Presidential Decree 1006, R.A No. 7836 and R.A No. 9293

All laws must be implemented consistently and enacted with the authorities

provided under the Constitution. It forms the basis for all regulations, guidance and

policies that explain what you can, cannot and must do. In addition, laws can be

amended or changed, it is only when Congress enacts and if the President signs. In

this paper, we will discuss the connections (similarities, differences) among the

three laws: The Presidential Decree 1006, R.A No. 7836 and R.A No. 9293.

These three laws are all concerned on teachers’ professionalization. In PD

1006 requires the teachers to have a license as a requirement for teaching. After

this law, another law was declared, it is the Republic Act No. 7836 which also

recognized the vital role of teacher’s in constructing and structuring of the society.

As stated earlier, that laws can be amended, the proclamation of Republic Act No.

9293 which certain sections of R.A No. 7836 are being amended, likewise, it is

enacted law related to professionalization of teachers, their practices and other

purposes. In terms of the definition of teachers, PD 1006 and R.A No. 7836 have

almost the same definition, which refers to all persons who are engaged in teaching

at the elementary and secondary levels, whether on a full-time or part-time basis,

including industrial arts or vocational teachers and all other persons performing

supervisory and/or administrative functions in all schools in the aforesaid levels and

legally qualified to practice teaching, but the words guidance counselors and school

librarians are mentioned in PD 1006. The term commission were added in R.A No.

7836. With regards in the scope of examination, in PD 1006 the examination is

consist of written tests, for both elementary and secondary teachers but the scope

was not clearly stated, while in R.A No. 7836, the examinations for both elementary

and secondary are separated. It means that for elementary level, the examination

for teachers consists of two parts which includes the professional education and

general education, while in secondary level, it consists of three parts including the

professional education, general education and field of specialization. The rating is

not inscribed in R.A No. 7836, but in PD 1006, the candidate must obtain a general

average of at least 70% in all subjects with no rating below 50% in any subject in

order to successfully passed the examination. Also it is much longer the waiting

time for the reporting the result in PD 1006 (150 day) than in R.A No. 7836 (120

days after last day of examination). Through PD 1006, the National board for

teachers was then the first board to exercise regulatory exercise over the teaching

profession but later on, it was transferred to the PRC by the enactment of R.A No.

7836. For causes of revocation of certificate and/or license in PD 1006 were not

included but in R.A No. 7836 it is included.

In Republic Act No. 9293, certain sections of R.A No. 7836 are being

amended. Such amendments will be discussing in this part. For Section 15

particularly in (e) (3) of R.A No. 7836 is hereby amended that for teachers in the

secondary grades, a bachelor’s degree in education or its equivalent with a major

and minor, o a bachelor degree in arts and sciences with at least eighteen (18) units

(in R.A No. 7836 it is ten units) in professional education to be able to become

qualified applicant to take the examination for teacher. Next amended is in the

Section 26, in R.A No. 9293 the statement about the professional teachers who have

not practiced their profession for the past five years should take 12 units of

education courses or equivalent training and number of hours provided by the

Board and the Department of Education before allowing them to practice their

teaching profession is added. Lastly, the amendment in Section 31 of R.A No. 7836,

it is being re-stated that those incumbent teachers will be given a special permit

with a validity of three and five years (in R.A No. 7836 five years’ temporary

certificate is mentioned). But only special permits with a validity of three years may

be renewed upon expiration for non-extendible period of two years.
