provisions for over-flight or landing in the territory of the State of Sudan.

d) In accordance with the provisions of SUCAR Part 7, an aircraft registered in the State of Sudan
shall comply with the Sudan Civil Aviation Regulations.
e) An Aircraft, registered outside the State of Sudan shall comply with the Sudan Civil Aviation
Regulations while operating to/from or within the territories of the State of Sudan wherever is
applicable.
f) An aircraft registered in the State of Sudan should comply with the regulations of other States that it
is overflying wherever is applicable.
g) Sudan CAA accepts the codes of the Type Certification Authority of the State of Manufacturer
and/or Design, for the purpose of issuing or Revalidation of Airworthiness Certificates,
Airworthiness Directives (ADs), Minimum Equipment List (MEL), and all other related issues in
that respect. The Sudan Civil Aviation Authority may impose additional requirements.

h) Any difference that may exist between SUCAR requirements and corresponding ICAO Annex
SARPs. Significant differences shall be published in the National AIP. The procedure for amending
the SUCARs and filing of differences with ICAO are contained in paragraph 4 below and detailed
information is found in the CAA Rule Making Manual.
i) An effort has been made for SUCAR requirements to be fully compliant with corresponding ICAO
Annexes; however, where an aviation activity for which a SUCAR regulation has not been
promulgated is undertaken in the Sudan, the relevant Annex provisions shall be applicable until it is
addressed in an amendment of the SUCAR.” Applicability date for SUCARs by users is set at six
months after they have been promulgated (30 September 2011).

2. Layout of the SUCAR Document

3 Rules of construction

In the Parts of these Regulations, unless the context requires otherwise:

1. Words importing the singular include the plural

2. Words importing the plural include the singular, and

3. Words importing the masculine gender include the feminine.

4. “Shall” is used in an imperative sense.

5. “May /should” is used in a permissive sense to state authority or permission to do the act prescribed,
and the words “no person may….” Or “a person may not …..” means that no person is required,
authorized or permitted to do the act prescribed, and

6. The word “Includes” means includes but is not limited to.

7. The word “Show” and its derivatives in these regulations have the exact intent as shown in the
dictionary.

4 Amendment Rationale and Procedures

The existing Sudan Civil Aviation Regulations will from time to time be amended to reflect the latest
updates of ICAO Standards and Recommended Practices (SARPs); it will also be amended to reflect the
latest up to date aviation safety related matters detected by the Civil Aviation Authority, the aviation
industry service providers or operators, and individuals and authorization holders; amendment may also be
generated to ensure safety standardization and to accommodate new initiatives or technologies. The
amendment procedure shall be as follows;

1. When the Civil Aviation Authority (CAA) receives an amendment to any of the current ICAO
Annexes, the same will be routed by the Office of the Director General of Civil Aviation to the
Standard and Safety Surveillance Committee (SSSC) which in turn will provide a copy to the
concerned Directorate for their study and comments within a specified period of time and route the
same back to the SSSC for final study and release.
2. When any of the different CAA Directorates requires a change to the applicable SUCAR parts, it
will send a letter stating the required change along with its justified reasons for such change where it
will then be studied and decided upon by the SSSC.
3. Any of the above mentioned change requests would then be prepared in draft form and sent to the
concerned Directorate for further study and comments within a specified period of time.
4. All suggested changes will be drafted in the form of notices of proposed amendments and addressed
to all concerned including industry representatives for comments prior to final release.
5. Any differences between the new regulations and ICAO standards and recommended practices will
be reported and recorded as differences to ICAO and reflected in the Aeronautical Information
Publications (AIP).
6. Entry into force time frame for any new regulations will be the responsibility of the SSSC. The
SSSC will also be responsible for coordinating the identification of differences from corresponding
ICAO Annexes in coordination with the concerned Directorates.
7. The Office of the Director General is responsible for filing differences with ICAO as soon as new
regulations or amendments thereto have been promulgated.
8. All concerned parties will be given a copy of the new amendment and will be requested to update
their copy of the regulations including their list of effective pages.
9. Approved amendments or corrigenda of SUCAR or part(s) thereof will be disseminated to the
industry through hardcopies (news release circulars directives and other) and softcopies (online or
database, Internet address, CD-ROM and other).
10. It is the responsibility of all concerned parties to keep their copy of the regulations up to date.
11. Where applicable, regulations contained in the Air Navigation Regulations (ANRs) that have not
been revoked may be enforced should the need arise.
12. The State may release no regulation prior to the formal approval of the Competent Minister as
determined in Civil Aviation Act 2010 or the Director General of Civil Aviation on delegation by
the Competent Minister.

SUBPART 1
GENERAL

VII.01.01 Applicability

(1) This ANR Part VII, applies to each person(s) operating or intending to operate civil
aircraft
in the Republic of SUDAN as a commercial air

operator. (2) This ANR Part VII prescribes:

(a) The types of AOCs issued by the CAA of the Republic of SUDAN;

(b) The certification requirements that a commercial air operator must attain in
order to obtain and hold an AOC authorizing operations under ANR Part VIII
Vol.2, ANR Part VIII Vol.3 or ANR Part X of the Republic of SUDAN,
specifications for each type of operation to be conducted and each class and
size of aircraft to be operated unless otherwise specified by the Director
General;

(c) The requirements a commercial air operator must meet to conduct operations
under ANR Part VIII Vol.2, ANR Part VIII Vol.3 and ANR Part X, and in
operati ng each class and size of aircraft authorised in its operations
specifications which relate to:

(i) Requirements affecting wet leasing of aircraft and other


arrangements for transportation by air.

(ii) Requirements for management personnel for operations conducte d under


ANR Part VIII Vol.2 or ANR Part VIII Vol.3.

(3) Unless otherwise specified by the Director General of the Sudan CAA,
operations when commercial transportation is not involved, conducted with aircraft
having a passenger -seat configuration of 9 seats or more, excluding any required
crewmember seat, or a payload capacity of 2,500 kg or more, this Part VII does not
apply to:

(a) Student instruction;

(b) Flights conducted with aircraft having a passenger seat configuration of 9


or less, excluding each crewmember seat, and a payload capacity of 2,500
kg or less, that start and end at the same airport, and conducted within a 25
nautical mile radius of that airport and are:

(i) Ferry or training

flights; (ii) Aerial work

operations;

(iii) Dusting, seeding, and

spraying; (iv) Banner towing;

(v) Aerial photography or survey;

(vi) Fire fighting activities under the control of the Minister.

(a) Helicopter operations in construction or repair work (but it does apply to


transportation
to and from the site of

operations); (b) Power line or

pipeline pa trol;

(c) Sightseeing flights conducted in hot air balloons;

(d) Non-stop flights carrying person(s)s for the purpose of intentional parachute

jumps; (e) Helicopter flights providing:

(i) Not more than two passengers are carried in the helicopter in addition to the
flight crew;

(ii) Each flight is made under day VFR conditions;

(iii) The helicopter used is certified in the standard category and complies
with inspection requirements of ANR Part VIII Vol.1

(iv) The operator notifies the Republic of SUDAN CAA at least 24 hours before
each flight and furnishes any essential information that is requested;

(v) The number of flights does not exceed a total of six in any calendar year.

