ASSIGNMENT:
1. Meaning of clemency and indeterminate sentence
Clemency is a procedure for obtaining relief from a court-ordered punishment or punitive action
to a person guilty of a criminal offense. Clemency can be granted via one of two methods:
pardon or commuting of sentence. In law, an indeterminate sentence is a period of imprisonment
that has no set length but is limited to a certain maximum. The parole authority determines
whether or not a person is eligible for parole.
2. Effects of pardon
While a pardon is commonly thought of as erasing the offender's guilt and making him as
innocent as if he had never committed the crime in the eyes of the law, it does not work in all
cases. Forgiveness or remission of guilt is at the heart of a pardon. Pardon means that you are
guilty. It doesn't change the fact that a crime was committed or that a person was convicted of it.
It does not remove the moral blemish. It entails forgiving rather than oblivion.
3. Difference between absolute and conditional pardon
Conditional pardon, which exempts an individual from punishment for a crime committed within
specific limits or conditions, resulting in the partial elimination of his or her criminal obligation;
and Absolute pardon is when a person's criminal obligation is completely removed without any
conditions.
4. Difference between reprieve and commutation of sentence
Commutation of sentence is not the same as pardon, which, if granted unconditionally, removes
the stigma of both the court judgement and the punishment while also restoring the person's civil
rights; commutation does neither. Commutation is not to be confused with reprieve, which just
delays or suspends the sentence.
5. What is RA 10707 all about
Volunteer Probation Assistants (VPAs). — To assist the Chief Probation and Parole Officers in
the supervised treatment program of the probationers, the Probation Administrator may appoint
citizens of good repute and probity, who have the willingness, aptitude, and capability to act as
VPAs.
