The case of the petitioner is that she


was appointed as Fair Price Shop Dealer of
Shop No.37 of Gosanipalli Village, Dhone
Mandal, Kurnool District on 06.11.2012.
The petitioner’s authorisation is valid till
31.03.2023. The petitioner has been
distributing the essential commodities to
the cardholders regularly without any
complaint from any quarter. While things
stood thus, on 24.11.2021, the 3rd
respondent inspected the shop and
submitted a report to the 2nd respondent to
initiate disciplinary proceedings. Pending
disciplinary proceedings against the
petitioner, she was denied supply of
essential commodities to distribute the
same to the cardholders, which is illegal
and arbitrary as held by this Court in
Voleti Tirupathamma Vs. District Supply

Officer (City), Visakhapatnam, 2002 (1)


ALD 577. The petitioner is entitled for
supply of essential commodities as long as
the authorisation is valid and subsisting.
Non-supply of essential commodities to the
petitioner without suspension or
cancellation of authorisation is illegal.

Having regard to the facts and


circumstances of the case, submissions of
the learned counsel and on perusal of the
material record, this Court is prima facie
satisfied that the petitioner has shown
sufficient cause for grant of interim order.

Accordingly, there shall be interim


direction as prayed for.