VII.01 02 Definitions

(1) Commercial transportation / Commercial air transport operator :

(a) Operations that constitute “commercial transportation” are required to be


conducted under ANR Part VIII, Vol. 2 or Part VIII, Vol. 3, or ANR Part X.

(b) “Commercial transportation” does exclude any operations conducted as

“private transportation”. Private transportation operations are not concerned by


this regulation.

(c) There are four elements in defining a “commercial transport operator” :


→ a holding out of a willingness to
→ transport persons or property
→ from place to place
→ for compensation.

(2) Domestic transportation :


Domestic transportation means any scheduled operations conducted :
- by using aeroplane having a passenger seat configuration of more
than 9
passenger seat (excluding each crew member seat) and a payload
capacity
of more than 7.500 pounds,
- within the boundaries of the Republic of Sudan.

(3) Small aircraft operation


Small aircraft operation means any scheduled operation conducted by any
person operating aeroplane - having configuration of nine seats or less,
and maximum payload of 7500 pounds (5.700 kg) or less - or helicopter, with a
frequency of operations
of at least 5 round trips per week on at least one route between two or more
points according to the published flight schedules.

VII.01 03 Certification, authorization, and prohibition

(1) A person(s) authorized by the Director General to conduct operations as a


commercial air operator will be issued an AOC.

(2) A person(s) who is not authorized to conduct commercial air operations, but
who is authorized by the Director General to conduct operations when commercial
transportation
is not involved as an operator of Republic of SUDAN registered civil aircraft
with a seat configuration of 20 or more passengers, or a maximum payload
capacity of 2500 kg or more, will be issued an AOC.

(3) A person(s) authorised to engage in commercial transportation under ANR Part


VIII Vol. 2, Part VIII Vol. 3 and Part X, or both, shall be issued an AOC
authorising such commercial transportation, regardless of the type of operation
or the class or size of aircraft to be operated.

(4) A person(s) authorised to engage in private (non -commercial) transportation


under ANR Part VIII Vol. 2 or Vol.3, or both, shall be issued an AOC authorising
such transportation, regardless of the type of operation or the class or size of
aircraft to be operated.

(5) No person(s) may operate as a commercial air operator without, or in violation


of, the appropriate AOC and appropriate operations specifications. No person(s)
may operate as
an air operator in violation of any deviation or exemption by authority, if issued
to that person(s) or that person(s)'s delegated representative.

(6) A person(s) holding an AOC authorizing private (non -commercial)


transportation operations shall not conduct any operations in commercial
transportation.
A person(s) holding an AOC authorizing commercial transportation operations
shall not conduct any operations in private (non -commercial) transportation.

(7) No person(s) may operate as a commercial air operator without holding


appropriate economic authority from the Republic of SUDAN CAA.

(8) An AOC holder under this Part VII may not operate aircraft under ANR Part
VIII Vol.2, ANR Part VIII Vol.3 and ANR Part X in a geographical area
unless its operations specifications specifically authorise the AOC holder to
operate in that area.

(9) No person(s) may advertise or otherwise offer to perform an operation subject to


this ANR Part VII unless that person(s) is authorised by the Republic of
SUDAN CAA to conduct that operation.

VII.01.04 Operations specifications

(1) Each AOC holder's operations specification s must contain:

(a) The authorizations, limitations, and procedures under which each type of
operation, if applicable, is to be conducted; and

(b) Other procedures under which each class and size of aircraft are to be operated.

(2) Except for operations specifications paragraphs identifying authorized types of


operations, operations specifications are not a part of an AOC.

VII.01.05 Use of business names

(1) An AOC holder under this ANR Part VII may not operate an aircraft under ANR
Part VIII Vol. 2, ANR Part VIII Vo l. 3 and ANR Part X using a business
name other than the business name appearing in the AOC holder's operations
specifications.

(2) No person(s) may operate an aircraft under ANR Part VIII Vol. 2, ANR Part VIII
Vol. 3 and ANR Part X unless the name of the AOC holder who is operating
the aircraft, or the commercial air operator AOC number of the AOC holder who
is operating the aircraft, is displayed on the aircraft and is clearly visible and

readable from the outside of the aircraft


to a person(s) standing on t he ground at any time except during flight time. The
means of displaying the name on the aircraft and its readability must be
acceptable to the Director General.

SUBPART 2

APPLICABILITY OF OPERATING REQUIREMENTS TO DIFFERENT


TYPES OF OPERATIONS UNDER ANR PART VIII VOL.2, PA RT VIII
VOL.3 AND PA RT X

VII.02.01 Commercial air operators engaged in domestic commercial


transportation.

(1) Each person(s) who conducts operations as a commercial air operator


engaged in domestic commercial transportation of person(s ) - or property -
shall comply with the certification and operations specifications requirements in
subpart 3 of this ANR Part VII, and shall conduct its:

(a) Operations – scheduled or non-scheduled – in accordance with the


applicable requirements of ANR Part VIII Vol.2, and shall be issued
operations specifications in the AOC for those operations in accordance with
those requirements.
However, based on a indicating of safety in air commerce, the Director
General may permit person(s) who conduct domestic opera tions between any
point located within any of the territories of the Republic of SUDAN,
compliant with the requirements applicable to operations contained in ANR
Part VIII Vol.2, Part VIII Vol.3 and Part X.

(b) Small aircraft operations in accordance with the applicable requirements of


ANR Part VIII Vol.3, and shall be issued operations specifications for
those operations in accordance with those requirements.

(c) On-demand operations in accordance with the applicable requirements of


ANR Part VIII Vol.3, and shall be issued operations specifications for
those operations in accordance with those requirements.

Note : Person(s) who are subject to the requirements of paragraph (b) of this
section may conduct those operations in accordance with the requirements of pa
ragraph (1)(a) of this section, provided they obtain authorization from the Director
General.

VII.02.02 Commercial Air Operators engaged in passenger -carrying


operations, cargo operations, or both with aircraft when commercial
transportation is not involved.

(1) Each person(s) who conducts commercial air operations when commercial
transportation
is not involved with aircraft having a passenger -seat configuration of 20 seats
or more, excluding each crewmember seat, or a payload capacity of 2,500

kg or more, s hall, unless deviation authority is issued :

(a) Comply with the certification and operations specification requirements of


ANR Part
VIII Vol.2.

(b) Conduct its operations with those aircraft in accordance with the requirements of
ANR Part VIII Vol.2, and

(c) Have issued operations specifications in accordance with those requirements.

(2) Person(s) who conducts non commercial transportation except as provided in ANR
Part
VIII Vol.1 or private transportation operations for compensation or hire with aircraft
having
a passenger-seat configuration of less than 20 seats, excluding each crewmember
seat, and a payload capacity of less than 2,500 kg shall :

(a) Comply with the certification and operations specifications requirements in


subpart 3
of this Part VII;

(b) Conduct those operations in accordance with the requirements of ANR Part VIII
Vol.3, except for those requirements applicable only to commuter operations; and

(c) Be issued operations specifications in accordance with those requirements.

VII.02.03 Rotorcraft operations : c commercial air operators.

(1) Person(s) who conducts rotorcraft operations for compensation or hire must
comply with the certification and operations specifications requirements of
Subpart 3 of this Part VII and shall conduct:

(a) Small aircraft operations in acc ordnance with the applicable requirements of
ANR Part
X, and shall be issued operations specifications for those operations in
accordance with those requirements.

