ORDER FOR TEMPORARY INJUNCTION

The above-captioned matter having come before the Court, the Honorable Marc A.

Hammer, presiding, for a hearing on Plaintiffs’ Motion for Ex-Parte Temporary Restraining

Order and Temporary Injunction on November 2, 2022. The Court, having reviewed the written

submissions and having heard oral arguments by counsel for Plaintiffs and Defendant, and

making findings and conclusions on the record, which are hereby incorporated by reference,

hereby enters the following:

IT IS HEREBY ORDERED:

1. That Defendant, Celestine Jeffreys, in her official capacity as City Clerk for the

City of Green Bay, Wisconsin, and her employees, representatives, agents, or designees, are

enjoined from preventing or restricting members of the public from observing the public aspects

of the in-person absentee ballot voting process, in particular, the witnessing of an elector’s

absentee ballot and the elector’s depositing or returning of a completed absentee ballot into a

ballot box during in person absentee voting, as required under Wis. Stat. § 7.41.

2. That, by 2:00 p.m. on November 2, 2022, Defendant shall create, adopt, and

implement a policy or procedure that complies with paragraph 1 of this Order and permits

members of the public from observing the public aspects of the in-person absentee ballot voting

process that is ongoing inside City Hall for the City of Green Bay, in particular, the witnessing of

an elector’s absentee ballot and the elector’s depositing or returning of a completed absentee

ballot into a ballot box during in person absentee voting, as required under Wis. Stat. § 7.41.

3. The foregoing orders shall remain in effect during the pendency of this case and

until further notified by the Court.
