6.1 Responsibilities of the Bidder

Delivery and Documents –


The Delivery terms of this Contract shall be as follows:

BREAKFAST: Daily distribution to ______ on the project site shall be


before 7:00 am

LUNCH: Daily distribution to _______ on the project site shall be before


12:00 noon

DINNER: Daily distribution to _______ on the project site shall be before


5:30 pm

Risk and title will pass from the Supplier to the Procuring Entity upon
receipt and final acceptance of the Goods at their final destination.”
Delivery of the Goods shall be made by the Supplier in accordance with the
terms specified in Section VI Schedule of Requirements.
For purposes of this Clause the Procuring Entity’s Representative at the
Project Site is OIC/Head of the security camp.

Packaging –
The Supplier shall provide such packaging of the Goods as is required to
prevent their damage or deterioration during transit to their final destination,
as indicated in this Contract. The packaging shall be sufficient to withstand,
without limitation, rough handling during transit and exposure to extreme
temperatures, salt and precipitation during transit, and open storage.

Transportation –

Deliveries. In the case of Goods supplied from within the Philippines or


supplied by domestic Suppliers risk and title will not be deemed to have
passed to the Procuring Entity until their receipt and final acceptance at the
final destination.
7 No subcontracting shall be allowed.
8 Procuring Entity’s Responsibilities

The (Camp)________ shall provide the following:


a) Area for cooking facilities for the preparation of foods (in good order
and working condition)
b) Uninterrupted supply of water and electricity (actual consumption shall
be for the account of the winning bidder)
c) On-site Cold Storage for perishable items maintained at desired
temperatures (below -10˚C) [DELETE][REQUIRE BIDDER TO
SHOW PROOF OF CONTRACT WITH DA-ACCREDITED COLD
STORAGE]
d) Space for Storage area for non perishable items
e) Security personnel
f) PDL Workers
10.3 Payments to the winning caterer for its services will be made every 10 th
day, 20th day and last day of the month.

16.1 INSPECTION AND ACCEPTANCE
There shall be a Food Inspection Team (FIT) that shall have the
responsibility to inspect, test and accept food and food products provided to
PDL. Inspection and acceptance will be conducted by the FIT and prior to
the distribution of items at the Project Site. Goods with defect or non-
compliant with the scheduled menu for the day as stipulated in the Technical
Specifications and/or Schedule of Requirements shall be reported to the
LRP Superintendent for appropriate penalties and/or sanctions
The Goods shall be deemed as accepted by the end user after passing the
inspection of the FIT

The inspections and tests that will be conducted are: physical as to quantity;
and qualitative in accordance with the APPROVED menu plan.

52.4 Any defects in the foods prepared/served shall be replaced immediately.
Notice will be issued to the caterer for the non-acceptance food due to
defects (unfit for human consumption food poisoning or other similar
complaint) based on a substantial verified complaint/s by the end-user
submitted to the FIT for subsequent recommendation for the termination of
contract subject to the approval of the HOPE .
56.1 All partners to the joint venture shall be jointly and severally liable to the
Procuring Entity.
22 Force majeure will also include, but not limited to, fire, earthquake,
typhoon, flood, riots, coups, civil disorder, war, power black-outs, brown-
outs, strikes, picketing, and gang war.
Un-availability of raw materials under circumstances which the
caterer/provider could not have foreseen, or which though foreseen, was
inevitable, will be deemed as force majeure or fortuitous event.