(b) On-demand operations in accordance with the applicable requirements of ANR


Part X and shall be issued operations specifications for those operations in
accordance with requirements

SUBPART 3
CERTIFICATION, OPERA TIONS
SPECIFICATIONS , AND CERTAIN OTHER
RE QUIREMENTS FOR OPERATIONS
CONDUCTED UNDER
ANR PART VIII VOL.2 , ANR PART VIII VOL .3 AND ANR X

VII.03.01 Applicability

(1) This subpart sets out certification requirements and prescribes the content of
operations specifications and certain other requirements for operations
conducted under ANR Parts VIII Vol.2 (Air Transport Operations – Large
Aeroplane), or VIII Vol.3 (Air Transport Operations – Small Aeroplane),
and X (Air Transport Operations – Helicopters).

VII.03.02 General requirements

(1) A person(s) may not operate as a commercial air operator unless that person(s) :

(a) Is a citizen of the Re public of SUDAN, or a permanent resident in the


Republic of
SUDAN

(b) Obtains an AOC; and

(c) Obtains operations specifications that prescribe the authorizations,


limitations, and procedures under which each type of operation must be
conducted.

(2) A person(s), other er than a commercial air operator, may not conduct any
commercial passenger or cargo aircraft operation for compensation or hire under
ANR Parts VIII Vol.2
or VIII Vol.3, unless that person(s) -

(a) Is a citizen of the Republic of SUDAN or a permanent resident in the


Republic of
SUDAN

(b) Obtains an AOC; and

(c) Obtains operations specifications that prescribe the authorizations,


limitations, and procedures under which each type of operation must be
conducted.

(3) Applicants for an AOC under this Part VII, and each applicant for operations
specifications authorizing a new type of operation that is subject to ANR
Parts VIII Vol.2 or VIII Vol.3, shall conduct proving tests as authorized by
the Director General during the application process for authority to conduct

operations under ANR Parts VIII Vol.2 or VIII Vol.3. All proving tests must be
conducted in a manner acceptable to the Director General. All proving
tests must be conducted under the appropriate operating and
maintenance requirements of ANR Parts VIII Vol.2 or VI II Vol.3 that would
apply if the applicant were fully certified.
The Director General will issue a letter of authorization to each person(s)
starting the
various authorizations under which the proving tests shall be conducted.

VII.03.03 AOC application requirements for all operators.

(1) A person(s) applying to the Director General for an AOC under this Part VII
must submit
an application :
(a) In a form and manner prescribed by the Director General; and
(b) Containing any information the Director General requires the applicant to
submit.
(2) Each applicant must submit the application to the Director General at least 45
days before the date of intended operation.

VII.03.04 Additional AOC application requirements for commercial


air operators

(1) Applicant for the original issue of an AOC for the purpose of
conducting domestic commercial transportation operations under ANR Parts
VIII Vol.3 or Part X shall submit an application to the Director General.

(2) Application submitted under paragraph (1) of this section mus t contain a signed
statement indicating the following:

(a) The name and address of each person having a financial interest, or
stockholder who owns 5 percent or more of the total voting stock of
the corporation, and if that stockholder is not the sole benefic ial owner
of the stock, the name and address of each beneficial owner.
An individual is considered to own the stock owned, directly or indirectly,
by or for his
or her spouse, children, grandchildren, or parents.

(b) The name and address of each Director Gen eral and each officer and each
person(s) employed, or who will be employed, in a management position

described in regulation ANR Parts VII. 03.18 and VII. 03.20, as applicable.
(c) The name and address of each person(s) directly or indirectly controlling or
c ontrolled
by the applicant, and each person(s) under direct or indirect control with the
applicant.

In addition, each applicant for the original issue of an AOC under paragraph (1) of
this section must submit with the application a signed statement indica ting the
nature and scope of its intended operation, including the name and address of
each person(s), if any, with whom the applicant has a contract to provide services
as a commercial air operator and the scope, nature, date, and duration of each
contrac ts.

(3) For applicants intending to conduct operations under ANR PART VIII Vol.2,
the financial information listed in paragraph (5)(b) of this section.

(4) Applicants for, or holder of, an AOC issued under paragraph (1) of this section,
shall notify the Director General within 10 days after :

(a) A change in any of the person(s)s, or the names and addresses of any
of the person(s)s, submitted to the Director General under paragraph (2)(c)
of this section;
or
(b) For applicants intending to conduct operations under AN R PART VIII
Vol.2, a change
in the financial information submitted to the Director General under
paragraph (5)(b) of this section that occurs while the application for
the issue is pending before the Republic of SUDAN CAA and that
would make the applicant' s financial situation substantially less
favourable than originally reported.

(5) Each applicant for the original issue of an AOC under paragraph (1) of this
section who intends to conduct operations under ANR Parts VIII Vol.2
must submit the following financial information:

(a) A balance sheet that shows assets, liabilities, and net worth, as of a date
not more than 30 days before the date of application.

(b) An itemization of liabilities more than 60 days past due on the balance
sheet date, if any, indicating each creditor's name and address, a
description of the liability, and the amount and due date of the liability.
(6) All applicants must provide itemization of claims in litigation, if any, against
the applicant
as of the date of application indicating each claima nt's name and
address and a description and the amount of the claim outstanding.

(7) All applicants must provide detailed projection of the proposed operation
covering 6
complete months after the month in which the AOC is expected to be issued
including

(a) Estimated amount and source of both operating and non operating
revenue, including identification of its existing and anticipated income
producing contracts and estimated revenue per mile or hour of operation
by aircraft type;

(b) Estimated amount of operating an d non operating expenses by expense
objective classification; and

(c) Estimated net profit or loss for the period.

(8) Applicants must provide an estimate of the cash that will be needed for
the proposed operations during the first 6 months after the month in wh ich
the AOC is expected to be issued, including :

(a) Acquisition of property and equipment

(explain); (b) Retirement of debt (explain);

(c) Additional working capital (with explanation);

(d) Operating losses other than depreciation and amortisation (explain); and

(e) Other (explanation).

(9) Applicants must provide an estimate of the cash that will be available during
the first 6
months after the month in which the AOC is expected to be

issued, from : (a) Sale of property or flight equipment

(explanation);

(b) New debt (explanation);

(c) New equity (explain);


(d) Working capital reduction (explain);

(e) Operations (profits -loss) (explanation);

(f) Depreciation and amortization (explanation); and

(g) Other (explanation).

(10) Applicants shall provide a schedule of insurance coverage in effect on the


balance sheet date indicating insurance companies; policy numbers; types,
amounts, and period of coverage; and special conditions, exclusions, and

limitations as well as :

(a) Any other financial information that the Director General requires to
enable him to determine that the applicant has sufficient financial
resources to conduct his or her operations with the degree of safety
required in the public interest.
(b) All financial statements containing financial information required by
paragraphs of this section must be based on accounts prepared and
maintained on an accrual basis in accordance with generally accepted

accounting principles applied on a consistent basis, and must contain


the name and address of the applicant's public accounting firm, if any.
Information submitted must be signed by an officer, owner, or partner of
the applicant or AOC holder.

VII.03.05 Contents of an AOC

The AOC shall include :

(a) The AOC holder's name;

(b) The location of the AOC holder's principal base of

operations; (c) The AOC number;

(d) The AOC effective date;

(e) The name or the designator of the AOC -holding office; and

(f) Operations specifications and limitations.

