HOA RULES AND REGULATIONS

Due to the special circumstances of close quarters living at Whispering Winds Casitas (to maintaining the value, insuring an attractive, and uniform community) these rules and regulations in addition to the CC & R s and by-laws are necessary. Violations of these rules and regulations are subject to warnings and/or fines by the Home Owners Association. Fines will be $25 for 1st offense, $50 for 2nd offense, and $100 for each offense thereafter or as noted. Failure to correct the violation within the specified time will result in fines being doubled. It is every Owner s responsibility to make sure that their tenants if rented receive a copy of the Rules and Regulations. Notice of the violation will be sent to the Owner only. Owner will be held liable for any violations committed by them or their tenants and or guests. Communication outside of HOA meetings should be done via the HOA Blog at www.9316balsam.blogspot.com, in writing, or via email at 9316balsam@gmail.com WHISPERING WINDS COMMON AREAS: FOR THE SAFETY OF ALL PERSONS WHILE IN OUR COMMUNITY: There is no riding of bicycle(s), roller skates, scooters, skateboards, and wagons (motorized vehicles included) on our community grounds. There will be no ball playing of any kind, i.e. football, baseball, soccer, etc. Residents will keep off of the landscaping, i.e. grass, trees, and bushes. There will be a $25.00 fee plus costs of repairs for anyone found destroying any part of our landscaping. Rock throwing is not allowed. Legal action will be pursued. The use of firearms, BB guns, pellet guns, knives, and slingshot or archery equipment are not permitted within the common areas of Whispering Winds property.

Climbing on buildings is prohibited except as necessary to maintain each unit. Noise is to be maintained at reasonable levels so as not to disturb other residents and in compliance with municipal regulations. No motor vehicle, trailer, camper, motorcycle, boat, etc. is to be driven or parked on common area grass, gravel or sidewalks at any time. PERSONAL PROPERTY: No personal property of any kind will be placed or kept on the landscaping. Lawns, trees and shrubbery are a vital and valuable part of the Community. Owners and Tenants understand they will be responsible for any damage, which is caused by the tenants, their guests or visitors. TRASH: Trash newspapers, cans and other garbage should be placed only in the designated containers. Items left outside the dumpster are subject to an immediate $60.00 fine. Owner and Tenants will comply with all governmental regulations relating to the containers and their use. The dumpster lids must remain closed at all times. Lessees, their families, and guests shall maintain order in the buildings and grounds. Lessees are responsible for actions of their guests. MANAGEMENT WILL HAVE THE RIGHT TO DETERMINE WHAT CONSTITUTES DISORDER OR INTERFERENCE WITH THE RIGHTS AND COMFORTS OF OTHER RESIDENTS. AN ADULT MUST ACCOMPANY ANYONE UNDER THE AGE OF 14 AT ALL TIMES WHILE ON THE PROPERTY. PETS: All animals must be on a leash, in hand, and in control of at all times when in designated pet areas of the community. Animal Control will be alerted and fines assessed by the HOA should there be a problem. Pets are not allowed in the laundry area. Immediate removal of animal droppings is required as they occur.

No animals are to be tied or kept outside of the Dwelling Unit. Failure to abide will result in an immediate fine of $60.00 Pets may not cause a disturbance to others due to noise or their vicious nature, etc.

VEHICLES: Auto repair, including the changing of oil, is not permitted within the common parking areas. Repairing of any motor vehicle for compensation of any kind is prohibited. The speed limit is 10 miles an hour. PARKING: ANY VEHICLE IN VIOLATION OF THE PARKING GUIDELINES WILL BE SUBJECT TO TOWING AT VEHICLE OWNER S EXPENSE WITHOUT ANY PRIOR WARNING OF A VIOLATION. Please be advised: Parking in any of the drives or fire lane areas is prohibited. Parking in front of any unit is prohibited. Any vehicle in non-operational condition or with any of the following will be towed from the property: expired license plate, no current registration tags, not covered by insurance, broken windows, flat tires or vehicles leaking any kind of fluids. Owner of said vehicle will be assessed the cost of any clean-up required. All vehicles must be parked in a designated parking area. Management and HOA reserve the right to tow away, at owner s expense, any vehicle improperly parked or in violation of the above rules without prior notice being placed on the vehicle. CAR ALARMS: Any vehicle that has an anti-theft alarm or horn that goes off repeatedly and disturbs residents for more than 15 minutes will be towed at the owner s expense. This policy shall be considered notice to the owner or operator and no further notice to the owner or operator shall be necessary prior to towing. BUILDING EXTERIOR: The porches and patios shall not be obstructed or used for any purpose other than those of the ingress or egress. Please keep your patios and areas surrounding units clean. Appropriate patio furniture is allowed if neatly organized and safety is observed. Upholstered and indoor-type furniture is prohibited.

Residents are not to hang, display, or expose to public view any clothing, laundry, mops, brooms, or other items inconsistent with the dcor and atmosphere of the Community. No Appliances of any kind allowed outside the units, except enclosed water heaters as approved by HOA.

WINDOWS: To keep the overall appearance of the property attractive, foil, solar screens, masking tape or any foreign objects cannot be used on the windows. Colored blinds are not allowed nor colored drapes on the outside of the unit. Only window treatments with neutral color linings will be allowed. Items should not be placed on the windows. No shades, screens, awnings or other projections will be attached to or extend beyond the outside walls, windows, or doors of the dwelling unit without the HOA written consent. BARBEQUE GRILLS: Gas grills are allowed on the patio as long as proof of renter s insurance is provided to HOA naming them and their agent as additionally insured, Owner must provide copy of said endorsement to HOA. Fire pits, bonfires, charcoal grills, smokers, and similar incendiary devices are prohibited. SIGNAGE: No signs, advertisements, notice or other lettering will be placed anywhere in the Community or on the outside of the dwelling unit, except as provided for in Arizona Revised Statutes. This Community has the right to make reasonable changes to these rules and regulations, from time to time as maybe needed in its judgment, which may be needed to enhance the cleanliness and orderliness of the premises, and safety and comfort of the residents. Notice of any rule change will be made in writing and posted on the HOA blog (site address listed on first page of these rules).

Landlord & Tenants The rules and regulations constitutes an agreement between the parties and upon violation the lease may be canceled at the option of the lessor giving written notice of its intention to declare the lease canceled whereby the lease shall cease and terminate.
