No. 0679-19 Be It ordained by the Honorable Sangguniang Panlungsod of Davao City, in session assembled that: Article I. ‘TITLE OF THE ORDINANCE Section 1.Short Title, This Ordinance shall be known as the “Davao City Comprehensive STI, HIV and AIDS Ordinance of 2013”. Article 1: DECLARATION OF POLICY Section 1. Declaration of Policy. The Sexually Transmitted Infection, Human Immunodefidency Virus and Acquired Immune Deficiency Syndrome (STI, HIV and AIDS) are public health concems that have wide ranging socal, poltical and economic repercussions, AS Such, responding to the STI, HIV and AIDS epidemic is imbued with public interest, and thus the City Goverment of Davao commits itself to the fight against the epidemic, The Cty revent the spread of HIV and other economic consequences to fight rus and mitigate any related social, Government of Davao commits to make actions lated social, psychologi To prevent the spread of jic consequences, as follows: nment of Davao shall establish policies and programs to prevent the HIV and AIDS and deliver treatment, care and support services to persons living with HIV in accordance with evidence-based strategies and approaches eee follow the principles of human rights, gender equalty, and meaningful participation of communities affected by the epidemic; 1. Definition of Terms. Community-based HIV Screening - refers to a nomlaboratory rapid screening procedure done outside a heath facity by a trained member of @ ‘community-based organizations or groups; Compulsory HIV Testing - refers to HIV testing imposed upon @ person attended or characterized by the lack of consent, use of force or intimidation; HIV Counseling and Testing Site/Facility - refers to DOH accredited HIV testing facility with HIV proficient Medical Technologist; Discrimination - refers to any action taken to distinguish, exclude, restrict or show gender, age, sexual orientation, gender whether actual or perceived, and impairing the recognition, enjoyment or ights and freedoms; preference based on any ground such as Sex, identity, economic status, disability, and which has the purpose or effect exercise by all persons similarly situated, Entertainment Establishments - are business establishments which include bars, rightelubs, eer houses, karaoke bars/sing-along pub houses and other similar establishments within Davao City; |. Ethics of Care - health care providers embraces the universal values of liberty, justice, ‘confidentiality, respect, gender equity and equality to clients; .. Falth-based Organization- refers to a group of individuals united on the basis of their religious and or spiritual beliefs; . Gender Identity: refers to a person's intemal and individual experience of gender that may or may not correspond with the sex assigned at birth; Health Certificate- is a certification In writing using the prescribed form issued by the City Health Officer stating that the person applying for or renewing such certificate, is permitted by the said Officer or hisfher duly authorized representative to work In an ecblishment, This certification fs Issued to the person applying for or renewing such, dfter passing the required physical and medical examinations, immunizations and other Gxaminations as maybe required by the City Health Officer or his duly authorized representative; HIV and AIDS Counselor- refers to any individual tralned by an Institution or ‘organization accredited by the Department of Health to conduct counseling on STI, HIV and AIDS, HIV prevention, human rights and stigma reduction; . No, 0679-19 HIV and AIDS Prevention and Control - refers to measures aimed at protecting ‘Ron-infected persons from contracting HIV and minimizing the Impact of the condition of persons living with HIV; . HIV and STI Counseling - refers to the provision of information on STI, HIV and ‘AIDS, how it is spread and how it may be prevented, risk-reduction approaches, and Information on treatment, care and support for persons living with HIV, which is conducted before and after HIV testing; HIV Testing - refers to any faclty-based or mobile medical procedure that Is ‘conducted to determine the presence or absence of HIV in person’s body; Human Immunodeficiency Virus (HIV) - refers to the virus that destroys the immune system of a person which causes AIDS; Indigent Clients - refers to cients that fit to the criteria and definition of the Davao ity Social Services and Development Office; Information Material - shall mean any written and/or printed material which educates the public; Key Populations at Higher Risk of STE and HIV Exposure or ‘Key Populations’ refer to those persons whose behavior make them more likely to be exposed to HIV or to transmit the virus, as determined by Philippine National AIDS Council ( PNAC); Medical Confidentiality - refers to the relationship of trust and confidence created or existing between a patient or a person living with HIV and his or her attending health ‘care providers and or any person providing services or those who have acvess to ‘medical records; Medical Practitioner - licensed Doctor of Medicine engaged in health work in hospitals, clinics, sanitaria, health stations, barangay health centers and the like; Partner Notification - refers to the method of finding and counseling the sexual partner(s) of a person who has been diagnosed as having Sexually-Transmitted Infection and HIV; Peer Educator - is a trained STI, HIV and AIDS educator who is capable of Influencing, motivating and developing healthy behaviors among his/her peers; Person Living with HIV - refers to any individual diagnosed to be infected with HIV; Quality Healthcare - as Indicated by standards set by WHO, accessibility and affordability of medical needs, ethical care, and appropriateness. of provider's knowledge on STI, HIV and AIDS, sexual and reproductive health and rights, gender sensitive_in thelr Interpersonal relations with patients and adept diagnostic treatment ‘and follow-up procedure of health providers; Reproductive Health - it is a state of complete physical, mental, and social well- being and not merely the absence of disease and Infirm ‘matters relating to the reproductive system and its functions and processes, as defined in the Cairo International Conference on Population and Development and World Health Organization and further affirmed by the Beljing Conference of the United Nations; Reproductive Health and Wellness Center (RHWC) wellness center which Purpose Is to achleve universal availability and accessi productive health care ‘and services, provides HIV related services and treatment in Davao City; Health Education, Promotion and Development Division - Conducts information, ‘education and promotion campaign and training on Reproductive Health, STI, HIV and AIDS activities under the City Health Office; ‘Seanned ith CanSeanner oo Republic v or ofthe Ph "ie ofthe Sangguniang ees ™ x Page 5 of 13 Ord. STI, HIV and AIDS Prevention. The Davao City AIDS ‘Council through the City Health Office-HPDD in coordination with the Department of Labor and Employment (DOLE) and the Cill Service Commission (CSC) shall provide standard basic information and instruction on STI, HIV and AIDS, national and local HIV related laws and ther related issues of stigma reduction and discrimination in the workplace, public and private, Including the Armed Forces of the ines (AFP) and the Philippine National Police (PNP). Section 11. Compulsory STI, HIV/AIDS Education. The Davao City AIDS Council through the City Health Office-HPDD shall coordinate with the DOLE and its attached agencies the Philippine Overseas Employment Administration (POEA) and Overseas Workers Welfare Administration (OWWA) to ensure that all overseas Fllpina workers shall be provided with information on how to access on-site STI, HIV and AIDS-related services and faciities before certification of overseas assignment. Section 13. HIV and AIDS Education in Communities.