VII.03.06 Issuing or denying a AOC.

(1) Applicants may be issued an AOC if, after investigation, the Director General
finds that the applicant:

(a) Meets the applicable requirements of this ANR Part VII;

(b) Holds the economic authority applicable to the types of operations to be


conducted, issued by the Ministry of Transports, if required; and

(c) Is properly and adequately equipped in acc ordance with the


requirements of the Republic of SUDAN ANR’s and is able to conduct a
safe operation under appropriate provisions of ANR Part VIII Vol. 2,
Part VIII Vol. 3 and Part X, and operations specifications issued
under this Part VII.

(2) An application for an AOC may be denied if the Director General finds that:

(a) The applicant is not properly or adequately equipped or is not able to


conduct safe operations under this subchapter;

(b) The applicant was previously holding an AOC which was revoked;

(c) The applicant intends to fill – or does fill – a key management


position listed in regulations ANR Parts VII. 03.18 or VII. 03.20, as
applicable, with an individual who exercised control over - or who held
the same or a similar position - with an AOC holder whose AOC was
revoked, or is in the process of being revoked, and that this individual
materially contributed to the circumstances causing revocation or causing
the revocation process to be administrated.

(d) An individual who has - or will have - control over, or h as a


substantial ownership interest in the applicant organization, had the same
or similar control or interest in an AOC holder whose AOC was revoked
- or is in the process of being revoked - and that individual materially
contributed to the circumstances causing revocation or causing the
revocation process; or

(e) In the case of an applicant for an AOC for domestic commercial


transportation, that, for financial reasons, the applicant is not able to conduct
a safe operation.

VII.03.07 Amending an AOC

(1) The Director General may amend any AOC issued under this ANR Part VII if:

(a) The Director General determines, in reference to any ANR of the


Republic of SUDAN, that safety in commercial air operations and
the public interest require the amendment; or

(b) The AOC holder applies for the amendment and the Director General
determines that safety in commercial air operations and the public interest
allow the amendment.

(2) When the AOC holder applies for an amendment of its AOC, the following
procedure applies:

(a) The AOC holder will file an application to amend the AOC at least 15
days before the date proposed by the applicant for the amendment to
become effective, unless the Director General approves filing within a
shorter period; and

(b) The application must be submitted in th e form and manner prescribed by


the
Director General.

(c) While an AOC holder seeks reconsideration of a decision from the


Director General concerning amendments of an AOC, an application for
reconsideration must be made within 30 days after the AOC holder
receives notice of denial.

VII.03.08 AOC holder's duty to maintain operations specifications  

(1) Each AOC holder must maintain a complete and separate set of its
operations specifications at its principal base of operations without exception.
(2) Each AOC holde r shall insert pertinent excerpts of its operations
specifications, or
references thereto, in its manual and shall:

(a) Clearly identify each such excerpt as a part of its operations specifications;
and

(b) State that compliance with each operations specificatio ns requirement is


mandatory.

(3) Each AOC holder shall keep each of its employees and other person(s)
used in its operations informed of the provisions of its operations
specifications that apply to that employee's or person(s)'s duties and
responsibilities.

VII.03.09 Maintaining a principal base of operations, main operations


base, and main maintenance base; change of address.

(1) Each AOC holder must maintain a principal base of operations. He may also
establish a main operating base and a main maintenance ba se which may be
located at either the same location as the principal base of operations, or at
separate locations accordingly.

(2) At least 21 days before it proposes to establish or change the location of its
principal base
of operations, its main operations base, or its main maintenance base, an
AOC holder must provide written notification to the SUDAN CAA office,
attention Operations Division.

VII.03.10 Contents of operations specifications

(1) Each AOC holder conducting commercial operations must provide o


perations specifications containing all of the following:

(a) The specific location of the AOC holder's principal base of operations
and, if

(b) different, the address that shall serve as the primary point of contact
for correspondence between the CAA of the Republic of SUDAN and
the AOC holder.

(c) Reference to the economic authority issued by the Ministry of Transports, if


required.

(c) Type of aircraft, registration markings, serial numbers for each aircraft
authorized for use, each regular and alternate airport to b e used in
scheduled operations, and, except for commuter operations, each
provisional and refueling airport.

(2) The AOC holder may not conduct any operation using any aircraft or airport
not listed in, when the following cannot be realized:

(a) Types of operations authorized.

(b) Authorization and limitations for routes and areas of

operations. (c) Airport limitations.

(d) Time limitations, or standards for determining time limitations, for


overhauling, inspecting, and checking airframes, engines, propellers,
appliances , and emergency equipment.

(e) Authorization for the method of controlling weight and balance


of aircraft. (f) Aircraft wet lease information required.
(g) Any authorized deviation and exemption granted from any
requirement of the
Republic of SUDAN ANR’s.

(h) Any other item the Director General determines as necessary.

(3) All AOC holders conducting supplemental operations must obtain


operations specifications containing all of the following:

(a) Specific location of the AOC holder's principal base of operations, and, if
different, the address that shall serve as the primary point of contact for
correspondence between the Republic of SUDAN CAA and the AOC holder
and the name and mailing address
of the AOC holder's agent for service.

(b) Other business names under which the AOC holder may operate.

(d) Reference to the economic authority issued by the Ministry of Transports, if


required.
(d) Type of aircraft, registration markings, and serial number of each aircraft
authorized for use.

(4) Subject to the approval of the Director General wi th regard to form and
content, the AOC holder may incorporate by reference the items listed in this
section into the AOC holder's operations specifications, by maintaining a
current listing of those items and by referring to the specific list in the applic
able paragraph of the operations specifications.

(5) The AOC holder may not conduct any operation using any aircraft not listed
including and not limited to:

(a) Types of operations authorized.

(b) Authorization and limitations for routes and areas of

operations. (c) Special airport authorizations and

limitations.

(d) Time limitations, or standards for determining time limitations,


for overhauling, inspecting, and checking airframes, engines, propellers,
appliances, and emergency equipment.

(e) Authorization for the method o f controlling weight and balance of aircraft.

(f) Aircraft wet lease information required by regulation ANR Part VII.03.12.

(g) Any authorization or requirement to conduct supplemental operations as


provided by regulation ANR Part VII.02.01.

(h) Any authorized devi ation or exemption from any requirement of the
Republic of
SUDAN ANRs.

(i) Any other item the Director General determines as necessary.

(6) Each AOC holder conducting on -demand operations must obtain operations
specifications containing all of the following:

(a) The location of the AOC holder's principal base of operations and, if
different, the address that shall serve as the primary point of contact for
correspondence between

the Republic of SUDAN CAA and the name and mailing address of the
AOC holder's
agent for service.

(c) Other business names under which the AOC holder may operate.

(c) Reference to the economic authority issued by the Ministry of Transports,

if required. (d) Type and area of operations authorized.

(e) Category and class of aircraft that may be used in those operations.

(f) Type of aircraft, registration markings, and serial number of each


aircraft that is subject to an airworthiness maintenance programme required
by ANR Part V.

VII.03.11 Amending operations specifications.

(1) The Director General may amend any operations specifications issued under
this ANR Part VII if:

(a) He determines that safety in commercial air operations and the public
interest require the amendment; or

(b) The AOC holder applies for the amendment, and the Director General

determines that safety in commercial air operations and the public interest allow
for the amendment.

(2) Except as provided in paragraph (9) of this section, when the Director General
initiates an amendment to an AOC holder's operations specifications, the
following procedure sh all apply :

(a) The SUDAN CAA operations office notifies the AOC holder in writing of
the proposed amendment.

(b) The SUDAN CAA operations office sets a reasonable period (but not
less than 15 days) within which the AOC holder may submit written
information, vie ws and arguments on the amendment.

(c) After deliberation on all material presented, the SUDAN CAA operations
office notifies the AOC holder of:

(i) Approval of the proposed amendment;

(ii) Partial approval of the proposed amendment; or

(iii) Withdrawal of the proposed a amendment.

(3) If the SUDAN CAA operations office issues an amendment to the


operations specifications, it becomes effective not less than 30 days after the
AOC holder receives notice of it, unless :

(a) The SUDAN CAA operations office finds under paragraph (9) o f this
section

(b) that there is an emergency requiring immediate action with respect to


safety in commercial air operations; or

(b) The AOC holder petitions for reconsideration of the amendment under
paragraph (8)
of this section.

(4) When the AOC holder applies for an amendment to its operations
specifications, the
following procedure will apply:

(a) He must file an application to amend its operations specifications list,

(b) At least 21 days before the date proposed by the applicant for the
amendment to become effective in all other cases.

(5) The application must be submitted to the SUDAN CAA operations office in
a form and manner prescribed by the Director General.

(6) After carefully considering all material presented, the Director General
notifies the AO holder of:

(a) approval of the applied for amendment; or

(b) partial approval of the applied for amendment, or

(c) the denial of the request for amendment. The AOC holder may
petition for reconsideration of a denial under paragraph (8) of this section.

(7) If the SUDAN CAA operations office approves the amendment, following co
-ordination with the AOC holder regarding its implementation, the amendment is
effective as soon as
the Director General approves it in his notification message.

(8) When an AOC holder seeks reconsideration of a decision from the SUDAN
CAA office concerning the amendment of operations specifications, the
following procedure applies:

(a) AOC holder must petition for reconsideration of that decision within 30
days of the date that the AOC holder receives a notice of denial of
the amendment to its operations specifications, or of the date it receives
notice of the Republic of SUDAN CAA initiated amendment to its
operations specifications, or whichever circumstance applies.

(b) AOC holder must address its petition to the Directo r General.

(c) Petition for reconsideration, if filed within the 30 -day period,


suspends the effectiveness of any amendment issued by the SUDAN
CAA operations office unless this office has found, under paragraph (9)
of this section, that an emergency exists requiring immediate action with
respect to safety in commercial air operations.

(d) If a petition for reconsideration is not filed within 30 days, the procedures of
paragraph
(c) of this section apply.
(9) If the SUDAN CAA operations office finds out that an eme rgency exists
requiring immediate action with respect to safety in air transportation that makes
the procedures set
out in this section impracticable or contrary to the public interest:

(a) The SUDAN CAA operations office amends the operations specifications
and makes the amendment effective on the day the AOC holder receives
notice of it.

(b) In the notice to the AOC holder, the SUDAN CAA operations office
articulates the reasons for its finding, that an emergency exists
requiring immediate action with respect to safety in commercial air
operations, or that makes it impracticable or contrary to the public
interest to maintain and keep on the effectiveness of the
amendment.

VII.03.12 Wet leasing of aircraft and other arrangements for transportation


by air

(1) Unless otherwise specified by the Director General, prior to conducting


commercial transportation operations involving a wet lease, each AOC holder
under this ANR Part VII, shall provide the Director General with a copy of
any wet lease contract to be executed.

(2) No AOC holder under this ANR Part VII may wet lease from a foreign air
operator or any other foreign person(s) or any person(s) not authorized in
commercial transportation operations.

(3) Upon receiving a copy of a wet lease contract, in which contract the
operational control of the aircraft will always be under the responsibility of the
AOC holder, the Director General will issue amendments to the operations
specifications of the AOC holder, as required. The lessor must provide the
following information to be incorporated into the operations
specifications of both parties, as required to include;

(a) Names of the parties to the agreement and the duration thereof.

(b) Nationality and registration markings of each aircraft involved in the

agreement. (c) Type of operation (e.g., domestic, supplemental, on -

demand, other).

(d) The airports or areas of operation.

(d) Statement specifying that the AOC holder is taking the operational
control of the aircraft, and the times, airports, or areas under which
such operational control is exercised.

(4) In making the determination of paragraph (3) of this section, the Director
General will consider the following:
(a) Crew members and training.
(b) Airworthiness and performance of

maintenance. (c) Dispatch.

(d) Servicing the

aircraft. (e)

Scheduling.

(f) Other factor the Director General considers pertinent.

VII.03.13 Obtaining deviation authority to perform operations under the


Republic of SUDAN military contract.

(1) An AOC holder my obtain from the Director General deviation to perform
commercial operations under the Republic of Sudan military contract, in a form
and manner prescribed
by the Director General.

(2) Operations specifications will never be less restrictive than as per the operator
AOC.

(3) Operations will be conducted in accordance with ANR Part VIII V ol. 2, Part
VIII Vol. 3 and
Part X.

VII.03.14 Obtaining deviation authority to perform an emergency operation

(4) In emergency conditions, the Director General may authorize deviations


providing:

(a) Conditions necessitate the transportation of person(s) or supplies for the


protection of life or property; and

(b) The Director General concludes that a deviation is necessary for the
expeditious conduct of the operations.

(5) If the Director General authorizes deviations for operations under emergency
conditions:

(a) The Director General will issue an appropriate amendment to the


AOC holder's operations specifications; or

(b) If the nature of the emergency does not permit timely amendment of the
operations specifications:

(i) The Director General may authorize the deviation orall y or by


telephone, confirmed by a tealeaf and mail, and

(ii) The AOC holder shall provide documentation describing the


nature of the emergency to the Republic of SUDAN CAA within
24 hours after completing the operation.

VII.03.15 Conducting tests and inspect ions

(1) At any time, at the discretion of the Director General, he or his designated
inspector(s) may conduct an inspection or test to determine whether AOC holders
under this ANR Part VII are complying with Republic of SUDAN applicable
regulations and the A OC - or the
AOC holder's - operations specifications.

(2) AOC holder(s) must:

(a) Make information’s available to the Director General at the AOC


holder's principal base of operations;

(b) Produce copy of the AOC holder's AOC, and the AOC holder's
operations specifications; and

(c) Produce a current listing that will include the location and person(s)
responsible for each record, document, and report required to be kept by
the AOC holder under this ANR Part VII.

(d) Allow the Director General to make any test or inspectio n to determine
(e) compliance respecting any matter stated in paragraph (a) of this section.

(e) Provide list of employee(s) or person(s) engaged by the AOC


holder who are responsible for maintaining the AOC holder's records
and must make those records available to the Director General.

(3) The Director General may determine an AOC holder's continued eligibility to
hold its AOC and/or operations specifications on any matter listed in
paragraph (2) of this section, or any other appropriate matter.

(4) Failure by any AOC holder to make available to the Director General - upon
request - the
AOC, operations specifications, or any required record, document, or report,
will conduct
to suspend operations specifications of the AOC holder's.
(5) In the case of operators conducting d omestic commercial transportation
operations, these inspections and tests include inspections and tests of financial
books and records.

VII.03.16 Duration and surrender of AOC and operations specifications

(1) An AOC issued under this ANR Part VII is effective until:

(a) The AOC holder surrenders it to the Director General; or

(b) The Director General suspends, revokes, or otherwise terminates the AOC.

(2) Operations specifications issued under ANR Part VIII Vol.2, Part VIII Vol.3
and Part X are effective unless:

(a) The Director General suspends, revokes, or otherwise terminates the AOC;

(b) The operations specifications are amended as provided in regulation


ANR Part
VII.03.11;

(c) The AOC holder does not conduct a type of operation for more than the
time specified
in regulation ANR Part VII.03.17 and fails to follow the procedures of

regulation ANR Part VII.03.17 upon resuming that type of operation; or

(e) The Director General suspends or revokes the operations specifications for
a type of operation.

(3) Within 30 days after an A OC holder terminates operations under ANR Part
VIII Vol.2, Part VIII Vol.3 and Part X, the AOC and operations
specifications must be surrendered by the AOC holder to the SUDAN CAA
operations office.

VII.03.17 Regency of operation

(1) Except as otherwise pro vided in paragraph (2) of this section, no AOC
holder may conduct a type of operation for which it holds authority in its
operations specifications unless the AOC holder has conducted that type of
operation within the preceding number
of consecutive calendar days specified in this section:

(a) For domestic or small aircraft operations -30 days.

(b) For supplemental or on -demand operations -90 days, except that if the
AOC holder has authority to conduct domestic or small aircraft
operations, and has conducted domestic or small aircraft operations
within the previous 60 days, this paragraph does not apply.

(2) If an AOC holder does not conduct a type of operation for which it is
authorized in its operations specifications within the number of calendar days
specified in paragraph (1) of this section, it shall not conduct such type of
operation unless:

(a) It advises the Director General at least 5 consecutive calendar
days before resumption of that type of operation; and

(b) It makes itself available and accessible during the 5 consecutive calendar
day period
in the event that Director General decides to conduct a full inspection re -
examination
to determine whether the AOC holder remains adequately equipped and
able to conduct a safe operation.

VII.03.18 Management personnel required for operations conducted under


ANR Part VIII Vol.2, ANR Part VIII Vol.3 and ANR Part X.

(1) All AOC holders must have sufficiently qualified management and technical
person(s) to ensure the highest degree of safety in their operations. The
AOC holder must have qualified person(s) serving full -time in the following
or equivalent positions as follows :

(a) Director / Director General / President / Accountable

Manager. (b) Director of Safety.

(c) Director of Flight

Operations. (d) Training

Manager / Chief Pilot. (e)

Director of Maintenance.

(f) Quality Manager.

(2) The Director General may approve positions or numbers of positions other
than those listed in paragraph (1) of this section for a particular operation if
the AOC holder shows that it can perform the operation with the highest
degree of safety under the direction of fewer or different categories of
management personnel due to:

(a) Type of operation involved;

(b) Number and type of aircraft used; and

(c) Area of operations.

(3) Title of the positions required under paragraph (1) of this section or the title
and number of equivalent positions approved under paragraph (2) of this
section shall be set forth in the AOC holder's operations specifications.

(4) The individuals who serve in the positions required or approved under
paragraph (1) of this section and anyone in a position to exercise control over
operations conducted under
the operating AOC must be/have:

(a) Qualified through training, experience, and expertise;

(b) Full understanding of the following materials with respect to the


AOC holder's operation specifications;

(c) Knowledge and practical understanding of aviation safety standards


and safe operating practices;
(d) Knowledge and understanding of manual requirements under ANR Part
VIII Vol.2, Part VIII Vol.3 and Part X; and(e) Discharge their duties to meet
applicable legal requirements and to maintain safe
operations.

(5) Each AOC holder must:

(a) State in the general policy provisions of the manuals required by ANR
(b) Part VIII Vol.2, Part VIII Vol.3 and Part X, the duties, responsibilities,
and authority of personnel required under paragraph (1) of this section
and;

(b) List in the manuals the names and business addresses of the individuals
assigned to those positions; and

(c) Notify the Republic of SUDAN CAA within 10 days of any change in
personnel or any vacancy in any position listed.

VII.03.19 Management personnel : Qualifications for operations


conducted under ANR Parts VIII Vol.2 and Vol. 3 , and ANR
Part X.

(1) To serve as Director of Flight Operations a person must:

(a) Hold – or have held – an airline transport pilot certificate;

(b) Have at least 3 years supervisory - or equivalent - managerial


experience within the last 6 years in a position that exercised
operational control over any operations conducted with large aircraft
under ANR Part VIII Vol .2, Part VIII Vol.3 and Part X.
Or if the AOC holder uses only small aircraft in its operations, the
cumulative
experience may be acquired in either large or small aircraft; and
(c) In the case of a person becoming a Director of Flight Operations for the fi
rst time ever, have at least 3 years experience, within the past 6 years, as
pilot in command of a large aircraft operated under ANR Part VIII
Vol.2, Part VIII Vol.3 and Part X, if the AOC holder operates large
aircraft.
If the AOC holder uses only small aircraft in its operation, the
experience may be obtained in either large or small aircraft.

(2) To serve as Training Manager / Chief Pilot a person must:

(a) Hold an airline transport pilot certificate with appropriate ratings for at least
one of the aircraft used in the AOC holder's operations, and

(b) In the case of a person becoming a Training Manager / Chief Pilot for the
first time ever, have at least 3 years experience, within the past 6 years, as
pilot in command of
a large aircraft operated under ANR Par t VIII Vol.2, Part VIII Vol.3 and
ANR Part X.
Or if the AOC holder uses only small aircraft in its operations, the
experience may be obtained in either large or small aircraft.

(c) In the case of a person with previous experience as a Training Manager /


Chie f Pilot, have at least 3 years experience as pilot in command of a
large aircraft operated under ANR Part VIII Vol.2, Part VIII Vol.3 and
Part X, if the AOC holder operates large aircraft.
If the AOC holder uses only small aircraft in its operations, the
experience may be obtained in either large or small aircraft.

(3) To serve as Director of Maintenance a person must:

(a) Have a mechanic certificate with airframe and power plant ratings;

(b) Demonstrate 5 years of experience in a position responsible for release


aircraft to service;

(c) Have at least 1-year experience in a supervisory capacity .

(4) AOC holders may request a deviation to employ a person who does
not meet the appropriate airmen experience requirements, managerial
experience requirements, or supervisory experience requirements of this
section if the person has comparable experience, and can effectively
perform the duties associated with the position in accordance with the
requirements of the procedures outlined in the AOC holder's manual.
Approval of deviation(s) under this paragraph may be granted after
consideration of the size and scope of the operation and the qualifications of
the intended personnel.
The Director General may, at any time, terminate any grant of deviation
authority issued under this paragraph.

VII.03.20 Safety Management System

(1) Air operator Organizations shall establish a safety management


system applicable to the size, scope and complexity of their
operation activities, with a view to ensuring that operations are carried
out in a controlled and safe manner.

(2) The Air operator Organizations shall ensure that all management and
operations personnel comply with the safety requirements applicable at the
Sudanese Airports in accordance to the Sudan Civil Aviation Safety
ACT 2011 standards and requirements, and shall monitor such
compliance.

(3) The Air operator Organizations shall ensure that all its personnel
cooperate in the promotion of safety at the airport by immediately reporting
accidents, incidents, defects and faults which have an impact on safety to

SUBPART 4

GROUND HANDLING CERTIFICATION PROCESS

Ground handling certification requirements are based on the IATA Airport


Handling Manual - AHM.
The main components of the ground handling certification process are as follow:

Ground Handling Organizations (GHO) wishing to operate at Sudanese


Airports shall submit an application for Ground Handling
Certificate (GHC) in a form prescribed by the SCAA.

The application shall include the organization’s Ground Handling Manual


(GHM). The contents of the manual should be in accordance to guidance
material issued by SCAA and IATA Airport Handling Manual.

SCAA shall assess the management structures, facilities, equipment,


services and procedures contained in the applicant’s GHM to ensure that
they are appropriate for the scope and type of services as proposed.

An applicant organization that complies with the SCAA GHC


requirements may be issued a SCAA Ground Handling Certificate
(GHC).

GROUND HANDLING CERTIFICATION

All Ground Handling Organizations engaged in ground handling


operations at the Sudanese Airports shall be in possession of a valid
Ground Handling Certificate issued by the SCAA.

The standards required for the issue of a Ground Handling Certificate


shall be based on internationally recognized best practice, including IATA
Airport Handling Manual and Dangerous Goods Regulations latest
revision.

An application for a Ground Handling Certificate shall be submitted to the


SCAA in a form prescribed by the Authority. The application shall
include the organization’s Ground Handling Manual and the evidence
of the establishment of a system of internal audits conducted in
accordance with IATA AHM 060–Airport Handling Quality Audit
and AHM 612– Recommendations for Airside Safety Performance
Audits.

VII.04.01 Acronyms and Definitions

Airport Handling Manual (AHM) – Published by the International Air Transport


Association IATA. It contains the standard classification and numbering system (AHM
xxx) for the ground handling functions described in ground handling manuals.

AOC – Air Operator Certificate Baggage - such articles, effects and other personal
property of a passenger as are necessary or appropriate for wear, use, comfort, or
convenience in connection with the trip. Unless otherwise specified, it includes both
checked and unchecked baggage.

Cargo – Any goods carried on an aircraft that are covered by an air waybill.

Dangerous Goods – Articles or substances which are capable of posing significant


risk to health, safety or property when transported by air.

Dangerous Goods Regulations - Published by the International Air Transport


Association IATA. The globally accepted field source reference for companies
shipping hazardous materials by air.

Ground Handling - Services necessary for an aircraft’s arrival at, and departure
from, an airport, other than air traffic services.

GHC – Ground Handling Certificate


GHM – Ground Handling Manual
GHO – Ground Handling Organization

Handling organization – A certified organization which scope of business is to


perform ground handling functions.

IATA – International Aviation Transport Association


SCAA – Sudanese Civil Aviation Authority
Load – Any item carried on an aircraft other than what is included in the
basic operating weight.

Load control – A function to ensure the optimum utilization of the aircraft capacity
and distribution of load as dictated by safety and operational requirements.

Safety management system – a system for the management of safety of


operations. It includes the organizational structure, responsibilities, procedures,
processes and provisions for the implementation of safety policies by the
organization. It provides for the control of safety within the organization and the safe
use of facilities and equipment.

VII.04.02 Applicability
All Air Operator Certificate holders and Ground Handling Organization shall ensure
that ground handling services and activities are conducted to or provided in
accordance to requirements as set out in the Sudanese Civil Aviation Authority -
Ground Handling Regulations.

These activities or services may be conducted as part of the Air Operator Certificate
holder’s organization or under contractual agreement with a certified Ground
Handling Organization, holding a valid Ground Handling Certificate, rated for the type
of activity to be conducted.

VII.04.03 Standards and Recommended Practices

The regulations are based on the standards and recommended practices contained
in the IATA Airport Handling Manual and the IATA Dangerous Goods Regulations.

These procedures have been established as the most suitable for handling
passengers, baggage, cargo and mail, and are the acceptable means of compliance
adopted by the SCAA.

VII.04.04 Ground Handling Certificate

(1) Requirements for Ground Handling Certification All ground handling


organizations, companies, agencies and operators, engaged in ground
handling operations at Sudanese Airports shall be in possession of a
valid Ground Handling Certificate issued by the Sudanese Civil Aviation
Authority - SCAA.

(2) An application for a Ground Handling Certificate shall be submitted to


SCAA in a form and manner prescribed by the SCAA.

(3) With the Application for Ground Handling Organization, the applicant shall
submit also the organization’s Ground Handling Manual.

(4) The SCAA will endeavor to process applications that meet 1.2.3
requirements in a timely manner.

VII.04.05 Issuance of the Ground Handling Certificate

(1) Upon receipt of an application for a GHC, the SCAA shall process the
application in order to verify that the applicant:

a. Has established a satisfactory ground handling manual has been


prepared and submitted to SCAA for approval;

b. Has established a satisfactory internal audit system has been


established in accordance with the appropriate standards and
recommended practices

c. Has established an acceptable safety management system within


the organization;

d. Has established an acceptable training programmer.

e. Has established ground handling facilities, services, procedures,


training and equipment appropriate for the scope of the proposed
operation and in accordance with the relevant standards and
recommended practices;

f. Has established ground handling of dangerous goods in accordance


with the appropriate regulations

g. Is capable of operating in accordance with its Ground Handling  


Manual

h. Contracted an insurance policy covering third party liability,


appropriate to the scope and type of operation he intends to be
certified

(2) Upon successful completion of the application process, SCAA may issue
a Ground Handling Certificate (GHC).

(3) SCAA may endorse the GHC with conditions or limitations to the
operations as required.

VII.04.06 Validity of the Ground Handling Certificate

(1) The validity of the Ground Handling Certificate is based upon the scope of
operation described in the Ground Handling Manual and maintained by
submitting the GHO Annual Status Report accompanied by the applicable
fees.

(2) The SCAA may specify on the Ground Handling Certificate the expiry
date of such a certificate from the date of issue.

VII.04.07 Ground Handling Annual Status Report


(1) Requirement to Report
The holder of a GHC shall submit to the SCAA, an Annual Status Report
and an Internal Audit Report, in the form and manner specified by the
SCAA. Reporting Schedule
The holder of a GHC shall submit the Annual Status Report to the SCAA,
no later than at the anniversary of the day on which the GH authority was
issued or at a reporting schedule agreed by the Sudanese SCAA.
(2) Responsibility to Report

Failure to submit to the SCAA, the required GH Annual Status Report and
applicable fee within the specified time frame, may invalidate the ground
handling authority "Ground Handling Certificate".

VII.04.08 Ground Handling Manual (Purpose and Scope)

(1) The Ground Handling Manual is a fundamental requirement of the


certification process. It shall contain all the pertinent information concerning
the ground handling facilities, services, equipment, operating procedures,
training programmers, organizational structures and safety management
system. The information presented in the Ground Handling Manual shall
demonstrate that the organization conforms to the standards and
recommended practices.

(2) The Ground Handling Manual is the organizations’ policy and procedures
document and provides the ground handling standards to be maintained
and the level of services that the organization can provided at the applicable
airport. Information provided in the ground handling manual will enable
SCAA to assess the suitability of the organization for the type and scope of
operations proposed. It is the basic reference guide for conducting audits

and inspections, for issuing a Ground Handling Certificate and for  


subsequent safety inspections.

(3) The ground handling manual shall be developed by the Ground Handling
Organization and approved by SCAA.

(4) The Ground Handling Manual is subject to amendments, in order to ensure


that it provides current and accurate information at all times, being this the
responsibility of the Ground Handling Certificate holder is responsible in this
respect

(5) The Ground Handling Certificate holder is also responsible for submitting
the amendments in a timely manner for SCAA approval, before they
become applicable.

VII.04.09 Ground Handling Manual Format

The Ground Handling Manual shall be prepared in the following format;

a) Printed in English and signed by an authorized person;

b) In a format that facilitates revision;

c) Have a system for recording the currency of pages and amendments


and shall include a page for logging revisions; and

d) Arranged in such a manner that will facilitate the preparation, review


and approval process;

e) CEO Statement of Compliance

VII.04.10 Manual Distribution

(1) The Ground Handling Organization shall provide the SCAA with two
complete and current copies of the Ground Handling Manual for approval.

(2) The Ground Handling Organization shall keep at least one complete and
current copy of the Ground Handling Manual at their place of business.

(3) The Ground Handling Organization shall make the Ground Handling Manual
(and copies as required) available to all relevant personnel and ready for
inspection by SCAA.

VII.04.11 Information to be included in the Manual

(1) The Ground Handling Organization shall include the following particulars in
the Ground Handling Manual (detailed in Appendix I):

a. Organization administration including organizational chart, duties,


responsibilities and reporting structure of all management and
operations personnel;

b. Description of ground handling operation including scope, capabilities,


facilities and equipment;

c. Safety management system;

d. Ground handling of dangerous goods;

e. Ground handling procedures, as applicable to the scope of the


operation, using the IATA AHM number system to identify the
procedures in their respective categories;

f. Training programmer including policy and procedures, initial, recurrent


and update training;

g. The ground handling quality audit schedule;

h. The airside safety performance audit schedule;

VII.04.12 Manual Revisions and Amendments

(1) The Ground Handling Organization shall submit all amendments to SCAA in
a timely manner and as soon as practicable, in respect to any amendments
that the organization has made to the Ground Handling Manual.

(2) The Ground Handling Organization shall amend the Ground Handling
Manual, whenever necessary, in order to maintain the accuracy of the
manual and the validity of the Ground Handling Certificate.

(3) To maintain the accuracy of the Ground Handling Manual, the SCAA may
issue written directions to a Ground Handling Organization requiring them
to alter or amend the manual in accordance with the applicable directions.

VII.04.13 Obligations and Responsibilities of the GHO

The issue of a Ground Handling Certificate obliges the Ground Handling


Organization to ensure safety, regularity and efficiency of their operations at the
Sudanese Airports.

VII.04.14 Dangerous Goods Handling

(1) The Ground Handling Organization shall demonstrate compliance to


applicable recommended standards and practices as by ANR Part XI or
approved relevant technical regulations.

(2) The regulations require that, every person engaged in the handling, or
transporting of dangerous goods be trained in the aspects of these activities
that are applicable to their assigned duties.

VII.04.15 Dangerous goods training

(1) The regulations require that, every person engaged in the handling or
transporting of dangerous goods be trained in the aspects of these activities
that are applicable to their assigned duties. This is self-evident and is of most
important concern in managing the handling and shipments of dangerous
goods. Without training, workers are not able to detect and identify the proper
action for consignment, or properly labeled and documented dangerous
goods. Without proper identification labeling and documentation, placards of
loads, proper handling may not occur and a resulting accident caused by
improper handling may escalate into a very serious incident for responders
and greatly endanger public safety.

(2) International requirements prescribe labels and placards for each


classification of dangerous goods as well as information to be in documents
that must accompany the consignment of dangerous goods.

(3) Markings and documentation are intended to convey the nature of the danger
to handlers and accident responders. Generally, smaller packages are
required to be labeled while larger shipments that are shipped in bulk
containers are placarded. Transport units that are used to ship dangerous
goods must be placarded in accordance with the regulations. The handling
organization should ensure that the goods is packaged in a way that ensures
no discharge, emission or escape of the dangerous goods that could result in
danger to life, health, property or the environment. Applicable documents
must accompany the consignment and be readily accessible.

(4) When no standard packaging is prescribed, the handling organization shall


ensure that the dangerous goods is packaged in a way that ensures no
discharge, emission or escape of the dangerous goods that could result in
danger to life, health, property or the environment.

VII.04.16 Guidelines for training criteria

The SCAA acceptable dangerous goods training minimum criteria, is incorporated as


Appendix I to this Standard.

(1) The Ground Handling Organization will allow personnel authorized by


SCAA to access its premises to carry out safety audits and inspections.

VII.04.17 Training and Competence of personnel

(1) The Ground Handling Organization shall employ adequate numbers of


qualified and skilled personnel for performing all activities in its operations.

(2) Where the SCAA or parent organization has established security and
competency requirements for personnel, the Ground Handling Organization
shall employ only those persons possessing documented evidence or
certificate attesting they meet the applicable requirements.

(3) The Ground Handling Organization shall implement a system to maintain


the competency of the personnel.
(4) The Ground Handling Organization shall implement training programs that
include initial, recurrent and update training of the personnel.

VII.04.18 Ground Handling Operations

(1) The Ground Handling Organization shall operate in accordance with the
procedures set out in its Ground Handling Manual, unless otherwise
directed by the SCAA.

(2) To ensure the safety of passengers and aircraft, the SCAA may give written
directions to the Ground Handling Organization to alter the procedures set
out in its Ground Handling Manual.

(3) The Ground Handling Organization shall ensure proper and efficient
maintenance of its facilities and equipment.

VII.04.19 Safety Management System

(1) Ground Handling Organizations shall establish a safety management


system applicable to the size, scope and complexity of their handling
activities, with a view to ensuring that operations are carried out in a
controlled and safe manner.

(2) The Ground Handling Organizations shall ensure that all management and
operations personnel comply with the safety requirements applicable at the
Sudanese Airports in accordance to the set SCAA standards and
requirements, and shall monitor such compliance.

(3) The Ground Handling Organizations shall ensure that all its personnel
cooperate in the promotion of safety at the airport by immediately reporting
accidents, incidents, defects and faults which have an impact on safety to
SCAA.

VII.04.20 Internal Audits

(1) The Ground Handling Organization shall arrange for an internal airside
safety performance audit in accordance with applicable recommended
practices.

(2) The audits, referred to shall be carried out every 12 months and the results
submitted to SCAA with the application for renewal of the Ground Handling
Certificate.

(3) The Ground Handling Organization shall ensure that the audit reports are
prepared by suitably qualified personnel.

VII.04.21 Emergency Response

(1) The Ground Handling Organization shall establish a formal emergency


response procedure and train its personnel on the implementation of such a
procedure.

(2) Emergency response contact information shall be made available to all


Ground Handling Organization personnel in order to enable timely response
in case an emergency or incident requiring response action occurs.
